Abstract

This research discusses the criminal act of money laundering through crypto assets and the form of criminal liability for crypto assets as an object of money laundering in Indonesia. Crypto assets function as an investment not for currency as a means of payment, but crypto assets are legally designated as digital commodity objects in the form of assets. Crypto assets have the threat of being misused as a new mode of money laundering to hide and disguise the proceeds of criminal acts. This research is structured with a statutory approach, concept approach and case approach with data collection based on literature and secondary materials.The results of the discussion of this research show that legitimate crypto assets as digital commodities can turn into illegitimate or illegal crypto assets as a result of the object of the means of criminal acts of money laundering. Money laundering through crypto assets that fulfill the elements of the criminal act of money laundering has criminal liability. The perpetrators of money laundering through crypto assets can be reached and held accountable according to the money laundering article violated in Law Number 8 Year 2010.

Abstract

Health is a human right and is an element of welfare because health is a community need and must be realized. One of the health supports is medicine, the function of medicine is prevention, healing, recovery, health improvement, and contraception, for humans. Based on its function and the dangerous consequences of drug consumption, its manufacture and distribution must be under the supervision of the Food and Drug Monitoring Agency, by Presidential Regulation Number 80 of 2017 concerning the Food and Drug Monitoring Agency.Under his supe rvision, illegal drugs remain widespread and consumed in inappropriate doses by the public, including hard drugs and narcotics. As a result of dependence, many drug traffickers are caught and repeat the same actions (recidivists). Drug recidivism is regulated in Law Number 5 of 2009 concerning Narcotics Article 144 paragraph (1). However, the distribution of narcotics continues to occur. From the results of this research, the author found that BPOM's efforts as a supervisory body need to be increased, not only collaborating between agencies but also inviting the community, this is also to realize Chapter XIII concerning Community Participation, Law Number 35 of 2009 concerning Narcotics. Also, apply the most severe sanctions to create a deterrent effect so that there is no repetition of criminal acts of narcotics trafficking.

Abstract

This research discusses the unilateral cancellation of concerts by organizers at Serasa Nada music concerts in Yogyakarta. This research uses Normative Juridical research type in which the processing of legal materials is done through literature study. This study aims to analyze the legal protection of Serasa Nada concert ticket buyers in Yogyakarta who were unilaterally canceled by the organizer. The results showed that for the cancellation of the Serasa Nada music concert in Yogyakarta there are legal consequences that occur, namely default. The legal consequences of default are penalties or sanctions in the form of paying losses, canceling the agreement, transferring risks and paying court costs. In addition, because it uses an electronic platform, the rules of Article 17 of the ITE Law and Article 18 paragraph (1) of the ITE Law jo. Article 46 paragraph (1) PP 71/2019 and the organizer is responsible according to Article 21 paragraph (2) letter c of the ITE Law. Legal efforts that can be made by buyers of Serasa Nada concert tickets are to file a civil lawsuit, namely a lawsuit for default in Article 1267 of the Civil Code and because concert ticket sales use a platform which is a form of electronic transaction, ticket buyers can file a lawsuit in Article 35 jo. Article 38 of the ITE Law. In addition, a criminal lawsuit can be filed in Article 28 paragraph (1) jo. Article 45 paragraph (2) of the ITE Law.

Abstract

Foreign nationals who enter Indonesia for work must be filtered and their use limited, especially in placement in structural positions in companies, bearing in mind the mandate of the Manpower Law which must prioritize Indonesian citizens in all available positions or positions. This research uses a normative juridical research type, research is carried out through literature study using a statutory approach and a conceptual approach. This research aims to find out the truth regarding the placement of foreign workers in personnel positions in a company along with the legal consequences for foreign workers themselves and companies who abuse their positions based on statutory regulations. The results of the analysis in this research show that the placement of foreign workers in personnel positions is not justified because it violates the provisions of Law Number 13 of 2003 concerning Employment, Government Regulation Number 34 concerning the Use of Foreign Workers, and the Job Creation Law. The legal consequences of violations for companies are in the form of criminal sanctions or administrative sanctions, while for foreign workers there are no statutory regulations that specifically regulate the legal consequences.

Abstract

Korporasi sebagai subjek hukum sudah diakui dan diatur dalam Undang-Undang khususnya Undang-Undangan Perlindungan Pengelolaan Lingkungan Hidup. Sebagai subjek hukum korporasi yang melakukan tindak pidana dapat dimintai pertanggungjawaban pidana. Dimana dalam meminta pertanggungjawaban pidana tersebut terdapat beberapa asas atau doktrin yang dapat digunakan yakni antara lain strict liability, asas vicarious liability, asas respondent superior, dan asas delegasi. Berkaitan dengan permasalahan yang sedang dibahas maka akan lebih difokuskan pada doktrin strict liability, hal tersebut didasarkan pada tindak pidana dalam lingkungan hidup yang dilakukan oleh korporasi. Dimana semakin pesatnya teknologi dan munculnya beragamnya modus operandi maka tentunya akan sulit untuk membuktikan ada atau tidaknya kesalahan pada korporasi, serta alasan penghapusan kesalahan yang dimaknai dan diterapkan secara berbeda-beda oleh Majlis Hakim yang akan berakibat pada dapat atau tidaknya korporasi dijatuhi pemidanaan, sementara disisi lain telah terjadi kerusakan atau pencemaran atas lingkungan akibat tindakan operasional dari korporasi. Hal tersebut sebagaimana Putusan Mahkamah Agung Nomor 3840 K/Pid.Sus.LH/2021 atas nama Terdakwa PT Kumai Sentosa dan Putusan Mahkamah Agung Nomor 3700 K/Pid.Sus-LH/2022 dengan Terdakwa PT Nickcrome Indo Jaya, memang terdapat perbedaan tindak pidana yang dilakukan oleh kedua korporasi tersebut, namun poin yang hendak ditelaah adalah mengenai perbedaan pertimbangan Majelis Hakim untuk menentukan hapusnya kesalahan dan serta bagaimana penerapan dari doktrin strict liability dalam tindak pidana lingkungan hidup yang berfokus pada pertanggungjawaban tanpa memerlukan pembuktian unsur kesalahan (mens rea), melainkan cukup dengan adanya perbuatan terlarang (actus reus) yang telah dilakukan. Penelitian dalam tesis ini menggunakan tipe penelitian legal research, serta untuk memperoleh pemecahan masalah menggunakan metode statute approach, conceptual approach dan case approach. Berdasarkan pembahasan tersebut menunjukan adanya inkonsistensi terhadap penerapan perlu tidak kesalahan, alasan penghapus kesalahan, perbedaan penerapan doktrin strict liability akibat tidak diaturnya doktrin strict liability dalam aspek tindak pidana secara tegas dalam Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup.

Abstract

In Indonesian law, both individuals and legal entities such as corporations are recognized as legal subjects. Corporations, which are governed by civil law, are now increasingly associated with crime, particularly Corporate Crime. Although initially disputed, it is now accepted that legal entities can be involved in criminal acts and that corporations should be held accountable for their unlawful actions. Corporate Crime encompasses situations where corporations break the law for their benefit, often in disregard of applicable regulations and norms. This development marks a shift in criminal law from targeting individuals to also holding corporations accountable. Therefore, principles such as Vicarious Liability and Strict Liability become the basis for establishing legal liability for corporations. These principles ensure that corporations are responsible for their actions, similar to the liability imposed on individuals. Since the legal construction in Perma RI No. 13 Year 2016 is different from individuals, corporations require specific legal principles to regulate their liability. Concepts such as Vicarious Liability, Strict Liability, and others become important pillars in imposing responsibility on corporations. Recognizing corporations as perpetrators of criminal acts shows the evolution of the legal system to adjust to the complexity of modern business practices and uphold justice in an ever-changing society.
