Abstract

Abstrak Perkembangan financial technology (fintech) yang terjadi secara global merupakan inovasi teknologi pada sektor jasa keuangan. Dengan hadirnya fintech, masyarakat menjadi lebih mudah mengakses layanan keuangan untuk memenuhi kebutuhan pembiayaan. Namun disisi lain, muncul tantangan khususnya terkait dengan isu perlindungan data dengan maraknya fintech illegal. Penelitian ini bertujuan untuk menganalisa pengaturan perlindungan data pribadi pada bisnis Fintech serta sejauh mana sanksi yang diberikan akibat penyalahgunaan data pribadi. Metode penelitian yang digunakan adalah yuridis normatif, menggunakan data pustaka baik yang meliputi bahan hukum primer berupa peraturan perundangan yang ada serta bahan hukum sekunder berupa literatur jurnal ilmiah, buku serta sumber pendukung lainnya serta dianalisis dengan pendekatan deskriptif. Hasil penelitian menunjukkan perlindungan data pribadi pengguna Fintech di Indonesia belum efektif karena regulasi yang ada saat ini masih mengatur data yang bersifat umum, tidak spesifik untuk industri fintech. Kata Kunci: Fintech, Bisnis, Yuridis, Perlindungan, Data Pribadi. AbstractThe development of financial technology (fintech) that is happening globally is a technological innovation in the financial services sector. With the presence of fintech, it is easier for people to access financial services to meet their financing needs. But on the other hand, challenges have arisen, especially related to the issue of data protection with the rise of illegal fintech. This study aims to analyze the regulation of personal data protection in the Fintech business and the extent to which sanctions are imposed due to misuse of personal data. The research method used is normative juridical, using good literature data which includes primary legal materials in the form of existing laws and regulations as well as secondary legal materials in the form of scientific journal literature, books and other supporting sources and analyzed using a descriptive approach. The results of the study show that the protection of personal data of Fintech users in Indonesia is not yet effective because current regulations still regulate general data, not specific to the fintech industry. Keywords: Fintech, Business, Juridical, Protection, Personal Data.

Abstract

ABSTRAK Tujuan utama kegiatan penerbangan komersil adalah keselamatan penerbangan. Aspek ini berkaitan erat dengan perlindungan penumpang atau konsumen terhadap pengguna jasa transportasi udara yang membawa barang bagasi, Hubungan antara pelaku usaha dengan konsumen adalah hubungan timbal balik yang saling membutuhkan. Kasus hilangnya bagasi penumpang pengguna jasa angkutan udara juga terjadi melibatkan perusahaan plat merah ternama tanah air yakni PT Garuda Indonesia. Garuda Indonesia , Tbk haruslah tunduk dan melaksanakan ketentuan undang-undang perlindungan konsumen. Selanjutnya ganti rugi atas hilangnya bagasi tercatat milik konsumen pada putusan Nomor 1317 K/Pdt.Sus BPSK/2017 terkait besaran ganti rugi terhadap konsumen tidaklah tepat karena besaran ganti rugi di potong 40% akibat penyusutan. Berdasarkan Pasal 19 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen jo Keputusan Menteri Perindustrian Dan Perdagangan Republik Indonesia Nomor 350/MPP/KEP/12/2001 Pasal 12 terkait ganti rugi.  Kata Kunci : Tanggung jawab maskapai, Ganti kerugian, Bagasi  E.   ABSTRACT The main objective of commercial aviation activities is flight safety. This aspect is closely related to the protection of passengers or consumers for users of air transportation services carrying luggage. The relationship between business actors and consumers is a reciprocal relationship that requires each other. The case of missing luggage of passengers using air transportation services also involved a well-known national state-owned company, namely PT Garuda Indonesia. Garuda Indonesia , Tbk must comply with and implement the provisions of the consumer protection law. Furthermore, compensation for loss of checked baggage belonging to consumers in decision Number 1317 K/Pdt.Sus BPSK/2017 regarding the amount of compensation to consumers is not correct because the amount of compensation is cut by 40% due to depreciation. Based on Article 19 of Law Number 8 of 1999 concerning Consumer Protection in conjunction with Decree of the Minister of Industry and Trade of the Republic of Indonesia Number 350/MPP/KEP/12/2001 Article 12 related to compensation.   Keywords : Airline liability, Compensation, E. Abstract

Death penalty for perpetrators of narcotics crimes is one of the punishments that is debated in various international countries, especially in Indonesia, a very big reaction from the community and even international countries in responding and intervening in the imposition of capital punishment with various fundamental reasons that death penalty is one of the crimes. the most cruel, sadistic, and undignified. This study aims to analyze capital punishment for crimes in Indonesia from a legal and human rights perspective. The method applied in this study uses normative legal research, which is a way of writing based on an analysis of several legal principles and legal theories as well as laws and regulations that are appropriate and related to problems in legal research writing. Death penalty for perpetrators of narcotics crimes in a country based on Pancasila as the basis of the philosophy of the Indonesian state and the 1945 Constitution of the Republic of Indonesia as the Great State Norms or Basic Norms of the Unitary State of the Republic of Indonesia and certain statutory regulations that regulate them in law something positive that is upheld is not said to violate the provisions on human rights violations, especially the basic right to life which is continuously debated in various international conventions, this must continue to be implemented.
