Abstract

ABSTRAK Penyelesaiaan persoalan data pribadi di Indonesia sekarang ini diselesaikan melalui pengadilan negeri, karena belum adanya aturan hukum yang mengatur hadirnya peradilan khusus data pribadi di Indonesia. Hal ini tercermin dalam permasalahan beberapa kasus, seperti Putusan Nomor 438/Pid.Sus/2020/PN.JKT.UTR, kasus a quo yang dijatuhkan berdasar Undang-Undang Informasi dan Transaksi Elektronik. Putusan Nomor 438/Pid.Sus/2020/ PN.JKT.UTR yang sejatinya juga terdapat ketidaktepatan pada pertanggungjawaban pihak perusahaan. Selain itu ada pula masalah efesiensi dan penegakan hak korban. Kasus ini mencerminkan adanya kesulitan dalam mewujudkan terlaksananya hak yaitu right to be forgotten pada hukum positif di Indonesia. Gambaran membuat satu lembaga independen yang menjadi quasi peradilan dan kelak bisa menegakkan prinsip right to be forgotten di Indonesia, belum lagi kasus data pribadi yang sangat banyak di Indonesia. Hal itu menjadi latar belakang ketertarikan penulis mengulas persoalan ini. Metode penelitian yang digunakan yaitu normatif, dengan beberapa pendekatan yaitu: pendekatan perundang-undangan, pendekatan konseptual, pendekatan historis, pendekatan kasus, dan pendekatan perbandingan. Data yang digunakan dalam penelitian terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan non hukum. Analisis yang digunakan yaitu kualitatif. Berdasarkan dari analisis dan penelusuran, ditemukan peluang untuk Komisi Perlindungan Data Pribadi ini menjadi quasi peradilan di ranah data pribadi. Analisis berhasil memetakan terkait korelasi kehadiran Komisi Perlindungan Data Pribadi ini dengan penegakan prinsip right to be forgotten, dan quasi yudisial di Indonesia. Kesimpulan ditemukan Komisi Perlindungan Data Pribadi kelak bisa menjadi quasi peradilan perlindungan data di Indonesia dan menegakkan prinsip right to be forgotten. Sebaiknya pemerintah segera menunjuk badan yang menyelenggarakan fungsi Komisi Perlindungan Data Pribadi ini.Kata kunci: quasi peradilan; perlindungan data pribadi; komisi independen; right to be forgotten. ABSTRACTSince there is no statutory regulation governing the special court for personal data, its settlement in Indonesia is currently being resolved in the district court. Reflecting on several decisions, such as Decision Number 438/ Pid.Sus/2020/PN.JKT.UTR, the quo case which was decided by the Information and Electronic Transactions Law, or Decision Number 438/Pid.Sus/2020/PN.JKT.UTR which actually also contains inaccuracies in corporate accountability, not to mention the problem of efficiency and enforcement of victims’ rights. This case reflects the difficulty of realizing the implementation of ‘right to be forgotten’ in positive law in Indonesia. This is like creating an independent institution that becomes a quasi-judicial court capable of upholding the right to be forgotten principle in Indonesia, apart from the many cases of personal data in Indonesia. This is discussed in this analysis using normative research methods, including statutory, conceptual, historical, case-based, and comparative approaches. The research data consisted of primary, secondary, and non legal legal materials, analyzed by qualitative analysis methods. Based on analysis and tracking, the Personal Data Protection Commission has the possibility of becoming quasi judicial in terms of personal data. The analysis succeeded in mapping the correlation between the presence of this Personal Data Protection Commission for enforcing the right to be forgotten, and quasi-judicial principles in Indonesia. In conclusion, the Personal Data Protection Commission might become a quasi-judicial court for data protection in Indonesia and uphold the principle of the right to be forgotten. For this reason, the government should immediately appoint a body that will carry out the functions of this Personal Data Protection Commission. Abstract

This paper aims to analyze and understand the position of the Developer towards the Bank as the provider of mortgage facilities in the implementation of buyback guarantee. Additionally, it is hoped that this paper can provide additional understanding and information for academics, especially in the field of property, and understand how the buyback arrangement applied by the Developer with the Bank. The research method used in this discussion is empirical juridical research by looking at articles that regulate the right to repurchase sold goods based on Article 1519 of the Civil Code using the Conceptual Approach and Statute Approach. The types and sources of law used include primary and secondary data by analyzing based on regulations applicable in Indonesia. The data collection techniques used are observation and interviews. The analysis technique used is qualitative analysis. From the agreements made by the parties, referring to Article 1338 of the Civil Code, the Cooperation Agreement gives birth to rights and obligations for both the Developer and the Bank, both of which have balanced positions. Additional provisions agreed upon by the Developer and the Bank are the Buyback Guarantee Agreement, which is a condition where the Developer acts as a Guarantor for the repayment of the Debtor's debt in the event of the Debtor's default in the obligation to pay installments or debts. The effectiveness of the buyback agreement can be seen from the realization data of buyback found in Developer X towards Bank A.

Abstract

Seiring dengan meningkatnya persaingan antar perusahaan di Indonesia, banyak perusahaan melakukan penyesuaian kepada hubungan kerja. Penyesuaian dilakukan dengan menyelaraskan peran kerja terhadap kompetensi inti perusahaan agar tercipta sistem kerja yang lebih efektif dan efisien.  Tujuan riset ini untuk mengkaji berbagai bentuk hubungan kerja di Indonesia sesuai ketentuan UU No. 13 Tahun 2003 dan UU No. 6 Tahun 2023. Hubungan kerja dikaji berdasarkan jenis-jenis dan kategori pekerjaan yang dapat menggunakan sistem outsourcing, borongan, perjanjian kerja (PKWT/PKWTT) serta kemitraan, khususnya dalam konteks industri Rumah Sakit. Riset ini mempergunakan pendekatan normatif-empiris, kemudian data yang disajikan dengan pengelolaan data melalui teknik analisis deskriptif kualitatif. Hasil penelitian menujukan bahwa perbedaan mendasar dalam hubungan kerja ditentukan oleh tiga unsur utama, yaitu perintah, upah. dan waktu kerja. Dari riset ini ditemukan perbedaan mendasar hubungan kerja ditentukan oleh unsur perintah, upah dan waktu kerja. Dalam konteks Undang-undang Cipta Kerja, hubungan kerja PKWT/PKWTT dan outsourcing (tidak termasuk borongan) tunduk kepada perlindungan ketenagaan. Saran untuk Industri kesehatan adalah menjamin kepastian status pekerja, pemanfaatan outsourcing dengan tepat dan memperkuat sistem pengawasan internal serta menjamin kewajiban dan hak pekerja dan tanggung jawab yang diberikan. Hasil penelitian menunjukkan bahwa secara normatif, outsourcing dan PKWT/PKWTT merupakan hubungan kerja yang wajib memenuhi perlindungan ketenagakerjaan, sementara borongan dan kemitraan merupakan hubungan perdata tanpa unsur subordinasi. Setiap jenis hubungan kerja pastinya memiliki resiko perihal ini yang perlu di perhatikan bagi semua pihak. As competition among companies in Indonesia intensifies, many companies are making adjustments to their employment relationships. These adjustments are based on aligning the roles of workers with the core competencies of the company in order to achieve more effective and efficient work system. The purpose of this study is to examine the various forms of employment relationship in Indonesia as regulated by UU No. 13 Tahun 2003 and UU No. 6 Tahun 2023. Employment relationships are examined based on the types of work that can use outsourcing, contract work, work agreements (PKWT/PKWTT) and partnerships, particularly in the hospital industry. This study uses normative-empirical approach, and the data is processed using qualitative descriptive analysis techniques. The results of the study found that the fundamental differences in employment relationships are determined by the elements of command, wages, and working hours. In the context of the Job Creation Law, PKWT/PKWTT employment relationships and outsourcing (excluding contract work) are subject to labor protection. Recommendations for the healthcare industry include ensuring worker status certainty, appropriate use of outsourcing, strengthening internal oversight systems, and guaranteeing worker’s rights. The results of the study indicate that, normatively, outsourcing and PKWT/PKWTT are employment relationships that must comply with labor protection regulations, while contract work and partnerships are civil relationships without elements of subordination. Each type of employment relationship carries inherent risks that must be carefully considered by all parties involved.

Abstract

Murder is a grave crime that threatens human life and social order, necessitating meticulous investigation to achieve material truth as mandated by the Indonesian Code of Criminal Procedure. Governed by Articles 1(14), 6, and 7 of Indonesian Code of Criminal Procedure and Law No. 2 of 2002 on the Indonesian National Police, investigations authorize investigators to receive reports, examine witnesses, secure crime scenes, and collect evidence. Determining the tempus delicti (time of the crime) is critical for reconstructing events, validating evidence, and identifying perpetrators, yet it is hindered by limited forensic technology, inconsistent witness statements, and weak inter-agency coordination. Crime scene processing, utilizing forensic analysis such as linkage theory and post-mortem examinations, is pivotal in establishing the time of the crime, as stipulated in Article 184(1) of Indonesian Code of Criminal Procedure. However, Indonesia’s lack of forensic laboratories, inadequate investigator training, and inconsistent standard operating procedures often lead to evidence contamination or failed prosecutions, potentially resulting in acquittals. Ethical violations by rogue investigators, such as abuse of authority, further erode legal legitimacy and public trust. This study employs a normative juridical approach, analyzing legislation, legal principles, and doctrines related to murder investigations to evaluate the effectiveness of crime scene processing, structural challenges, and compliance with positive law, including Indonesian Code of Criminal Procedure and the 1945 Constitution. The study recommends forensic reforms, enhanced investigator integrity, and improved inter-agency coordination to support substantive justice in a rule-of-law state.

Abstract

Human organ trafficking, particularly involving kidneys, constitutes a grave crime that violates human rights and persists despite stringent national and international prohibitions. This crime is perpetrated not only by individuals but also by organized syndicates, including rogue state officials and transnational networks, exploiting societal vulnerabilities such as poverty, low education levels, and limited access to legal information. This study aims to thoroughly examine Indonesia's legal framework concerning human trafficking for kidney transplantation and evaluate the legal protections available to victims. Employing a normative juridical approach, the research analyzes relevant legislation, including the Eradication of Human Trafficking Law, the Health Law, and the Child Protection Law. Additionally, it reviews concrete cases and legal literature to depict real-world legal practices. The findings reveal that, despite existing regulations, legal protection for victims remains ineffective, particularly in terms of assistance, restitution, and rehabilitation. Many victims lack adequate access to justice, and perpetrators, including involved corporations, often escape proportionate legal consequences. The study also identifies normative and implementation challenges, with sanctions deemed insufficient to create a deterrent effect and inter-agency coordination remaining suboptimal.

Abstract

This study aims to analyze the phenomenon of online gambling, especially its prevalence and characteristics among adolescents, as well as the challenges faced in overcoming to this problem. The importance of legal protection to prevent adolescents from getting caught up in online gambling is the main focus, where the role of the government and related institutions is crucial in supervising and enforcing the law. In addition, this study also identifies ideal steps that can be taken to prevent online gambling. The method used is normative juridical with a qualitative analysis approach based on the law. The results of the study indicate that legal regulation is very necessary to prevent online gambling among adolescents. Data were analyzed using a thematic approach, and the findings indicate that online gambling is a complex problem influenced by various factors, such as easy access, social influence, and financial incentives. This study emphasizes the need for a comprehensive approach in dealing with online gambling, involving the government, law enforcement, and civil society organizations. The findings also indicate that educational campaigns and public awareness are essential in preventing online gambling, and law enforcement needs to be equipped with adequate resources and technology to monitor and block online gambling activities. Thus, this study contributes to the existing literature by providing insights into the experiences and perceptions of adolescents involved in online gambling.
