Abstract

The Sahabat Saksi dan Korban (Friends of Witnesses and Victims) program is part of the 2025 Beginner Community Service Program implemented in Manggarai Village, Tebet District, South Jakarta. The program aims to strengthen protection and the fulfillment of victims’ rights through a community-based approach. Using a participatory descriptive qualitative method, the activities involved observation, interviews, documentation, and joint reflection with the community. The findings show that the program enhanced community legal awareness regarding victims’ rights, reporting mechanisms, and access to protection. It also contributed to psychosocial recovery, fostered social solidarity, and reinforced local protection networks through collaboration with LPSK and the IBLAM Legal Aid Institute. A field narrative illustrated the complexity of community roles in supporting victims amid stigma and cultural barriers. Supporting factors included community leaders’ involvement and institutional support, while social stigma remained the main obstacle. These findings suggest that the Sahabat Saksi dan Korban program is effective as a community-based model for victim protection and relevant to be replicated in other urban areas with similar vulnerabilities.

Abstract

Perencanaan kehutanan merupakan salah satu kegiatan dalam bidang kehutanan yang memegang peranan penting, karena kegagalan melakukan perencanaan akan berdampak negatif terhadap kelangsungan hutan, oleh karena dalam perencanaan kehutanan akan berkaitan pula dengan pengurusan kehutanan. Hal ini menjadi penting untuk melihat bagaimana peranan dan fungsi hutan kota, karena kenyataannya kota-kota yang terdapat di Kabupaten/Kota cenderung mengabaikan ruang hutan yang ada di kotanya. Regulasi tentang Perencanaan dan pengurusan hutan kota di DKI Jakarta menuju penyelenggaraan kehutanan yang bermanfaat dan lestari menjadi penting untuk dilihat bagaimana Pemerintah Provinsi DKI Jakarta melakukan perencanaan dan pengurusan hutan kotanya serta bagaimana upaya Pemprov DKI Jakarta mewujudkan peran hutan kota dalam pembangunan kota berkelanjutan yang berwawasan ekologi. Jenis penelitian yang digunakan adalah normatif empiris, paradigma konstruktivisme, pendekatan socio-legal research. Pengaturan hutan kota sifatnya himbauan dan tidak mewajibkan pemerintah kota untuk melakukan pembangunan dan pengembangan hutan kota. Pengaturan yang tidak tegas ini berimplikasi pada keseriusan pemerintah kota untuk membangun hutan kota, sehingga mengakibatkan pembangunan hutan kota bukan merupakan kebutuhan yang mendesak karena pemkot berprinsip mampu mengatasi permasalahan lingkungan dan hutan kota dinilai belum terlalu mendesak dibandingkan pembangunan lainnya yang bersifat pelayanan publik dan menyentuh masyarakat banyak. Namun demikian, upaya Pemprov DKI Jakarta telah berhasil melaksanakan amanat PP 63 Tahun 2002 untuk mewujudkan 10% dari luas kota DKI Jakarta untuk menyediakan hutan kota sebagai bagian dari RTH selama kurun waktu 4 tahun terakhir sejak 2015-2019.

Abstract

General Elections, or later known as Elections, are a means based on popular sovereignty with the function of electing the President and Vice President, members of the DPR, DPRD and DPD. During the Regional Head Election, problems such as disputes over the election and deputy regents. Wondama Bay, West Papua, the problem of which is contained in MK Decision no. 32/PHP.BUP-XIX/2021. The formulation of the problem discussed in this research is the causes of the decision to re-vote by the Constitutional Court as in MK Decision No. 32/PHP.BUP-XIX/2021 and what legal consequences arise from the re-voting after the intended Constitutional Court Decision. This research method includes normative legal research which is descriptive analytical in nature through the use of secondary data from the results of literature studies along with the results of interviews, then data is carried out qualitatively and conclusions are drawn based on deductive logic. The results of research and discussion show that violations by general election organizers took the form of double voting and double voter lists. Conclusion After the re-voting was carried out, the Regency General Election Commission determined the results in Decree No. 18/PL.02.7-Kpt/9207/KPU-Kab/IV/2021. that candidate pair number four was announced as the winner

Abstract

Suspension Of Debt Payment is a legal mechanism regulated in Law No. 37 of 2004, concerning Suspension Of Debt Payment (PKPU) and Bankruptcy, this mechanism allows Creditors and Debtors to apply for postponement of payment of overdue debts through the Commercial Court. This research aims to provide a comprehensive overview of the objection mechanism that can be submitted by Creditors in the event of a dispute between the value of the bill and the value determined by the Management. This research uses normative legal research methods. The results of this study indicate that when the PKPU application has been granted, the Debtor will be in a temporary PKPU condition which lasts for 45 days then the Panel of Judges will appoint Supervisory Judges and Administrators who are tasked with overseeing the PKPU process. In the PKPU series, there are agendas held by the Administrators, one of which is bill matching, in this agenda there is often a dispute between the value of the bill submitted by the Creditor and the value of the bill determined by the Administrators, which if there is such an event then referring to article 279 paragraph 2 of Law No. 37 of 2004, the Creditor can file an objection through the Supervisory Judge, then based on article 280 of Law No. 37 of 2004, the Supervisory Judge will issue a determination which then becomes a reference for the Management in determining the value of the bill from the Creditor which can be included in the PKPU process. This research also includes the determination in case Number: 125/Pdt.Sus-PKPU/2021/PN.Niaga.JKT.PST, in which case, both the Creditor and the Supervisory Judge have carried out the mechanism as regulated in Article 279 paragraph (2) and Article 280 of Law No. 37 of 2004.

Abstract

Pasca Reformasi, Indonesia telah menyelenggarakan pemilu langsung sebanyak lima kali, yaitu pada tahun 2004, 2009, 2014, 2019, dan 2024. Dalam pemilu ini, rakyat dapat memilih langsung presiden, wakil presiden, serta anggota legislatif yang akan memimpin Negara Republik Indonesia. Namun, isu suku, agama, dan ras (SARA) masih sering digunakan untuk mempengaruhi kecenderungan pemilih dalam pertarungan politik antar kandidat. Dari sudut pandang pertahanan negara, isu suku, agama, dan ras (SARA) dalam kampanye politik merupakan ancaman bagi keutuhan dan persatuan bangsa. Pemilu yang awalnya berfungsi sebagai alat pemersatu dapat berubah menjadi alat pemecah. Penelitian ini menggunakan pendekatan kualitatif dan bertujuan untuk mendapatkan gambaran serta konstruksi bela negara yang dapat diterapkan dalam konteks politik seperti pemilu, terutama untuk mengatasi masalah isu suku, agama, dan ras yang sering terjadi. Hasil penelitian ini diharapkan dapat memberikan panduan bagi para pemangku kepentingan, baik itu bagi para peserta maupun penyelenggara pemilu, dalam menyusun langkah strategis untuk mengatasi politisasi SARA pada setiap perhelatan pemilu di Indonesia.

Abstract

This research highlights Judge Guntur Hamzah's dissenting opinion in the Constitutional Court's decision regarding Article 35 paragraph (1) of Law no. 13 of 2023 concerning Employment. He criticized the phrase "recruit the required workforce clarity" which has the potential to give rise to legal uncertainty and discrimination, especially regarding age limits and appearance requirements. This dissenting opinion provides an alternative perspective that encourages critical reflection on the majority decision. The implication is the need for legal revisions for justice and inclusiveness, punctuation increasing public awareness about discrimination. The research method uses normative juridical methods with a literature approach. Research recommendations include reviewing Article 35 paragraph (1), stricter law enforcement, and developing fair employment policies.

Abstract

In a democratic country, elections play a crucial role in shaping a power system based on the sovereignty of the people. The Election Law regulates the requirements for candidacy for the positions of President, Vice President, and legislative members. However, currently, many legislative candidates do not adhere to the specified criteria. The identification problem revolves around the rights of former corrupt convicts before and after Constitutional Court Decision Number 87/PUU-XX/2022, as well as the implications and consequences following the decision, which altered one of the conditions for candidacy as a legislator. The research method employed is a normative and descriptive study, utilizing secondary data as the source of information. This data is qualitatively analyzed, and conclusions are drawn deductively. The result research and conclusion indicate that Constitutional Court Decision Number 87/PUU-XX/2022 has led to changes in the eligibility criteria for legislative candidates, particularly for former convicts, who are now required to wait for 5 years after their release before being eligible to run for election again.

Abstract

Restrictions on the activities of foreigners in Indonesia are intended to prevent immigration violations, such as misusing visas or residence permits. The misuse of residence permits of two foreign nationals (WNA) from India named Mohammad Zaffer Syed and Syed Naveed violated Law No. 6 of 2011 concerning Immigration by carrying out activities contrary to their limited stay permits. The identification problems of this research are: how the immigration action against the abuse of residence permits by the Indian foreigner is, and whether the immigration action against the two WNAs is in accordance with Law No. 6 of 2011 concerning immigration. The article is a normative legal research, descriptive in nature, using secondary data, then analyzed qualitatively, and the conclusion is drawn deductively. The research and conclusion of this research shows that foreigners from India named Mohammad Zaffer Syed and Syed Naveed Abbas are proven to have misused their residence permit and violated Article 122 letter a of Law No. 6 of 2011 concerning Immigration, and were sentenced to five months imprisonment and a fine of IDR 500,000,000.  with the provision that if the fine is not paid, it will be changed to one-month imprisonment.
