Abstract

After the Law on Foundations was formed, every Foundation that existed before the enactment of the Law was obliged to adjust its Articles of Association with the provisions of the Law on Foundations. If not, there will be legal consequences for foundations that have not made adjustments, or in other words, the foundation will be legally weak and will also have an impact on the assets/wealth of the foundation. The purpose of this study is to find out the legal implications for new foundations that do not comply with the Foundation Law, as well as find out the typology of strengthening foundations to adjust the condition of their assets by the Foundation Law. With the sociological juridical method, it can be concluded that for foundations that do not adjust their statutes by the Law on foundations, especially related to assets, the foundation will have difficulty managing the ownership of its assets, especially for immovable objects. Then there are two typologies of strengthening to adjust the conditions of the AR Foundation by the Foundation Law, namely from the legality side of law and audit reports. Legal legality emphasizes that achieving accountability and transparency can be carried out through non-litigation efforts which include controlling assets, increasing the capacity of Foundation organs, strengthening supervision, and mediation as well as litigation efforts in the form of court suits. While the typology of strengthening in terms of financial reports, foundations need to have routine reporting standards to report their activities and funding to the Foundation Trustees by financial accounting standards. Keywords: Foundation; Strengthening; Typology.   Abstrak Pasca Undang – Undang tentang Yayasan terbentuk, setiap Yayasan yang lahir/ ada sebelum UU Yayasan wajib untuk menyesuaikan Anggaran Dasarnya dengan ketentuan UU Yayasan. Jika tidak maka akan ada implikasi hukum terhadap Yayasan yang belum melakukan penyesuaian, atau dengan kata lain Yayasan tersebut lemah secara hukum yang turut berdampak (salah satunya) terhadap asset/kekayaan Yayasan. Penyesuaian yang diwajibkan semata-mata bertujuan untuk memberikan penguatan pada sebuah Yayasan yang masih eksis hingga saat ini. Sedangkan penguatan itu sendiri memiliki karakter tertentu yang pada umumnya akan terakumulasi dan muncul sebagai bentuk kesan maupun citra yang diberikan siapa saja terhadap eksistensi Yayasan. Beranjak dari latar belakang yuridis demikian maka penelitian ini menjadikan Yayasan “AR” sebagai objek penelitian, karena berdasarkan observasi peneliti menemukan adanya problem status asset/ kekayaan Yayasan yang disebabkan oleh kurang optimalnya pengelolaan aset yang harus mengacu kepada UU Yayasan. Problem yang demikian menempatkan posisi Yayasan “AR” lemah secara hukum terhadap kepemilikan asetnya, sehingga melalui penelitian ini diharapkan dapat memberikan gambaran objektif mengenai faktor penyebab problem tersebut, dan memberikan solusi mengenai langkah apa saja yang diperlukan untuk memperkuat Yayasan “AR”. Terlebih bahwa Penyesuaian asset/ kekayaan memiliki keterkaitan dengan terbentuknya sebuah klasifikasi penguatan atau yang sering digunakan dengan istilah tipologi penguatan. Guna menjawab permasalahan tersebut, peneliti mengangkat dua buah permasalahan, pertama apa implikasi hukum terhadap Yayasan baru yang tidak menyesuaikan diri dengan UU Yayasan, khususnya terkait asset Lembaga, dan kedua bagaimana tipologi penguatan untuk menyesuaikan kondisi Yayasan baru saat ini dengan ketentuan UU Yayasan. Abstract

Law number 41 of 2004 concerning Waqf explains that the management and development of waqf land can be carried out by Nazhir in the form of a legal entity. However, there are still many mosques managed by the Foundation that still stand on non-waqf land or in this case the land status does not yet have legal documents such as certificates. This problem is also experienced by the "M" Mosque, one of the mosques in the city of Malang which has been established since 1983. This service program aims to provide assistance and legal knowledge to Foundation administrators regarding the legality registration of land assets regarding mosque management. This service uses the PAR (Participatory Action Research) method, where the stages include planning, implementation and evaluation activities. This legal assistance activity was carried out in January - July 2023. The results of the service showed that the reason the mosque was still standing on non-waqf land was the lack of knowledge of the Foundation management regarding land legality registration procedures. Appropriate assistance to be provided is in the form of counseling and processing legal documents in registering waqf certificates. This service activity through mentoring is carried out as a method of providing information about strategic steps in managing the Foundation's assets so that they are more optimal.   Abstract Optimalisasi Status Aset Yayasan Melalui Pendampingan Pendaftaran Tanah Masjid “M” Kota Malang. Undang-Undang No. 41 Tahun 2004 tentang Wakaf menjelaskan bahwa pengelolaan dan pengembangan tanah wakaf dapat dilakukan oleh Nazhir yang berbentuk badan hukum. Akan tetapi masih banyak masjid yang dikelola Yayasan masih berdiri di atas tanah non wakaf atau dalam hal ini status tanah belum memiliki dokumen legal seperti sertifikat. Persoalan ini yang juga dialami Masjid “M”, salah satu masjid di kota Malang yang telah berdiri sejak tahun 1983. Program pengabdian ini bertujuan untuk memberikan pendampingan dan pengetahuan hukum kepada pengurus Yayasan tentang pendaftaran legalitas aset tanah terhadap pengelolaan masjid. Pengabdian ini menggunakan metode PAR (Participatory Action Research), dimana tahapannya meliputi kegiatan perencanaan, pelaksanaan, dan evaluasi. Kegiatan pendampingan hukum ini dilaksanakan pada bulan Januari – Juli 2023. Hasil pengabdian diperoleh penyebab masjid masih berdiri di atas tanah non wakaf yaitu kurangnya pengetahuan pengurus Yayasan mengenai prosedur pendaftaran legalitas tanah. Pendampingan yang sesuai untuk diberikan yaitu dalam bentuk penyuluhan dan pengurusan dokumen-dokumen hukum dalam pendaftaran sertfikat wakaf. Kegiatan pengabdian melalui pendampingan ini dilakukan sebagai metode pemberian informasi tentang langkah strategis pengelolaan aset Yayasan agar lebih optimal.

Abstract

After the issuance of the Foundation Law, every Foundation that existed before the Foundation Law was required to adjust its Articles of Association with the provisions of the Foundation Law. If not, there will be legal implications for the Foundation, or in other words, the Foundation is legally weak which will also have an impact on the assets/wealth of the Foundation. Moving on from the results of observations, the service team found problems with the asset status/wealth of the Foundation caused by the less than optimal management of assets which must refer to the Waqf Law. Such problems place the position of the "AR" Foundation legally weak. This community service activity is intended to strengthen the partner's position as a new foundation, a continuation of the old foundation that has existed since 1977. The method used in this community service activity is the method of counseling and legal assistance directly to partners. The application of flowcharts, preparation of letters according to format, and tables of completeness of documents are the outputs of service activities for partners who can provide information and understanding about efforts to strengthen the Foundation.

Abstract

According to public law, employers are required by statute to pay compensation to employees whose work period has ended or whose completed work has resulted in the termination of their employment relationship. This is specifically related to the implementation of paying compensation to workers with specified time agreement. But what about the employees whose jobs expire before the terms of the employment contract? What are the rights of employees as they relate to labor law which is applied in accordance with both public and private law?. The sociological juridical (empirical) method was employed in this study to gain legal information experimentally. The data were collected through interviews, literature studies, target object observation, and online websites. This study provided multiple findings. First, the agreement was implemented while adhering to the construction mandated by statutory laws and maintaining compliance with existing provisions during its implementation. Second, when considering the factor leading to the termination of the labor agreement prior to its expiration, it could be observed that this incidence was caused by two variables: the employer factor and the employee component. Third, if a worker's work period ended before the work agreement due date, didn’t receive compensation money unless their death caused the work agreement to terminate. Similarly, if a worker's work period ended or the work was completed, they didn’t receive compensation money because the payment was provided during the employment agreement's implementation. It is intended that recommendations derived from this study will consider different viewpoints when putting the agreement into practice. In addition, it is expected of the parties to always work toward a cordial and professional working relationship and to heed any signals sent by the government. Abstrak Dalam pelaksanaan pemberian uang kompensasi kepada pekerja PKWT secara hukum publik bahwa peraturan perundang-undangan mewajibkan pengusaha untuk memberikan uang kompensasi kepada pekerja yang telah habis masa kerjanya atau telah selesainya pekerjaan yang dikerjakan sehingga menyebabkan berakhirnya hubungan kerjaa diantara keduanya. Namun, bagaimana dengan pekerja yang berakhir masa kerjanya sebelum perjanjian kerja berakhir. Bagaimana hak-hak nya pekerja itu jika dilihat dari kacamata hukum ketanagakerjaan yang keberlakuannya menganut dua bentuk hukum yaitu privat dan publik. Adapun metode yang digunakan dalam penelitian ini adalah metode yuridis sosiologis (empiris) yaitu memperoleh pengetahuan hukum secara empiris dengan teknik pengumpulan data melalui observasi pada objek yang dituju, wawancara, studi kepustakaan, dan juga website internet. Dalam penelitian ini menghasilkan beberapa kesimpulan Pertama, bahwa pelaksanaan perjanjian yang terjadi dibuat dengan tetap mengikuti kontruksi yang diperintahkan oleh peraturan perundang-undangan serta dalam pelaksanannya tetap sesuai denagan ketentuan yang ada. Kedua, bila dilihat dari aspek faktor penyebab berakhirnya perjanjian kerja sebelum perjanjian kerja itu berakhir disebabkan oleh dua faktor yaitu dari faktor pekerja itu sendiri dan dari faktor pengusaha yang menyebabkan kejadian ini terjadi. Ketiga, pekerja yang berakhir masa kerjanya sebelum perjanjian kerja berakhir tidak mendapatkan uang kompensasi kecuali perjanjian kerja tersebut berakhir disebabkan oleh pekerja meninggal dunia, dalam hal pekerja yang telah habis masa kerjanya atau telah selesainya pekerjaan yang dikerjakan maka uang kompensasi tersebut juga tidak diterima dikarenakan uang kompensasi tersebut tidak diberikan di akhir melainkan pada saat berjalannya perjanjian kerja. Saran dari penelitian ini diharapkan dalam pelaksanaan perjanjian memperhatikan berbagai perspektif. Selanjutnya para pihak diharapkan selalu mengupayakan hubungan kerja yang baik dan professional serta memperhatikan rambu-rambu yang diberikan oleh pemerintah.

Abstract

The distribution of inheritance for adopted children in Islamic inheritance and civil law in Indonesia is a complex and multidimensional issue, reflecting the dynamics between the principles of religious law and the development of modern secular law. This study aims to analyze the position of adopted children in the Islamic inheritance system and civil law, and to identify the challenges and integrative solutions needed to protect their rights. The method used is qualitative with a descriptive-analytical approach, through literature studies, interviews with legal experts, and analysis of relevant laws and regulations. The results of the study indicate that traditional Islamic law does not automatically recognize adopted children as heirs, except through special mechanisms such as wills, while civil law provides greater flexibility by recognizing the inheritance rights of adopted children as equal to biological children. This difference gives rise to legal conflicts, especially in families that integrate the two legal systems. In addition to legal aspects, social and ethical factors such as cultural stigma also influence the acceptance of adopted children's inheritance rights. This study recommends harmonization between Islamic law and civil law through legal reform and constructive dialogue between stakeholders, as well as increasing education and public awareness regarding the rights of adopted children in inheritance. Thus, it is hoped that a more just and inclusive legal system will be created, which is able to protect the rights of adopted children while maintaining the basic principles of Islamic law.

Abstract

This study examines the role of asset legality and land management in strengthening agrarian reform, particularly its impact on the welfare of smallholder farmers in Indonesia. The main objectives of this study are to evaluate the effectiveness of regulations that support farmer empowerment and to formulate an integrative strategy to promote sustainable agrarian justice. This study looks at laws and regulations, checks how they are put into practice, and measures how well these policies help reduce unfairness in owning and accessing land and resources. The results show that programs such as Complete Systematic Land Registration (PTSL) play an important role in accelerating the legalization of land assets but have not fully addressed the challenges of legal uncertainty and weak land management. Legal land ownership has been shown to increase smallholder farmers' access to financing and subsidies, while effective land management contributes to increased productivity and sustainability. To realize inclusive agrarian reform, cross-sectoral synergy is needed through bureaucratic simplification, fair land redistribution, technical training, and strengthening the role of the National Land Agency (BPN) and developing a community-based land management model.   Penelitian ini mengkaji peran legalitas aset dan manajemen lahan dalam memperkuat reforma agraria, khususnya dampaknya terhadap kesejahteraan petani gurem di Indonesia. Tujuan utama studi ini adalah mengevaluasi efektivitas regulasi yang mendukung pemberdayaan petani serta merumuskan strategi integratif untuk mendorong keadilan agraria secara berkelanjutan. Dengan menggunakan pendekatan normatif-empiris dan metode deskriptif-analitis, dengan menganalisis peraturan perundang-undangan, mengevaluasi implementasinya di lapangan, dan menilai sejauh mana kebijakan mampu mengatasi ketimpangan kepemilikan serta akses terhadap sumber daya agraria. Hasil penelitian menunjukkan bahwa program seperti Pendaftaran Tanah Sistematis Lengkap (PTSL) berperan penting dalam mempercepat legalisasi aset tanah, namun belum sepenuhnya menjawab tantangan ketidakpastian hukum dan lemahnya pengelolaan lahan. Kepemilikan tanah yang sah terbukti meningkatkan akses petani gurem terhadap pembiayaan dan subsidi, sementara manajemen lahan yang baik berkontribusi pada peningkatan produktivitas dan keberlanjutan. Untuk mewujudkan reforma agraria yang inklusif, diperlukan sinergi lintas sektor melalui penyederhanaan birokrasi, redistribusi tanah yang adil, pelatihan teknis, serta penguatan peran Badan Pertanahan Nasional (BPN) dan pengembangan model manajemen lahan berbasis komunitas.

Abstract

Land disputes are a significant issue in Bumiaji Village, Batu City, East Java, due to the community's low legal literacy and limited involvement of local stakeholders. Lack of understanding of formal legal procedures, the importance of land certification, and disharmony between customary and national laws have made it difficult to resolve land conflicts. This research aims to improve community legal literacy by considering the local context and strengthening the involvement of local stakeholders in land dispute resolution. The method used was Participatory Action Research (PAR), which actively involved communities and local stakeholders in problem identification, program design, and evaluation. The results showed that a locally-based approach that integrates customary and national laws was successful in improving community understanding of their legal rights and obligations, as well as encouraging participation in formal dispute resolution. In addition, the involvement of village officials, traditional leaders, and the National Land Agency in the dispute resolution process was able to create a more inclusive and equitable solution. The research concludes that legal literacy and synergy between local actors are key to resolving land disputes effectively and sustainably.

Abstract

Sekolah Ramah Anak (SRA) harus membuat proses pembelajaran yang menyenangkan dengan inovasi dari sekolah dan penerapan disiplin ilmu positif. Tujuan pengabdian ini adalah mengoptimalkan GEDSI melalui penerapan sekolah ramah anak di Sekolah Dasar. Kegiatan yang dilakukan antara lain melalui metode pelatihan (pembinaan dan pendampingan) yang dilakukan dengan strategi kronologis atau bertahap. Pelatihan dilakukan dengan pemberian materi yang dilanjutkan tanya jawab dan praktik langsung serta pembahasan hasil praktik sebagai evaluasi dan feed back. Selain itu, pelatihan dilakukan secara gratis atau tidak dipungut biaya. Hal ini dilakukan dengan tujuan agar peserta lebih tertarik dan antusias dalam mengikuti pelatihan yang diadakan. Pelatihan diberikan oleh para pengabdi yang berkompeten dengan bidang yang berkaitan dengan persoalan mitra. Hasil dari pengabdian ini antara lain peningkatan pemahaman guru dan peserta didik tentang GEDSI dan implementasi Sekolah Ramah Anak (SRA) di jenjang sekolah dasar.

Abstract

Free, Prior, and Informed Consent (FPIC) is an International legal standard that guarantees indigenous peoples' right to consent to projects affecting their territories and lives. Indonesia has not explicitly adopted this principle in its national legal system, so the management of customary forest areas. The absence of clear FPIC regulations creates legal loopholes impacting the legitimacy of business licenses and the protection of indigenous peoples' rights, which can lead to human rights violations. This study aims to analyze how FPIC is regulated and implemented in Indonesian national law, as well as assess the legal consequences of noncompliance in the context of customary forest management. Using normative legal research methods and statutory and conceptual approaches, the study concludes that disregarding FPIC not only goes against the spirit of the constitution and international commitments but also contributes to social disintegration and unequal power relations between indigenous peoples and the state. Therefore, the principle of FPIC must be explicitly recognized in national laws and regulations, and participatory, fair, and legally binding implementation mechanisms must be established to realize inclusive and ecologically just development.
