Abstract

Haryono No. 169 Malang e-mail: intannurainii@student.ub.ac.id ABSTRAK Pengungsi yang merupakan salah satu pergerakan manusia lintas batas negara seharusnya tidak diputus oleh pengadilan nasional suatu negara tanpa mengaplikasikan refugee law sebagai bahan pertimbangannya, utamanya bagi negara-negara yang belum memiliki instrumen hukum nasional khusus tentang pengungsi. Absennya prinsip non-refoulement yang merupakan prinsip terpenting refugee law dalam putusan Supreme Court India atas kasus Mohammad Salimullah & ANR. v Union of India & ORS. mengakibatkan 150 – 170 pengungsi Rohingya di Jammu terancam mengalami deportasi ke negara asal mereka, yakni Myanmar. Dengan pendekatan konseptual, perundang-undangan, dan menelaah putusan-putusan pengadilan yang ada sebelumnya, Peneliti menganalisis keberlakuan prinsip non-refoulement sebagai bagian dari jus cogens dalam hukum nasional Indonesia berkaitan dengan kewajiban negara India terhadap pengungsi Rohingya di negaranya. Sebagai bagian dari jus cogens, prinsip non-refoulement berlaku secara universal bagi seluruh negara di dunia, termasuk India, tanpa memandang apakah negara tersebut merupakan negara peserta konvensi internasional yang mengandung prinsip non-refoulement atau tidak. Selain itu, prinsip non-refoulement juga telah diakui sebagai custom sebelum mendapatkan status sebagai jus cogens dan ditinjau dari putusan-putusan pengadilan sebelumnya, prinsip non-refoulement terbukti diakui dan diterapkan dalam hukum nasional India. Hal ini semakin memperkuat kewajiban India untuk mematuhi prinsip tersebut dan Supreme Court dapat langsung mengaplikasikannya sebagai bahan pertimbangan tanpa memerlukan adanya inkorporasi atau transformasi. Oleh karena itu, putusan Supreme Court India atas kasus Mohammad Salimullah dinilai tidak sesuai dengan kewajiban negara India terhadap prinsip non-refoulement sebagai jus cogens maupun kewajiban internasional India yang lain terhadap pengungsi Rohingya di negaranya. Kata Kunci: Prinsip Non-Refoulement, Jus Cogens, Kewajiban Negara, India, Pengungsi Rohingya ABSTRACT The cross-boundary crimes should not be judged within the scope of a national court without applying refugee law as the consideration, especially for countries with no instrument of national law concerning refugees. The absence of the non-refoulement principle as the vital principle of refugee law in the Supreme Court Decision of India over the case of Mohammad Salimullah & ANR. V Union of India & ORS has caused 150 to 170 Rohingya refugees in Jammu to face refoulement deporting them to Myanmar. With conceptual and statutory approaches and the technique of analyzing the previous court decisions, this research analyzes the non-refoulement principle as part of just cogens in the national law of Indonesia regarding the responsibility of India for Rohingya refugees in the country. As part of jus cogens, the non-refoulement principle applies universally to all countries worldwide, including India without questioning whether the state concerned is a member of an international convention that takes into account the refoulement principle. Moreover, this principle started to be recognized as custom before it gained its status as just cogens. As seen from earlier court decisions, the non-refoulement principle is recognized and applicable in national law in India. This condition strengthens the responsibility of India to comply with this principle, and Supreme Court could directly apply this as a matter of consideration without any transformation. Therefore, the Supreme Court Decision of India over the case of Mohammad Salimullah is deemed not relevant to the responsibility of India regarding the refoulement concept as jus cogens or as the international responsibility held by India for Rohingya refugees in the country. Abstract

The moral crisis has become a hot topic frequently discussed in various mass media lately. Various forms of moral crisis can be observed among different younger generations, including within the environment of Islamic boarding schools. In recent years, there has been a shift in values and behaviors among teenagers influenced by technology, social media, and cultural changes, leading to a decline in awareness of social ethics and prevailing norms in society. Through a holistic and integrated approach, social ethics education will provide understanding to female students about the importance of values such as empathy, tolerance, social responsibility, equality, and justice. This research aims to explore the concepts of social ethics values, the internalization process of social ethics education values, as well as the supporting and inhibiting factors of internalizing social ethics education values in the Al-Qur’an Specialized Boarding School of Kalibeber Wonosobo. The research method employed is qualitative to gain in-depth understanding. The findings indicate that the concept of internalizing social ethics education values for female students is a key factor in shaping noble character. The social ethics of female students in the Al-Qur’an Specialized Boarding School of Kalibeber Wonosobo is deemed positive based on their daily habits, and they have successfully addressed several issues through implemented programs, ensuring that the process of internalizing social ethics education values progresses as expected.

Abstract

Adolescence is the peak of high emotional development, in early adolescence emotional development is very sensitive and reactive to events or social situations that are under pressure and new conditions. Their emotions tend to be negative and temperamental. This makes the teenager’s emotions often explode in the form of irritability and self-will that doesn’t want to be told. Every teenager is a person with individual growth patterns and timing, as well as personality, background and family experiences. Likewise in their behavior, the things that underlie or cause the emergence of a behavior in adolescents are of course also very diverse. Aggressive behavior for example. In general, aggressive behavior in adolescents tends to hurt other people, aggressive behavior can also deliberately vent one’s emotions. Aggressive behavior can be done by anyone, including teenagers. Factors that influence aggressive behavior are not only from within the individual but also from environmental influences. In our view, these problems can be overcome through the Rational Emotive Behavior Therapy (REBT) approach. Where in this approach focuses on the process of thinking and behavior. Irrational mindset will lead to a life that is not good. Conversely, a rational mindset will lead to a happy, comfortable and effective life. There are three techniques in this Rational Emotive Behavior Therapy (REBT) approach, cognitive techniques, emotive techniques and behavioral techniques. However, researchers only focus on one technique, namely cognitive techniques. The purpose of this research is that humans can live effectively and happily by having rational mindsets and behaviors about their lives. The results of this study are able to make clients reduce the habit of making counselees overcome aggressive behavior towards others, willing to listen if others tell them and also not saying harshly to other people.

Abstract

The ability to speak Indonesian is a crucial aspect of children's development, as it plays a significant role in learning, communication, and social interaction both in school and in the wider community. This study aims to analyze the impact of local language use on students’ Indonesian language proficiency, focusing on fourth-grade students at SDN 03 Kelabu. All 20 students in the class were selected as the research sample. This research employs a qualitative approach using observation and interviews to gather in-depth data regarding students’ daily language habits and their effects on classroom learning. The findings reveal that the dominant use of local languages at home and in the surrounding environment limits the students' ability to use Indonesian actively, particularly in formal learning contexts. This negatively affects their communication skills—both spoken and written—and hinders academic achievement. The study is analyzed through social learning theory and ecological systems theory, which explain that language development is influenced by interactions between individuals and their immediate environments, such as family, peers, and school. Based on these findings, it is recommended that teachers and parents actively encourage the use of Indonesian in daily activities, especially in educational settings. The study also provides suggestions for further research on strategies to improve Indonesian language proficiency in areas where local languages are predominantly spoken.

Abstract

Environmental conditions and community activities impact surface water and groundwater quality. Physical, chemical, and biological parameters can be used to assess water quality so that i can be used by established quality standars. This study aimed to assess the quality of surface water and groundwater around the Samarinda State Agricultural Polytechnic using TDS, pH, COD, Fe, and Zn parameter sat eight different sampling locations. Water quality assessment based on physical and chemical parameters follows the guidelines of Goverment Regulation No. 22 of 2021. Based on the research results, the TDS value range is 61 mg/L – 320 mg/L; the pH value range is 5,4 – 7,97; the COD value range is 136 mg/L – 208 mg/L; the Fe value range is between 21,4 mg/L and 27,3 mg/L, and the Zn value range is between 0,89 mg/L and 1,44 mg/L. This indicates that some water quality parameters, including COD, Fe, and Zn, do not meet the quality limits set by Government Regulation No. 22 of 2021.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis kesulitan yang dialami siswa kelas IVB SDN Wates 01 dalam berbicara Bahasa Jawa. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan teknik pengumpulan data melalui observasi, wawancara, dokumentasi, dan analisis video. Hasil penelitian menunjukkan bahwa siswa mengalami berbagai kendala dalam berbicara bahasa Jawa, meliputi aspek kebahasaan (lafal, kosakata, dan struktur kalimat), serta nonkebahasaan (materi, kelancaran, dan gaya berbicara). Kesulitan tersebut tercermin dalam pelafalan fonem yang kurang tepat, keterbatasan dalam memilih kosakata yang sesuai, penyusunan kalimat yang kurang runtut, penggunaan jeda yang tidak tepat, hingga gaya berbicara yang minim ekspresi dan tidak komunikatif. Temuan ini menunjukkan perlunya penguatan strategi pembelajaran yang lebih komunikatif, kontekstual, dan berbasis praktik, serta keterlibatan aktif orang tua dan lingkungan sekitar dalam mendukung pembiasaan dan pelestarian Bahasa Jawa di kalangan siswa.

Abstract

The learning process carried out by many teachers today tends to achieve the target curriculum materialand is more concerned with memorizing concepts rather than understanding. This can be seen from thelearning activities in the classroom which are always dominated by the teacher. In delivering material,the teacher usually uses the lecture method in which students only sit, take notes, and listen to what theteacher says and there are few opportunities for students to ask questions. Thus, the learning atmosphereis not conducive so that students become passive. If students are psychologically less interested in thelearning method or model used by the teacher, students will naturally provide psychological feedbackthat is less supportive in the learning process. The indication is that there is a feeling of not havingsympathy for the teacher, not being interested in learning materials, and over time, indifference to thesubject of learning arises. Fun learning can make students dare to try, or do, dare to ask questions, dareto express ideas, dare to question the ideas of others. Therefore the author realizes that the PAKEMlearning model is suitable for improving student learning outcomes. Because the PAKEM learning model(Active, Creative, Effective, and Fun Learning) allows students to do a variety of activities to developskills, attitudes, and understanding of various sources and learning aids including the use of theenvironment so that learning is more interesting, fun and effective.
