Abstract

Cases of sexual violence in Indonesia are increasing every year, even the victims are not only adults, teenagers, children and even toddlers are now the targets. The increasing number of cases of sexual violence is not only seen in terms of quantity or number of cases, but also in terms of quality. For this reason, the state is present with its policy, then Law Number 12 of 2022 concerning the Crime of Sexual Violence (UU TPKS) is passed which aims to protect every citizen from violence and degrading treatment of human dignity. The Victim Trust Fund or Victim Assistance Fund is a mandate from the TPKS Law as a form of state responsibility when the assets of the confiscated convict are insufficient for restitution costs. The Victim Assistance Fund exists as the state exists to protect its citizens, the concept of the Victim Trust Fund was previously regulated in Presidential Regulation No. 80 of 2011 concerning Trust Funds. However, the Presidential Regulation does not specifically regulate the aid fund for victims of sexual violence. The purpose of this study is to provide a legal framework on how to manage the Victim Aid Fund using a conceptual approach that uses analytical deductive methods to process data. The Victim Assistance Fund should be managed by the Witness and Victim Protection Agency (LPSK) which already has a system so that the state can save costs in establishing a new institution.

Abstract

The decision of the Constitutional Court Number 22/PUU-XV/2017 has an impact on the fulfillment of the basic rights and constitutional rights of citizens, especially in terms of marriage. The logical consequence of the Constitutional Court's decision is that there is a change in the norms of Law Number 1 of 1974 concerning Marriage, which reaches the age limit for marriage. Article 7 of Law no. 1 of 1974 stipulates that the minimum age for marriage for men is 19 years and for women 16 years. The regulation was amended through Law no. 16 of 2019 which stipulates the minimum age for marriage for men and women who will marry is at least 19 years old. Changes in the minimum age for marriage have an impact on dispensation for marriage. The existence of a "marriage dispensation" whose authority is given to religious court judges is a double-edged sword which sometimes becomes a challenge in preventing early marriage

Abstract

The purpose of this research is to examine the handling and the resolution of tenurial conflicts in forest areas. The factors examined in this research are the regulation of prohibition and juridical consequences regarding tenure conflicts that occur in the forest area. The conflict arose due to the use and exploitation of the forest by the village community and the government. This research uses normative legal research. The approach used is the statutory approach and case approach. The results of this study are a regulation on the use of forest areas by the laws and regulations so that optimal and sustainable forest utilization is achieved at Perhutani Central of Java. The aim of resolving tenure conflicts is to restore state forest according to their status function because forest is the lifeblood of many people so forest must be reserved, one of which is through law enforcement and implementing the applicable laws and regulation at Perum Perhutani.

Abstract

Nowadays there are rampant acts of bullying perpetrated by children with child victims both at school and in friendship circles at home. Bullying is a trend that is rife among young people as an action that is considered normal, contemporary and an ordinary joke, even though the consequences are quite dangerous, some cases result in physical injury to the victim, others become depressed and stressed, even victims of bullying who hold grudges can commit irrational actions as an outpouring of frustration such as shooting bullies, setting fire to schools where victims are often bullied and so on which end in criminal proceedings Muslimat as an autonomous body (Banom) under the auspices of the Nahdlatul Ulama (NU) organization plays an important role in providing education and knowledge to society in general and members in particular consisting of mothers who incidentally are the main pillars of the family. Muslimat Twig Sokaraja Kulon Village feels the need to equip its members, all of whom are mothers, with knowledge about bullying to prevent their children, siblings and even their grandchildren from being bullied. The implementation of PKM uses a comprehensive group-based legal counseling method and local wisdom. Team activities are carried out in a measurable manner through the achievement of targets and the resulting outputs, including increasing partners' knowledge of PKM material. The result of this PKM is to increase the knowledge and awareness of the community in general and partners in particular regarding bullying and its prevention through instilling Islamic values. It is hoped that the knowledge possessed by partners can become the basis for partners to disseminate their knowledge to the wider community to reduce bullying cases.

Abstract

The third amendment to the BUMN Law marks a new paradigm in BUMN management, adopting the Business Judgment Rule (BJR) doctrine. The material of the amendment is that BUMN directors cannot be held legally responsible for losses that occur if it is proven that the loss was not caused by error or negligence, decisions were taken in good faith and caution, there was no conflict of interest, and preventive measures were taken to prevent or stop losses. This BJR changes the pattern of directors' accountability, BUMN losses are no longer considered state financial losses so that they are not included in the realm of corruption based on the Corruption Law, this study uses a normative legal method through a doctrinal and conceptual approach, and uses secondary data. The analysis used uses the deductive method. With the amendment to the Law, it provides guidance for directors to be more careful in carrying out BUMN business processes. Providing certainty to corporate directors professionally without being overshadowed by fear of criminalization.

Abstract

Sesuai dengan ketentuan Surat Keputusan Direksi BI No. 23/69/KEP/DIR tanggal 28 Februari 1991 tentang penjaminan ketentuan Pub L. L. No. 23 dalam upaya mengatasi kredit macet, bank dapat melakukan beberapa hal yaitu, reconditioning, restructuring, dan rescheduling. Namun, kendala yang cukup signifikan terjadi pada saat penyelesaian kredit macet, apabila cara-cara tersebut tidak berhasil dan masih terjadi kredit macet terhadap debitur, oleh karena itu cara terakhir yang dapat dilakukan oleh bank adalah dengan melakukan eksekusi jaminan. Pengaturan mengenai jaminan kebendaan dan jaminan perorangan pada kredit mikro diatur dalam: (1) Jaminan Hak Tanggungan yang diatur dalam Undang-Undang Republik Indonesia Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah. (2) Jaminan Fidusia, diatur dalam Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. (3) Jaminan perorangan, diatur dalam Kitab Undang-Undang Hukum Perdata Bab XVI Pasal 1820-1850. Prosedur penyelesaian sengketa kredit mikro macet dengan jaminan kebendaan dan jaminan perorangan di PT Bank Rakyat Indonesia Unit Banyumas Kantor Cabang Purwokerto (Persero) Tbk. Ada dua cara yaitu, melalui jalur non litigasi dan litigasi.

Abstract
