Abstract

Pengaturan hukum tentang pengendalian, pengawasan, penentuan daerah/tempat penjualan, kewenangan penerbitan ijin minuman beralkohol dan ketentuan mengenai pengaturan minuman beralkohol tradisional memiliki urgenitas, mengingat Bali sebagai salah satu tujuan wisata domestic dan manca negara. Bahwa minuman beralkohol tradisional juga digunakan sebagai salah satu pelengkap sarana upacara keagamaan. Peneliti melihat telah terjadi kekosongan hukum setelah terbitnya Peraturan Presiden No 74 tahun 2013 tentang Pengendalian dan Pengawasan Minuman Beralkohol. Keadaan ini tentu dapat memunculkan persoalan ketidakpastian hukum. Artikel ini merupakan penelitian hukum normative, dengan melakukan pendekatan peraturan perundangan, pendekatan sejarah, dan pendekatan konsep. Hasil penelitian menunjukkan bahwa Peraturan Presiden (Perpres) No. 74 tahun 2013 dan Undang-Undang No. 23 tahun 2014 secara eksplisit telah mengatur tentang pengendalian, pengawasan, penentuan tempat penjualan minuman beralkohol dan minuman beralkohol tradisional serta mengatur tentang kewenangan pemberian ijin usaha. Pengaturan tentang minuman beralkohol telah diatur dalam Undang-Undang dan peraturan Presiden, ketentuan tersebut hendaknya segera ditindaklanjuti dengan menerbitkan peraturan daerah sebagai implementasi peraturan diatasnya, didasarkan asas hierarki, dengan demikian dapat memberikan kepastian hukum dan memberikan manfaat bagi masyarakat luas.

Abstract

Constitution in the government system of the Republic of Indonesia adheres the concept of trias politica, which is a concept stating that power is not transferred to the same person/institution, to prevent abuse of power and to guarantee human rights of citizens. The concept of trias politica is applied in the form of three institutions, namely executive, legislative and judicial institutions. These three institutions have different duties, rights, obligations, and responsibilities according to their authority. It turns out, however that the aim of preventing abuse of power by means of power distribution is not running well and there has been an overlap of authority among the institutions. This research is the author's study of the Legal Arrangements concerning Regional Unit Price Standards upon the issuance of Presidential Regulation Number. 33 of 2020 concerning Regional Unit Price Standards, its impact to Financial and Administrative Rights of the chairman and members of the Regional People's Representative Council. It is a normative legal research applying statutory approach, conceptual and comparative approaches. It was concluded that the placement of legislature as a quasi-executive results in the legislature shall comply with every regulation issued by the executive, this causes in an overlap of authority between the executive and the legislative institutions

Abstract

Legal arrangements regarding control, supervision, determination of areas/places of sale, authority to issue alcoholic beverage permits and provisions regarding the regulation of traditional alcoholic beverages have urgency, considering that Bali is one of the domestic and international tourist destinations. That traditional alcoholic drinks are also used as a complementary means of religious ceremonies. Researchers see that there has been a legal vacuum after Presidential Regulation No. 74 of 2013 was issued concerning Control and Supervision of Alcoholic Beverages. This situation can certainly raise the issue of legal uncertainty. This article is a normative legal research, using a statutory, historical, and conceptual approach. The research results show that Presidential Regulation (Perpres) No. 74 of 2013 and Law no. 23 of 2014 explicitly regulates control, supervision, determination of places to sell alcoholic and traditional alcoholic beverages and regulates the authority to grant business licenses. Regulations regarding alcoholic beverages have been regulated in laws and presidential regulations, these provisions should be followed up immediately by issuing regional regulations as the implementation of the regulations above, based on the principle of hierarchy, thereby providing legal certainty and providing benefits to the wider community.
