Abstract

ABSTRAKPartai politik merupakan satu diantara faktor yang penting dalam sistem politik sebuah negara demokrasi, dimana kemudian partai politik bagian dalam sistem politik keamanan tata kelola publik. Bahwa dalam proses penerapan, sistem politik keamanan tata kelola publik , partai politik wajib melakukan kontrol atas sebuah sistem politik keamanan tata kelola publik yang dikeluarkan oleh pemerintah guna menjalankan fungsi pemerintah. Ditengah masyarakat akan menjadi sebuah keniscayaan karena hukum berfungsi melayani masyarakatnya sesuai area dan eranya, dengan pendekatan sosiologis penelitian ini dapat mengaitkan antara pergulatan dan kesepakatan politik, serta kenyataan-kenyataan masyarakat yang mempengaruhinya.   Permasalahan dalam penulisan ini adalah bagaimana pelaksanaan istithaah pelaksanaan haji di Indonesia yang tersistematis, terstruktur dan masif?  Metode penelitian yang digunakan adalah metode penelitian yuridis normatif. Simpulan dari peulisan ini adalah bahwa kekuatan atas lahirnya sebuah kekutan politik melalui proses politik dalam institusi negara yang diberikan otoritas untuk membangun sistem politik keamanan tata kelola publik, serta komunikasi politik dari pusat hingga ke akar rumput diperlukan, sehingga akan lahir sebuah kekuatan dalam menjaga sistem politik keamanan tata kelola publik yang tersistematis, terstruktur dan massif.  Pemerintah yang merupakan (ulil amri) hasil dari Proses Politik dan juga merupakan kader dari Partai Politik wajib meningkatkan pelayanan kesehatan (termasuk memfasilitasi)  sebaik mungkin bagi calon jama’ah haji yang menderita gangguan kesehatan agar dapat melaksanakan ibadah haji dengan baik. Bahwa kekuatan atas lahirnya sebuah kekutan politik melalui proses politik dalam institusi negara yang diberikan otoritas untuk membangun sistem politik keamanan tata kelola publik, serta komunikasi politik dari pusat hingga ke akar rumput diperlukan, sehingga akan lahir sebuah kekuatan dalam menjaga sistem politik keamanan tata kelola publik yang tersistematis, terstruktur dan massif. Kata kunci: Membangun sistem politik, pelaksanaan Istihaah Jamaah Haji Indonesia.

Abstract

Amandemen UUD 1945 menghasilkan sejumlah design baru format kenegaraan Indonesia. Pertama, Presiden dan Wakil Presiden dipilih melalui pemilihan umum (pemilu) secara langsung oleh rakyat, sedangkan kewenangan MPR hanya sebatas melantik Presiden dan Wakil Presiden terpilih saja. Sebagai konsekuensinya, berbeda dengan sebelum perubahan UUD 1945, Presiden tidak lagi bertangungjawab kepada MPR, namun bertanggungjawab langsung kepada rakyat pemilih. Teori kedaulatan rakyat digunakan untuk menjelaskan secara filosofis dan bersifat makro mengenai rakyat sebagai asasi berdaulat di dalam kehidupan berbangsa dan bernegara, sebagai satu-satunya orang yang berhak dalam menentukan arah dan tujuan negara. Salah satu perwujudan kedaulatan rakyat melalui penyelenggaraan pemiluyang diatur dan dijamin oleh konstitusi. Kedaulatan bisa berada pada tangan seseorang dalam sistem pemerintahan yang otoriter atau tiran. Pemegang kedaulatan bertindak untuk dan atas nama negara. Dalam sistem oligarkhi, kedaulatan berada pada kelompok atau golongan tertentu masyarakat seperti: kaum bangsawan, kaum borjuis, partai, bahkan kelompok agama dalam negara agama. Sementara bagi negara  yang berpaham integralistik, kedaulatan ada pada negara, Dalam demokrasi, keterlibatan seluruh rakyat dalam Pemilu menjadi sumber legitimasi kekuasaan pemerintah. Tulisan ini bertujuan untuk mengetahui bahwa pemilu pada hakikatnya merupakan salah satu sarana kedaulatan rakyat yang mensyaratkan dilindunginya hak rakyat untuk memilih para pemimpin negara yang dijamin berdasarkan konstitusi.

Abstract

Parties politics are one of the most important components of a country's political system. This article aims to generate the birth of political power through the political process in empowered institution state and through political communication from the middle to the grassroots. The research method used in this research is a descriptive qualitative method. The data types used in this research are qualitative data, which are divided into primary data and secondary data. Data sources obtained through library research techniques (library research) are related to resources available online and offline, such as: Scientific journals, books, and news from reliable sources. The findings of this study conclude that the role of political forces in the political system is crucial in the process of legislation and communication through which the party's vision and mission are realized. Political institutions that formally have legislative power are staffed by those empowered to do so, or are reflected in the power structure of state institutions through formal political power, such as the President, the Council of People's Representatives, and other state institutions and political infrastructure. Political power, such as political parties, community leaders, community organizations, NGOs, professional associations, etc.

Abstract

Regional Autonomy as the implementation of the decentralization system there is delegation of authority given to regional governments to achieve the goals of each region, the regional head is tasked with leading the course of regional autonomy, the appointment of regional heads such as mayors who are not in accordance with statutory regulations can invite various conflicts. The formulation of the problem is what is the mechanism for appointing a mayor based on election regulations and whether this mechanism is in accordance with the mechanism for appointing Syamsuddin Lologau as mayor of North Jakarta. The purpose of this study is to describe the mechanism for appointing Mayors based on election regulations for DKI Jakarta Province and to analyze the appointment of Syamsuddin Lologau as Mayor of North Jakarta. This type of research uses normative legal research, is descriptive and explanatory, uses primary data and secondary data, qualitatively analyzed by drawing conclusions using deductive logic. Based on the appointment of the mayor of North Jakarta, Syamsuddin Lologau, it can be concluded that there was a violation of this appointment and the government should have regulated more clearly regarding the implementation of the mechanism for appointing officials and there is transparency regarding decisions regarding appointments within the scope of the state civil apparatus.

Abstract

Pasca Reformasi, Indonesia telah menyelenggarakan Pemilu langsung sebanyak empat kali, yakni pada tahun 2004, 2009, 2014, dan 2019. Dalam perhelatan Pemilu langsung tersebut rakyat dapat memilih langsung Presiden dan Wakil Presiden dan juga anggota legislatif. Akan tetapi, isu SARA untuk mempengaruhi kecenderungan pemilih dalam pertarungan politik antar kandidat masih acap mengemuka. Dari sudut pandang pertahanan negara, isu SARA yang muncul dalam kampanye politik adalah ancaman bagi keutuhan dan persatuan bangsa. Pemilu yang awalnya ditempatkan sebagai alat pemersatu bisa berubah sebaliknya, menjadi alat pemecah. Penelitian ini menggunakan pendekatan kualitatif dan bertujuan mendapatkan gambaran dan konstruksi partisipasi pemilih seperti apa yang dapat diterapkan dalam konteks kehidupan politik seperti Pemilu, terutama untuk mengatasi permasalahan isu SARA yang kerap berulang terjadi dari Pemilu ke Pemilu di Indonesia.

Abstract

This study explores the legal implications of the postponement of the halal certification requirement in Indonesia's tourism sector until 2026, focusing on strengthening the authority of the Halal Product Assurance Agency (BPJPH) in supervising and enforcing halal standards. This postponement creates significant challenges in the application of the Lex Superior Derogat Legi Inferiori principle and results in a legal vacuum (rechtsvacuum) that could undermine legal certainty. The study employs a descriptive approach with qualitative analysis involving in-depth interviews with BPJPH officials and constitutional law academics, as well as a review of documents related to halal regulations. The findings indicate that the postponement of halal certification negatively impacts regulatory compliance, damages Indonesia's image as a halal tourism destination, and necessitates strict legal measures to address the legal vacuum and strengthen BPJPH's authority. Practical recommendations are provided to enhance oversight and law enforcement to maintain the integrity of halal standards in Indonesia during this postponement period.

Abstract

Since Indonesia's establishment and independence, the process of filling the seats or positions of Regional Heads has changed many times, starting from the Old Order era, the New Order, and the reform period. These changes are actually in accordance with the needs of the times and not motivated by the interests of maintaining power. The decision of the Constitutional Court (MK) Number 60/PUU-XXII/2024 is right for now. At least it saves democracy from the cartel politics being played by the political elites in the country. The Constitutional Court's decision, which changed the threshold to resemble or almost the same as the requirements for individual candidates, opened the faucet for competition to become even more alive. This includes guaranteeing the constitutional rights of non-parliamentary political parties (without seats) to be able to nominate candidates for Regional Heads who were originally unable to as specified in Article 40 of Law 10 of 2016 concerning Pilkada. However, for the sustainability of democracy in the future, the author views that this decision is not optimal or still leaves problems. In the future, the implementation or application of a threshold or minimum requirement of support for the nomination of candidates for Regional Heads and even the President is no longer appropriate. In the future, an open nomination system should be applied, in which all political parties participating in the elections that pass the KPU verification are automatically entitled to propose candidates for Regional Heads. Some countries that adhere to the Presidential system do not recognize the term threshold. America, Brazil, Peru, Mexico, Colombia, and Kyrgyzstan.

Abstract

This study discusses the direct appointment of the Nusantara Capital Region Authority Chief by the President, bypassing general elections, raising questions about consistency with the underlying democraticprinciples of the Indonesian State. Although the 1945 Constitution grants the public the right to elect local leaders through general elections, the direct appointment of the Nusantara Capital Region Authority Chief creates tension with these principles, prompting inquiries about leadership legitimacy and the role between central and regional governance. Employing normative legal research methods and descriptive-analytical analysis of secondary data from literature, this study highlights the inconsistency between the appointment of regional heads and the fundamental democratic principles of the state. The implications of this appointment raise concerns regarding accountability, public representation, and alignment with democratic principles. The findings underscore the importance of maintaining consistency in the application of legal regulations in regional head elections, particularly in the Nusantara Capital, as a robust foundation for a transparent, accountable, and people-respecting democratic process.

Abstract

When elections are held, conflicts often arise as a result of the elections. This conflict arose during the regional elections for the regent and deputy regent of South Labuhanbatu in 2020 due to fraud which resulted in differences in votes at a number of polling stations. The main issue discussed was whether the re-voting in the election for the Regent and Deputy Regent of South Labuhanbatu was in accordance with the contents of Constitutional Court Decision Number 37/PHP. BUP-XIX/2021 and what legal impacts will arise as a result of the re-voting. This research uses descriptive normative legal research methods. The data used consists of primary and secondary data which are analyzed qualitatively, and conclusions are obtained through deductive logic. The results and conclusions show that the re-voting carried out in 16 villages by the KPU of South Labuhanbatu Regency was in accordance with the ruling of the Constitutional Court. The legal impact that arises from repetition of votes is when an applicant who previously submitted a request does not resubmit his application to the Constitutional Court. As a result, the KPU of South Labuhanbatu Province approved the elected candidates for Regent and Deputy Regent of South Labuhanbatu for 2020

Abstract

The provision of contraceptives for school-age children and adolescents is a complex issue, especially related to legal and social aspects. This study analyzes government policies regarding the provision of contraceptives in this age group based on Government Regulation No. 28 of 2024 which implements Law No. 17 of 2023 concerning Health. The policy aims to support reproductive health, prevent sexually transmitted diseases, and reduce teen pregnancy rates. The method used is a normative juridical approach, analyzing regulations and literature related to the perspective of legal ideals which are the fundamental principles that are the basis for the formation and implementation of laws and regulations. The results show that although this policy aims to protect the health of children and adolescents, this policy does not meet the aspect of the law itself and has no further explanation In conclusion, this policy needs to be adjusted to the principles of legal ideals, especially in terms of legal certainty and utility. The recommendations include the evaluations in terms of contraceptive services.
