Abstract

The problem that arises because the regions do not have absolute independence to take care of their own household affairs can be one of the factors that hinder Indonesia from becoming a welfare state through the progress of the regions. The problem of the essence of regional autonomy at the level of implementation of its system in the frame of the Unitary State of the Republic of Indonesia is still not in accordance with the nature of broad, real, and responsible regional autonomy so that this will also hinder the achievement of the greatest happines of the greatest number for as in the theory of utilitarianism in achieving the goal of the state to become a welfare state ). The research method used is normative juridical by taking a historical approach and legislation. The results showed that the urgency of implementing broad, real, and responsible regional autonomy is needed in the regional government system in order to meet regional needs with the essence of autonomy possessed in order to realize the greatest happiness of the regional community.

Abstract

The decision of the Administrative Court is one of 'final' nature, there is an expansion of meaning to refer to the legal status of the decision. Once a final decision has been issued by the Administrative Court, the parties to the dispute can no longer appeal or make other legal efforts to challenge or change the decision, except in certain circumstances regulated by law. The term 'final' indicates that the decision is irreversible and legally binding for all parties involved in the case. However, the definition of 'final' in a particular situation may vary depending on the applicable laws in the country. The purpose of this research is to examine the expansion of the meaning of final in Administrative Court Decisions usually related to the annulment, amendment, or confirmation of Administrative Court decisions that have become the subject of disputes. This research uses normative juridical legal research methods. In this article, researchers have concluded that the expansion of the meaning of 'final' in the context of State Administrative Court (PTUN) decisions refers to the legal status of the decision. The term 'final' indicates that the decision is irreversible and becomes a legally binding decision for the parties involved in the case. In practice, final PTUN decisions have the same legal force as other court decisions and must be obeyed by the parties involved in the case. This is important to maintain legal certainty and the integrity of the state administrative justice system.

Abstract

This study examines the legal construction of the obligation to prepare Academic Draft s in the process of forming regional regulations in Indonesia. Academic texts have a strategic role as a scientific and rational basis to ensure that the Regional Regulations produced are in accordance with the needs of the community, based on the principles of good regulation formation, and do not contradict higher legal norms. This study uses a normative juridical method with a statutory approach and conceptual analysis to identify the relevance, implementation, and challenges in the implementation of Academic Draft obligations. The results of the study show that the obligation to prepare Academic Draft s has been regulated in laws and regulations, but its implementation is often faced with various obstacles, such as low technical understanding, limited budget allocation, and lack of expert involvement. Therefore, it is necessary to strengthen regulations and increase institutional capacity to ensure a more participatory, transparent, and accountable process for the formation of regional regulations. This research is expected to contribute to the development of policies that support the formation of quality and responsive regional regulations to the needs of the community.

Abstract

Tindak lanjut atas putusan Mahkamah Konstitusi oleh bukan addressat utama yaitu pembentuk undang-undang justru menimbulkan masalah baru dan produknya tersebut dapat dibatalkan oleh Mahkamah Agung dikarenakan amar putusan Mahkamah Konstitusi tidak ditindaklanjuti dalam bentuk undang-undang. Putusan Mahkamah Konstitusi yang bersifat final dan mengikat, dalam pengujian undang-undang terdapat norma yang telah diuji di Mahkamah Konstitusi tetapi belum mendapat tindak lanjut dari addressat utama sehingga perlu dikaji bentuk ideal atas Putusan Mahkamah Konstitusi dalam pengujian undang-undang. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif melalui pendekatan studi komparatif beberapa negara. Tujuan penelitian ini yaitu untuk menemukan bentuk ideal terhadap tindak lanjut Putusan Mahkamah Konstitusi dalam pengujian undang-undang. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi perlu memiliki kewenangan melalui amandemen konstitusi, memberikan limitasi waktu bagi legislator untuk merevisi undang-undang agar sesuai dengan putusan Mahkamah Konstitusi terhadap pengujian undang-undang sebagaimana praktik di Negara Slovenia, Ceko, Rumania, Amerika Serikat, Perancis, Ukraina.
