Abstract

The Noken system in Papua has generated significant debate regarding the balance between electoral democratic principles and Indigenous political traditions. Within this system, the Big Man holds a central position as the decision-maker for collective votes through structured community deliberation. Although frequently viewed as conflicting with the principle of “one person, one vote,” this practice represents an Indigenous conception of justice based on communal consensus and respect for leaders with strong moral legitimacy. This study aims to examine the role of the Big Man in the Noken system, its contribution to the protection of human dignity, and its relevance within Indonesia’s legal and democratic framework. Using a qualitative approach supported by literature review and analysis of Constitutional Court decisions, the research identifies that the legitimacy of the Big Man rests on a consistent record of service, the capacity to maintain social harmony, and customary authority recognized by the community. Findings indicate that the Noken system functions as a valid expression of cultural democracy when implemented in a participatory, transparent manner and when it accommodates individuals who choose to vote independently. This research offers a unique contribution by demonstrating the compatibility of Indigenous political mechanisms with human rights principles and by providing insights for strengthening electoral governance in Indigenous regions.

Abstract

The development of the platform economy in Indonesia has significantly transformed employment patterns, yet this transformation has not been companied by an adequate legal framework, resulting in legal uncertainty and structural injustice. This study aims to examine the structural roots of such uncertainty, analyse the problems in the relationship between platform companies and workers, and reaffirm the state’s responsibility to ensure legal certainty. Adopting an empirical juridical method with doctrinal and non-doctrinal approaches, the study finds that legal uncertainty is driven by multidimensional factors. These include the failure to internalise justice principles in the protection of platform workers, regulatory framework that remain ad hoc, sectoral, and frequently changing, a political configuration influenced by market logic and capitalism, and a gap between the evolving practices of platform work and the existing legal framework. These conditions create ambiguity in worker status and reinforce structural injustice in employment relations. In this context, the state is required to perform a corrective function to address structural inequality by recognising worker status, providing protection that ensures legal certainty and effectiveness, and regulating the distribution of economic risks and benefits in a fair and proportional manner. This study proposes a conceptual framework based on three pillars—recognition, protection, and redistribution—as a foundation for adaptive and progressive legal reform, while also contributing theoretically and practically to the development of labour law in the digital era.

Abstract

The increasing problem of plastic waste has become a serious environmental challenge, particularly due to its non-biodegradable nature and its negative impact on ecosystems. On the other hand, the demand for construction materials such as paving blocks continues to grow along with infrastructure development. This study aims to examine the utilization of plastic waste as an alternative material in the production of environmentally friendly paving blocks with economic value for the community. The method used in this study is the Participatory Action Research (PAR) approach, which actively involves the community through stages of observation, planning, training implementation, evaluation, and reflection. The study was conducted in Rengas Village, Kedungwuni District, with waste collectors as the research subjects. Data were collected through observation, pre-test, post-test, and practical assessments to measure improvements in participants' knowledge and skills. The results show that the utilization of plastic waste in paving block production produces materials that are lighter in weight, have lower water absorption, and exhibit good wear resistance. In addition, there was an improvement in community knowledge and skills in plastic waste management. From an environmental perspective, this innovation contributes to reducing the volume of plastic waste, while economically it can reduce production costs by approximately 25% and create new business opportunities for the community. In conclusion, the use of plastic waste as a material for paving blocks has significant potential as an innovative solution for waste management while supporting sustainable development based on a circular economy.
