Abstract

Money laundering is a follow-up crime, an underlying crime from a predicate crime, so that the existence of money laundering cannot be separated from the original crime. How can money laundering occur without proving the original crime? Therefore, the aim of this study is to analyze the legal implications of predicate offenses without substantiation in money laundering in Indonesia. This research is juridical-normative research, which uses a statutory approach and a case approach. The results of this study indicate that there are legal implications for predicate offenses without proof in money laundering in Indonesia. Starting from breaking through the presumption of innocence and inconsistencies in legal norms in the TPPU Law. So, it is necessary to change the construction of norms contained in article 69 related to proving predicate crimes in TPPU.

Abstract

The Family Welfare Empowerment Program (PKK) is essential as a community organization to empower women to participate in village development. In this case, women are also involved in a particular organization and can participate in village development by encouraging the participation of village communities. The method of implementing community service that is carried out is the Community Organization / Community Development (CO / CD) Method. The Community Organization / Community Development (CO / CD) method is one of the methods in social work practice with the main focus being the wider community or community with activities that involve the community to increase the level of social functioning of the community, especially in community self-involvement of Family Welfare Empowerment Program (PKK) organizations in Ilangata Village. The techniques implemented in this community service activity are observation, interviews, and Methodology Participatory Assessment (MPA). The stages of implementing this community service activity are social initiation, social organizing, social assessment, social intervention planning, and social intervention. The result of community service activities that have been carried out is the implementation of capacity-building activities for the Ilangata Village Family Welfare Empowerment (PKK) organization, which consists of reactivating organizations supported by the Decree of the Head of Ilangata Village concerning the Establishment and Appointment of the Ilangata Village Family Welfare Empowerment (PKK) Management Number 41 of 2022, capacity building resources through the provision of entrepreneurship materials and training for members of the Ilangata Village Family Welfare Empowerment Program (PKK) organization. Abstract

Dalam sistem penyelenggaraan kenegaraan, Dewan Perwakilan Rakyat Daerah ditetapkan sebagai salah satu unsur penyelenggara pemerintahan, sebagaimana disebutkan pada Pasal 1 Ayat (2) Undang-undang Nomor 32 Tahun 2004 adalah penyelenggara urusan DPRD dalam sistem dan prinsip Negara Kesatuan Republik Indonesia sebagaimana dimaksudkan dalam Undang-undang Dasar Negara Republik Indonesia Tahun 1945. Kedudukan DRPD sebagaimana yang diamanatkan oleh undang-undang Nomor 32 Tahun 2004 implikasinya adalah antara kepala daerah dan DPRD benar-benar memiliki kesetaraan dan kesederajatan dan tidak ada dominasi salah satu diantara keduanya. Berbagai data dan fakta yang telah diungkapkan tersebut membuktikan DPRD Kabupaten Bone Bolango, dari hasil pengamatan awal penulis fungsi pengawasan yang seharusnya dijalankan oleh para anggota DPRD Kabupaten Bone Bolango dirasa belum maksimal. Penelitin ini bertujuan untuk menganalisis bagaimana Pelaksanaan Fungsi Pengawasan Dewan Perwakilan Rakyat Daerah pada Pelaksanaan Peraturan Daerah tentang Penyelenggaraan Pelayanan Publik di Kabupaten Bone Bolango serta faktor-faktor apa yang menghambat Pelaksanaan Fungsi Pengawasan Dewan Perwakilan Rakyat Daerah pada Pelaksanaan Peraturan Daerah tentang Peyelenggaraan Pelayanan Publik di Kabupaten Bone Bolango. Berdasarkan hasil penelitian peneliti menyimpulkan bahwa Pelaksanaan Fungsi Pengawasan Dewan Perwakilan Rakyat Daerah pada Pelaksanaan Peraturan Daerah tentang Penyelenggaraan Pelayanan Publik di Kabupaten Bone Bolango dilakukan dengan dua cara, yakni formal dan informal. Dalam suatu pengawasan tentunya terdapat suatu pengawasan internal kemudian pengawasan DPRD terhadap Perda Pelayanan Publik belum dapat dikatakan efektif dikarenakan beberapa faktor diantaranya faktor struktur hukum, substansi hukum dan kultur hukum. .Kata kunci: Efektivitas, Fungsi Pengawasan, DPRD, Peraturan Daerah, Pelayanan Publik ABSTRACT In the state administration system, the Regional People's Representative Council is designated as one of the elements of government administration, as stated in Article 1 Paragraph (2) of Law Number 32 of 2004, which is the organizer of DPRD affairs in the system and principles of the Unitary State of the Republic of Indonesia as intended in the Law. The various data and facts that have been disclosed prove that the DPRD of Bone Bolango Regency, from the author's initial observations, feels that the supervisory function that should be carried out by members of the DPRD of Bone Bolango Regency is not optimal. This research aims to analyze how the Supervisory Function of the Regional People's Representative Council is implemented in the Implementation of Regional Regulations on the Delivery of Public Services in Bone Bolango Regency and what factors hinder the Implementation of the Supervisory Function of the Regional People's Representative Council in the Implementation of Regional Regulations on the Delivery of Public Services in Bone Regency. Bolango. Based on the results of the research, the researcher concluded that the implementation of the Supervisory Function of the Regional People's Representative Council on the Implementation of Regional Regulations concerning the Implementation of Public Services in Bone Bolango Regency is carried out in two ways, namely formal and informal. In supervision, of course there is internal supervision, then the DPRD's supervision of the Public Service Regional Regulation cannot be said to be effective due to several factors, including legal structure, legal substance and legal culture.
