Abstract

This research analyzed anarchist demonstrations by undergraduate students while expressing opinions in public. The study used normative and empirical research methods, including direct interviews and a literature review of legal materials. Results showed that these anarchist demonstrations occur in Indonesia and other countries. Several factors motivated the protest masses to participate in anarchist demonstrations: the Government’s failure to respond to their aspirations, the presence of certain provocateurs, and the Police’s inability to control the protest masses. Meanwhile, the Police take measures to prevent anarchist demonstrations: the field coordinators of the protest masses must inform before the demonstration, urge the protest masses for a peaceful demonstration and respect citizens’ rights around the demonstration location, and disband anarchist demonstrations. In addressing the root causes of anarchist demonstrations, it is recommended that the Government and members of Parliament take proactive measures, such as responding to the protest masses’ aspirations. At the same time, the Police and undergraduate students in demonstration locations should continue enforcing the provisions under applicable legislation. These efforts can maintain peace and order for undergraduate students during demonstrations while protecting the rights of citizens to express opinions in public.

Abstract

Oversight of judges is a vital element in maintaining the integrity and accountability of the judiciary. In Indonesia, this function is carried out by two main institutions: the Judicial Commission (KY) as an external supervisor and the Supreme Court (MA) as an internal supervisor. Despite their different mandates and approaches, synergy between the KY and MA is an absolute prerequisite for the realization of a clean, professional, and trustworthy judicial system. This article examines the forms of synergy that can be built between the two institutions, ranging from information exchange, the establishment of coordination forums, to the use of digital technology in oversight. Furthermore, it discusses the challenges of coordination, differing perceptions of authority, and the importance of political support and sustainable institutional reform. Effective oversight is not only repressive, but also preventive and educational, with the aim of building a culture of integrity within the judiciary. With a collaborative and adaptive approach, the KY and MA can become driving forces for the transformation of Indonesia's judicial system toward a dignified and substantive justice system.

Abstract

Judicial oversight constitutes a crucial instrument in preserving the integrity, accountability, and public trust in the judiciary. Within the Indonesian constitutional framework, judicial oversight is exercised by two principal institutions: the Judicial Commission as the external supervisory body focusing on the honor, dignity, and conduct of judges, and the Supreme Court as the internal supervisory body emphasizing institutional discipline as well as technical and administrative oversight. In practice, however, the relationship between these institutions has not functioned in a fully synergistic manner. The main problems include overlapping perceptions of authority, weak follow-up on the Judicial Commission’s recommendations, institutional resistance, limited resources, and suboptimal public participation. This study aims to analyze the construction of authority of the Judicial Commission and the Supreme Court in judicial oversight, identify factors inhibiting effective supervision, and formulate an institutional synergy model that remains respectful of judicial independence. This research employs normative legal research using statutory and conceptual approaches. The study finds that the principal issue lies not in the existence of dual supervisory institutions, but in the absence of an operational and procedurally binding coordination design supported by an open institutional culture.
