Abstract

Ibnu Taimiyyah adalah seorang ulama yang memiliki ilmu yang luas dan ahli dalam bidangnya, khususnya bidang Fiqh dan Ushul Fiqh. Namun, Ibnu Taimiyyah memiliki pendapat yang membolehkan pembuktian amal dengan nash marjuh (lemah), yaitu mashlahah mursalah. Penelitian ini menggunakan metode penelitian kepustakaan, dengan cara mengumpulkan data yang terdapat dalam buku, buku, dan jurnal ilmiah yang merupakan sumber primer, sedangkan untuk menunjang penelitian ini juga membutuhkan sumber sekunder, seperti buku dan penelitian ilmiah terkait. Tujuan dari penelitian ini adalah untuk mengungkap pemikiran Ibnu Taimiyyah terkait kemampuannya melakukan hujjah dengan menggunakan mashlahah murshalah yang dipandang sebagai teks marjuh oleh para ulama. Hasil penelitian ini dapat disimpulkan, bahwa para ulama berbeda pendapat mengenai berhujjah dengan mashlahah mursalah, sebagian ulama menolak untuk menjadikan mashlahah mursalah sebagai hujah dalam beramal, karena yang diperbolehkan hanya berpesan Al-Qur'an, Hadis, dan Ijma 'Ulama. Namun sebagian ulama juga membolehkan berhujjah dengan mashlahah mursalah dengan syarat tertentu, yaitu tidak bertentangan dengan nash qath'i, tidak menggunakan nalar untuk kepentingan individu, dan menghilangkan kesulitan bagi umat. Sedangkan menurut Ibnu Taimiyyah, diperbolehkannya berhujjah dengan mashlahah mursalah, selama perbuatan itu tidak membatalkan dan meniadakan ibadah, seperti orang yang memimpin shalat berjamaah yang paham jahar membaca basmallah, tetapi imam paham sirr dalam membaca basmallah. Namun, Ibnu Taimiyyah juga melarang penggunaan mashlahah mursalah di pengadilan, halal dan haram serta fatwa.

Abstract

Kajian ini menjelaskan fenomena budaya patriarki dalam rumah tangga dari sudut pandang hukum Islam. Budaya patriarki adalah sistem sosial di mana otoritas, kekuasaan, dan kendali dominan dipegang oleh para pria dalam sebuah keluarga. Pendekatan ini menggambarkan peran gender yang tersegmentasi dan hierarkis di mana perempuan dan anak-anak sering kali berada di bawah kontrol dan pengaruh pria. Dalam kerangka hukum Islam, rumah tangga dipandang sebagai unit fundamental dalam masyarakat yang diatur oleh prinsip-prinsip yang diturunkan dari Al-Quran dan Hadis. Kajian ini meninjau konsep-konsep seperti kewajiban suami untuk memberikan nafkah kepada istri dan anak-anaknya, tanggung jawab istri untuk memelihara rumah tangga, serta kewajiban saling menghormati dan mendukung antara suami istri. Namun demikian, praktik budaya patriarki dalam rumah tangga sering kali menyimpang dari prinsip-prinsip ini, mengarah pada ketidakseimbangan kekuasaan, penindasan, dan ketidakadilan gender. Oleh karena itu, kajian ini juga mengkaji pemahaman Islam tentang kesetaraan gender, keadilan, dan hak asasi manusia dalam konteks rumah tangga. Melalui analisis ini, diharapkan dapat memberikan wawasan yang lebih mendalam tentang bagaimana budaya patriarki dalam rumah tangga dapat dinilai dari perspektif hukum Islam, serta mengidentifikasi upaya-upaya yang dapat dilakukan untuk memperbaiki ketidakseimbangan kekuasaan dan mempromosikan hubungan yang lebih seimbang dan adil antara suami dan istri dalam kerangka nilai-nilai Islam.

Abstract

Tepuk tepung tawar is a traditional Malay wedding ceremony which aims to ask for protection and safety for the bride and groom as well as the smooth running of the event. It is important to preserve this ancestral heritage, because every material used has a deep meaning, showing the strong connection between the Malay people and nature. This research adopts descriptive qualitative methods through field research. Data was collected by direct observation, interviews, and documentation from traditional leaders in Bengkalis, in order to understand the procession and review of munakahat jurisprudence regarding this custom. As a result, plain flour pats involve the use of natural ingredients and regular traditional processes. Even though it is not in the Qur'an or hadith, the law is mubah (permissible). This is in accordance with the principle of muamalah in Islam, where everything is considered permissible as long as there are no arguments that prohibit it and it does not conflict with religious law.

Abstract

It is undeniable that technological developments have brought major changes to the social and religious realms of human life. One of them is the phenomenon of digital taaruf which is now a trend among the younger generation as an alternative to finding a life partner through online platforms. So it is interesting to study the validity of the sharia in this practice. This study aims to analyze the concept of digital taaruf from the perspective of fiqh munakahat. Using a descriptive qualitative approach, data was obtained through literature studies and analysis of several digital ta'aruf platforms in Indonesia. The results of the study show that despite differences in services and costs, the three platforms still prioritize the principles of Islamic law such as maintaining manners, involving third parties who can certainly avoid slander for prospective couples who use this service. In the view of fiqh munakahat, digital ta'aruf is acceptable as long as it is in accordance with sharia values. Thus, digital ta'aruf is a form of actualization of the concept of introduction in Islam that is relevant to the development of the times.

Abstract

This research is motivated by the existence of Minangkabau customs which have a tradition of prohibiting marriage within the same tribe. This means that in Minangkabau customs it is forbidden for a man to have the same tribe as a woman he wants to marry. Interestingly, there is no verse in the Qur'an or Hadith regarding this marriage within the same tribe, while Minangkabau customs adhere to the principle commonly known by its proverb, namely "Adaik basandi syarak, syarak basandi Kitabullah". Therefore, this study aims to analyze the tradition of prohibiting marriage within the same tribe in Minangkabau, by focusing on the study of the principles and factors causing the prohibition of marriage within the same tribe in Minangkabau, as well as its analysis according to customary law and Islamic law. The method used is library research with a normative approach, where the data obtained is analyzed qualitatively. The results of the study show that the Minangkabau community adheres to an exogamous marriage system, which means that someone from a certain tribe must marry someone from another tribe. The prohibition of marriage within the same tribe in Minangkabau is also due to the implications of the matrilineal customary system or maternal lineage. This is because there are principles and thoughts that view inter-tribal marriage as a form of family or very close kinship, which if implemented will narrow family ties, as a pioneer of the destruction of the tribe, and produce low-quality offspring. Therefore, someone from Minangkabau is required to marry someone from outside their tribe to maintain unity and harmony in their society. According to the logic of Minangkabau customary law, inter-tribal marriage is considered bad and can be subject to moral sanctions. The prohibition of inter-tribal marriage in Minangkabau is included in the category of 'urf sahih, this prohibition is also not considered haram according to sharia because it is in accordance with the maqashid sharia regarding the maintenance of offspring so as not to produce weak offspring.

Abstract

This study examines the concept of kafa'ah (equality) in marriage, focusing on the aspect of property from the perspective of classical and contemporary Islamic jurisprudence. Kafa'ah is one of the important principles in determining the compatibility of a husband and wife, covering aspects of religion, lineage, social status, and economy. Along with the social and economic development of modern society, new dynamics have emerged in understanding the relevance of economic equality in building a harmonious family. This study uses a library research method, by reviewing Islamic jurisprudence literature from four schools of thought as well as the views of contemporary scholars such as Yusuf Qaradhawi and Sayyid Sabiq. The results of the study show that although there are differences of opinion among scholars regarding the importance of kafa'ah in the aspect of property, it is generally agreed that the aspects of religion and morality are the main considerations in marriage. However, in the context of modern life, economic equality can be considered as a supporting factor in realizing a stable family. Thus, kafa'ah in property should not be made an absolute requirement, but rather positioned as one of the rational considerations in choosing a life partner.

Abstract

This article explores how Nahdlatul Ulama (NU), through its local branch in Bengkalis (PCNU), responds to the worsening ecological crisis in one of Indonesia’s most vulnerable coastal regions. Using a qualitative case study approach that combines field interviews, participant observation, and document analysis, this study investigates how Islamic environmental ethics—particularly fiqh al-bi’ah and maqāṣid al-sharī‘ah—are translated into collective practices through grassroots religious initiatives. Two key programs are highlighted: Green Pesantren, which integrates ecological education, reforestation, and sustainable practices into Islamic boarding schools; and Mimbar Dakwah, which encourages preachers to include environmental themes in sermons as a form of moral advocacy. These initiatives show how religious discourse can shape environmental behavior and public consciousness at the community level. However, the study also identifies major obstacles, including economic hardship, weak policy enforcement, limited institutional support, and escalating climate impacts. Despite these barriers, PCNU plays a critical role in mobilizing religious networks, shaping local ecological narratives, and promoting community resilience. The findings contribute to the sociology of religion and environmental studies by demonstrating how faith-based organizations can serve as agents of social action and environmental engagement, especially in regions where state capacity is limited.

Abstract

The development of information technology has encouraged the emergence of increasingly complex e-commerce transactions that require legal certainty. This study aims to analyze the legality of e-commerce transactions through a comparison of Islamic law and Indonesian civil law perspectives. The method used is normative juridical research with a descriptive-analytical approach based on literature review, using primary sources in the form of the Qur'an, hadith, the Civil Code, the ITE Law, and fatwas of contemporary scholars, and secondary sources in the form of related academic literature. The results of the study indicate that in Islamic law, e-commerce transactions are permitted as long as they fulfill the pillars and conditions of a valid sale and purchase, are free from elements of gharar, usury, and fraud, and uphold the principles of justice, honesty, and openness. Meanwhile, Indonesian civil law views e-commerce as valid if the conditions of an agreement as stipulated in Article 1320 of the Civil Code are met, namely the existence of an agreement, legal capacity, a specific object, and a lawful cause, and are based on the principles of freedom of contract and good faith. Thus, both Islamic law and civil law emphasize the importance of transparency, agreement, and justice, although with different emphases. This study recommends strengthening regulations and legal education to protect consumers while creating a safe and equitable digital transaction ecosystem.
