Abstract

Penulisan artikel ini bertujuan untuk mengetahui sejauh mana eksistensi pelaksanaan mediasi penal dengan pendekatan restorative justice yang merupakan cara penyelesaiaan perkara pidana dengan mengutamakan win win solution atau perdamaian antara pelaku dan korban sehingga perkara tidak harus sampai ke Persidangan. Penulisan artikel ini dituangkan dalam tulisan yang bersifat deskriptif, yaitu memberikan gambaran tentang eksistensi mediasi penal dengan pendekatan restoratif justice pada penyelesaian tindak pidanaserta untuk mendapatkan data yang diinginkan, penulis menggunakan metode pendekatan yuridis normatif dimana penulis mempelajari peraturan perundang-undangan, teori yang relevan mengenai pelaksanaan mediasi penal. Kesimpulan dari penulisan artikel ini didapatkan bahwa mediasi penal dengan pendekatan keadilan restoratif atau restorative justice memang sudah harus diupayakan pada pintu awal penyelasaian perkara pidana yakni penyidikan terutama yang sudah disebutkan pada Peraturan Kapolri Nomor 8 Tahun 2021 tentang Penanganan tindak pidana namun pada kenyataannya terkadang penyidik masih merasa takut dengan stigma masyarakat yang menganggap kalau mediasi penal dengan pendekatan restorative justice ini merupakan jalan yang haram dalam penyelesaian perkara pidana.

Abstract

Violence against children and women in Indonesia is a serious problem that reflects weaknesses in the legal protection system. Various social factors such as poverty, low education, patriarchal culture, gender inequality, and early marriage exacerbate the situation. This phenomenon demands deep reforms in policy and law enforcement to ensure protection and justice for victims. This research aims to analyze the effectiveness of the legal protection system for children and women in Indonesia, highlighting policy gaps, structural barriers, and the impact on victims. The research uses a normative-empirical method with a descriptive-qualitative approach. Data was collected through a literature review of laws and regulations, as well as analysis of other legal and non-legal documents. The results identified eight main obstacles in law enforcement, including suboptimal implementation of additional punishment, stereotyping, victim blaming, revictimization, and difficulties in presenting evidence at trial. Punishments that are still oriented towards imprisoning perpetrators and the lack of understanding of power relations among legal officers add to the complexity of the problem. In addition, victims often do not report their cases due to lack of legal support and the risk of psychological impact is not considered. Legal reform is needed to create responsive and humane protection. Improve training of law enforcement officers, provide one-stop service centers for victims, expand public awareness campaigns, and increase budget allocations to support more effective policy implementation.

Abstract

The discourse on the implementation of Islamic Criminal Law in Indonesia has been a subject of dynamic development, particularly as Islamic values gradually influence national legal frameworks. Against this background, this study aims to explore the perspectives of the Indonesian Ulama Council (MUI) in South Tapanuli regarding the application of Islamic Criminal Law and its relevance to the Islamic Criminal Law academic program. Employing a descriptive qualitative approach, the research captures and analyzes the views of MUI administrators across four regencies and one city in South Tapanuli, using interviews and documentation studies to reveal their perceptions. The findings demonstrate that although Islamic Criminal Law has not yet been fully codified into Indonesia’s positive law, it increasingly serves as a foundational reference in the evolution of the country's criminal legal system. The MUI of South Tapanuli unanimously supports the continuation and strengthening of the Islamic Criminal Law study program, emphasizing its strategic role in bridging Islamic legal principles with societal legal awareness. The study implies that academic institutions and policymakers must collaboratively promote integrative models that harmonize Islamic legal education with national legal development. The novelty of this research lies in its empirical focus on regional ulama perspectives as a grassroots reflection of the socio-legal integration process, offering a rare insight into the localized dynamics of Islamic law adaptation in Indonesia

Abstract

This study examines the sasi system as a customary legal mechanism within the community of Desa Iha, Maluku, and analyzes the nature of its violations through the lens of Islamic criminal law. Sasi is a local tradition aimed at preserving natural resources through collective prohibitions agreed upon by the community. Using a descriptive-qualitative approach, the research employed observation, in-depth interviews, and document analysis. The findings reveal that violations of sasi continue to occur, including theft, hoarding, and premature harvesting of protected crops. Customary sanctions such as fines and confiscation serve both preventive and corrective functions, aligning with the Islamic concept of ta‘zīr punishments. From the perspective of maqāṣid al-sharī‘ah, these violations may also be categorized as fasād fī al-arḍ (corruption on earth), as they damage both social order and ecological balance. Thus, integrating customary law and Islamic criminal principles presents a strategic approach to strengthening resource management systems grounded in justice and sustainability

Abstract

This study examines the application of the death penalty in Indonesia from a human rights perspective, with a focus on legal reforms introduced through Law No. 1 of 2023 on the Criminal Code, and discusses whether the introduction of a 10-year probation period as an alternative to immediate execution can effectively protect the right to life while addressing ethical and justice dilemmas. This study uses a normative legal research method with a legislative approach. Primary legal materials were obtained from Law No. 1 of 2023, the Criminal Code, and other official legal documents, while secondary materials were obtained from credible legal and non-legal books and journals. Data collection was conducted through document study, and qualitative analysis was performed using a comparative and interpretative approach. The findings show that although the trial mechanism reflects progress in aligning criminal law with human rights values, there are still significant gaps, particularly regarding the risk of judicial error and unequal access to legal representation. These issues highlight the urgent need for harmonization of regulations with international human rights instruments, strengthening of institutional capacity among legal actors, and independent oversight mechanisms. This study concludes by recommending further interdisciplinary and empirical research to support more equitable and socially responsive criminal law reform that upholds the protection of human rights.
