Abstract

Pengadaan tanah untuk kepentingan umum dalam pembangunan jalur rel pelaksanaanya menimbulkan permasalahan hukum, yaitu dalam proses pemberian ganti rugi dan penggunaan lembaga konsinyasi, dimana konsinyasi dilakukan tanpa kesepakatan pemilik tanah. Permasalahannya yaitu, bagaimana proses pemberian ganti ruginya dan apakah penggunaan konsinyasi sudah tepat digunakan dalam pengadaan tanah. Tipe penelitian ini yuridis normatif. Sifat penelitiannya yaitu deskriptif analisis. Data yang digunakan data sekunder dan data primer. penarikan keimpulan dengan cara logika deduktif. Hasil analisis pertama yaitu, tahap pelaksanaan sampai penyerahan hasil sudah sesuai secara administratif proseduralnya, namum untuk substansi materiil masih terdapat pelanggaran asas kesepakatan, penguasaan hak atas tanah dan perlindungan hukum bagi pihak yang berhak. Analisis kedua, konsinyasi tidak sesuai jika dalam pengadaan tanah, karena merupakan bentuk kesewenang-wenangan mengenai kesepakatan sepihak. Kesimpulannya, dalam tahapan pengadaan tanah sudah sesuai berdasarkan Undang-Undang Nomor 2 Tahun 2012, tetapi musyawarah yang dilakukan tidak melahirkan kesepakatan secara bulat, karena masih terdapat warga yang ganti ruginya dikonsinyasikan.

Abstract

 ABSTRAKPerencanaan kehutanan merupakan salah satu kegiatan dalam bidang kehutanan yang memegang peranan penting, karena kegagalan melakukan perencanaan akan berdampak negatif terhadap kelangsungan hutan, oleh karena dalam perencanaan kehutanan akan berkaitan pula dengan pengurusan kehutanan. Hal ini menjadi penting untuk melihat bagaimana peranan dan fungsi hutan kota, karena kenyataannya kota-kota yang terdapat di Kabupaten/Kota cenderung mengabaikan ruang hutan yang ada di kotanya. Regulasi tentang Perencanaan dan pengurusan hutan kota di DKI Jakarta menuju penyelenggaraan kehutanan yang bermanfaat dan lestari menjadi penting untuk dilihat bagaimana Pemerintah Provinsi DKI Jakarta melakukan perencanaan dan pengurusan hutan kotanya serta bagaimana upaya Pemprov DKI Jakarta mewujudkan peran hutan kota dalam pembangunan kota berkelanjutan yang berwawasan ekologi. Jenis penelitian yang digunakan adalah normatif empiris, paradigma konstruktivisme, pendekatan socio-legal research. Pengaturan hutan kota sifatnya himbauan dan tidak mewajibkan pemerintah kota untuk melakukan pembangunan dan pengembangan hutan kota. Pengaturan yang tidak tegas ini berimplikasi pada keseriusan pemerintah kota untuk membangun hutan kota, sehingga mengakibatkan pembangunan hutan kota bukan merupakan kebutuhan yang mendesak karena pemkot berprinsip mampu  mengatasi  permasalahan  lingkungan dan hutan  kota  dinilai belum  terlalu  mendesak  dibandingkan  pembangunan  lainnya  yang  bersifat  pelayanan  publik  dan menyentuh masyarakat banyak. Namun demikian, upaya Pemprov DKI Jakarta telah berhasil melaksanakan amanat PP 63 Tahun 2002 untuk mewujudkan 10% dari luas kota DKI Jakarta untuk menyediakan hutan kota sebagai bagian dari RTH selama kurun waktu 4 tahun terakhir sejak 2015-2019.Kata kunci: pengurusan dan perencanaan; hutan kota; DKI Jakarta. ABSTRACT Forestry planning is one of the activities in the forestry sector that plays an important role, because failure to plan will have a negative impact on forest sustainability, because forestry planning will also be related to forestry management. It is important to see how the role and function of urban forests is, because in fact cities in districts/cities tend to ignore forest space in their cities. The potential for a shift in the function of green space will be detrimental to the city itself, both in terms of aesthetics and comfort and health as the lungs of the city. Regulations on the planning and management of urban forests in DKI Jakarta towards the implementation of useful and sustainable forestry are important to see how; The DKI Jakarta Provincial Government is planning and managing its urban forest and how the DKI Jakarta Provincial Government is trying to realize the role of urban forests in sustainable urban development with an ecological perspective. The regulation of urban forest is advisory in nature and does not oblige the city government to carry out the construction and development of urban forest. This indecisive arrangement has implications for the seriousness of the city government to develop urban forests, resulting in the development of urban forests not being an urgent need because the city government has the principle of being able to overcome environmental problems and urban forests are considered not too urgent compared to other developments that are public services and touch the community at large. However, the efforts of the DKI Jakarta Provincial Government have succeeded in carrying out the mandate of PP 63 of 2002 to realize 10% of the area of the city of DKI Jakarta to provide urban forests as part of green open space during the last 4 years from 2015-2019.Keywords: management and planning, urban forest, DKI Jakarta.

Abstract

This article examines the urgency of protecting against displacement caused by climate change under international law and questions why Rohingya displacement has not been resolved even though it has been protected by international law, whether the harmonization of human rights approaches, national law, and international law towards refugees and climate refugees. This paper uses a literature review method and a normative legal approach by reviewing national and international human rights law. The findings of this paper suggest that many Rohingya continue to flee to safer countries, often taking enormous risks, including dangerous ocean crossings. The impacts of climate change can be categorized as persecution; the Refugee Convention requires that such persecution be due to race, religion, nationality, political opinion, or membership of a particular social group. Persecution alone is not enough. The difficulty is that the impacts of climate change are largely indiscriminate and not related to specific characteristics such as a person's background or beliefs. The Rohingya people have experienced violence, discrimination, and persecution for decades, and the international community has failed to protect them effectively. The international community has allowed Myanmar to carry out genocide against the Rohingya without taking any action, even though United Nations member states are obliged to protect their population from genocide, war crimes, ethnic cleansing, and crimes against humanity. National, international, and human rights laws play an important role in determining the legal status and rights of refugees in a country. All three must be embedded and integrated, starting from international law and its derivatives to national law, which contains humanitarian rights.

Abstract

This research aims to evaluate the land acquisition process carried out by the Depok City Government for the development of Alun-Alun Kota Depok. The main question under investigation is the extent to which this land acquisition complies with the provisions stipulated in Law Number 2 of 2012 concerning Land Acquisition for Development for Public Purposes and National Land Law. The research methodology employed is normative legal research with a qualitative and descriptive approach, utilizing secondary data, and applying deductive methods to draw conclusions. The research results indicate that the land acquisition for the development of Alun-Alun Kota Depok has adhered to the applicable regulations, including Law Number 2 of 2012 concerning Land Acquisition for Development for Public Purposes and other National Land Law regulations. Therefore, it can be concluded that the development of Alun-Alun Kota Depok is in accordance with the prevailing legal provisions and does not face significant legal obstacles in its implementation

Abstract

The utilization of timber resources in customary forests must have permission if it is to be used for business purposes and must comply with applicable regulations. This is stipulated in Article 50, paragraph (2) of Law No. 41 of 1999 on Forestry. Transporting timber without permission constitutes illegal logging, as regulated in Article 12, letter K of Law No. 18 of 2013 on the Prevention and Eradication of Forest Destruction. The issue raised is whether the use of timber in the customary forest area of Sabuai Village by CV. Sumber Berkat Makmur violates the applicable regulations, and whether the judge's considerations in the ruling align with the principles of forest utilization and the impacts of illegal logging. To address this, a normative legal method is used, with secondary data analyzed descriptively and analytically, utilizing qualitative data analysis and deductive reasoning. Based on the result and the conclusion, CV. SBM violated Article 50, paragraph (2) of Law No. 41 of 1999 and Article 12, letter K of Law No. 18 of 2013. Illegal logging occurred outside the permitted area, thus the judge's ruling was appropriate, and sanctions must have a deterrent effect. Illegal logging disrupts environmental sustainability due to forest damage.

Abstract

The determination of the Entitled Party in the Land Acquisition Implementation phase basically refers to the provisions of Law Number 2 of 2012 concerning Land Acquisition for Public Purposes, supported by other related regulations such as Government Regulation Number 19 of 2021 on the Implementation of Land Acquisition for Public Development Purposes. It is emphasized that the Entitled Party is the one who truly has valid proof of ownership and/or legitimate control that can be accountable for its accuracy. Therefore, at the identification stage to determine the subject and object. The identified problem in this study is how the determination of entitled parties in the implementation stage of land acquisition is carried out in accordance with statutory regulations. The land acquisition implementer must thoroughly consider both the physical and juridical aspects of ownership of the land affected by the alignment for the Light Rail Transit (LRT) development in the Jabodetabek area. Based on the results and conclusion of the study, it is concluded that the provisions regarding the entitled parties are crucial to ensure legal certainty and avoid ownership disputes, as well as to provide a solid legal basis in every stage of land acquisition implementation, especially in national strategic infrastructure projects such as Jabodetabek LRT.

Abstract

Land acquisition for the construction of public infrastructure such as dams is a form of land acquisition for the public interest that must guarantee legal certainty and protection of citizens' rights to land. As a solution to reduce flooding, the government built a dam as a public interest project in Bogor Regency. Which requires the release of rights by providing fair and appropriate compensation. And the formulation of the problem is How is compensation given in land acquisition for the construction of the Cibeet and Cijurey Dams in Bogor Regency. This type of research is normative juridical which is descriptive-analytical. The data used are secondary data and primary data. Drawing conclusions with deductive logic. The results and conclusion of the analysis regarding the implementation of compensation at the land acquisition implementation stage are in accordance with applicable regulations. However, there are still differences of opinion regarding the amount of compensation so that strengthening is needed from various parties in its implementation so as not to cause social conflict

Abstract

Infrastructure development in Indonesia, such as the construction of Ring Road II by the Manado City Government, aims to enhance welfare. However, the land acquisition process for this project does not align with the procedures outlined in Law Number 2 of 2012 regarding Land Procurement for Public Interest Construction. The research investigates the land acquisition process and assesses whether Decision Number 661/Pdt.G/2021PN Mnd complies with the law. Using descriptive normative research with secondary data, the study reveals that the Manado City Government's land acquisition process lacks conformity with the legal preparatory stages specified in Articles 18 and 19 of Law Number 2 of 2012. Consequently, the considerations and decision in Judge's Decision Number 661/Pdt.G/2021PN Mnd align with the law.
