Abstract

The applicable law in Indonesia consists of three major legal systems, namely Islamic law, customary law and ex-Dutch colonial law. Islamic law as a legal system that still exists and is in force in Indonesia certainly has its own dynamics from the historical perspective of its implementation. Moreover, it is located between two large legal systems, namely customary law and ex-colonial law. This study attempts to analyze the history of Islamic law and the existence of Islamic law in Indonesia. The research method used is a normative legal research method with a historical approach. The use of a historical approach is because the main focus of the study is analyzing the history of Islamic law and the existence of Islamic law in Indonesia. The data used are primary legal materials and secondary legal materials. Primary legal materials are the Marriage Law, KHI, Sharia Banking Law, Religious Courts Law. The secondary legal materials used are books, journals and relevant research results. The research results show that historically Islamic law has been left behind and marginalized as a result of VOC policies which tended to elevate customary law and colonial law and emphasized Islamic law. The existence of Islamic law developed again after independence, marked by the many regulations governing Islamic law, Islamic law was even used as raw material in formulating national law in Indonesia. What's more interesting is that the majority of the raw materials used come from books written by Imam Syafi'i, such as during the formulation of the KHI. Hukum yang berlaku yang berlaku di Indonesia terdiri dari tiga sistem hukum besar, yaitu hukum Islam, hukum adat dan hukum eks kolonial Belanda. Hukum Islam sebagai salah satu sistem hukum yang masih eksis dan berlaku Indonesia tentu memiliki dinamika tersendiri dalam perspektif historis permbelakuannya. Apalagi berada di antara dua sistem hukum yang besar yakni hukum adat dan hukum eks kolonial. Kajian ini berusaha menganalisis sejarah taqnin hukum Islam dan eksistensi hukum Islam di Indonesia. Metode penelitian yang digunakan yaitu metode penelitian hukum normatif dengan pendekatan historis. Penggunaan pendekatan historis karena fokus utama kajian menganalisis sejarah taqnin hukum Islam dan eksistensi hukum Islam di Indonesia. Data yang digunakan yaitu bahan hukum primer dan bahan hukum sekunder. Bahan hukum primer yaitu UU Perkawinan, KHI, UU Perbankan Syariah, UU Peradilan Agama. Bahan hukum sekunder yang digunakan yaitu buku, jurnal dan hasil penelitian yang relevan. Hasil penelitian menunjukkan bahwa secara historis hukum Islam memang mengalami ketertinggalan dan terpinggirkan akibat dari kebijakan VOC yang cenderung mengangkat hukum adat dan hukum kolonial serta menekankan hukum Islam. Eksistensi hukum Islam kembali berkembang pasca kemerdekaan yang ditandai dengan banyaknya regulasi yang mengatur tentang hukum Islam, bahkan hukum Islam dijadikan sebagai bahan baku dalam memformulasikan hukum Nasional di Indonesia. Hal menariknya lagi, mayoritas bahan baku yang digunakan berasal dari kitab karangan Imam Syafi’i seperti pada saat perumusan KHI.

Abstract

The philosophy of language is an intricate and expansive field that defies narrow definitions due to its deep entrenchment within the broader framework of philosophical inquiry. Its scope extends across nearly every domain of knowledge, making it a foundational yet complex subject of study. This article addresses the essential nature of language by treating it as a central object of philosophical investigation. The primary research question posed is: "What is the philosophical nature of language when approached as an autonomous object of inquiry?" Using a conceptual and descriptive-analytical method, the study examines language's ontological and epistemological dimensions. The findings suggest that language in philosophy is not merely a medium of communication but a constitutive element of thought, meaning, and reality construction. This aligns with other branches of philosophy—such as the philosophy of law, nature, human existence, and society—which similarly treat their core concepts as independent objects of scrutiny. The article concludes that the philosophy of language offers a distinctive yet integrative lens for understanding human cognition, knowledge systems, and cultural structures.

Abstract

This study examines the ijtihad (independent reasoning) undertaken by female judges in the Sharia Court when imposing sentences on perpetrators of child sexual abuse. It highlights the variations in the judges’ verdicts, which include punishments such as caning and imprisonment, as well as sentences that differ—either higher or lower—from the demands of the Public Prosecutor. This study utilized an empirical juridical method, combining statutory analysis with the maqashid al-sharia (objectives of Islamic law) approach. Data were gathered through interviews with female judges and a review of judicial decisions, journal articles, books, research reports, and legal regulations. The findings reveal that female judges’ ijtihad in sentencing child sexual abusers has been driven by trial evidence and the best interests of the child. The judges typically approve of imprisonment as a means of limiting contact between the perpetrator and the victim, in order to safeguard the child from further trauma. Within the framework of maqashid al-sharia, the verdicts of these female judges have been in line with the principles of protecting the interests and security of the child, as the main objective of Islamic law.  This study suggests that courts review the caning rules in the Qanun Jinayat and consistently prioritize the child’s best interests while imposing penalties.

Abstract

This research aims to optimize the learning environment in Indonesian language subjects at student through the implementation of a positive culture in the form of "Class Agreement". The problems faced during the previous learning process were low student participation, lack of positive interaction between students, and disorder in class which hampered the effectiveness of learning. To overcome this, teachers implement a class agreement approach by involving students in formulating mutually agreed class rules in order to create a more conducive and supportive learning atmosphere. The methods used in implementing class agreements include group discussions, drafting joint rules, and periodic evaluation of the implementation of the agreement. The results of implementing this positive culture show an increase in active student participation, the creation of more harmonious relationships between students, and the creation of a classroom environment that is more disciplined and conducive to learning. In addition, Indonesian language learning becomes more effective with increased student involvement in discussions, group assignments and other learning activities. The implementation of class agreements has proven successful in improving the quality of learning and creating a more positive learning environment

Abstract

Forced child marriage is a form of punishment following the enactment of Law Number 12 of 2022 concerning the Crime of Sexual Violence. The presence of this law has given a new nuance to changes in marriage law in Indonesia. This research aims to analyze the existence of Islamic marriage law reform in Indonesia through the prosecution of perpetrators of forced child marriages and the juridical implications for mujbir guardians in marriage. This research uses a type of normative legal research because the author analyzes the legal norms contained in the TPKS Law in the context of reforming Islamic family law and the juridical implications of the existence of this Law on the authority of mujbir guardians in marrying off children. Data was obtained by studying literature, materials in libraries, journals and research results. The primary legal materials used consist of the TPKS Law, the Marriage Law. Secondary legal materials are books, journals and research results, while tertiary legal materials are legal dictionaries and Islamic law encyclopedias. The research results show that the presence of the TPKS Law is a concrete answer to the problems faced by children, especially forced marriages that occur in society. The determination of punishment in cases of forced marriage is a form of ta'zir punishment and can be justified in Islamic teachings with the aim of realizing the benefit of children and ensuring the realization of maqashid syari'ah. The presence of the TPKS Law has contributed to efforts to reform Islamic family law. Guardians who force child marriages can be subject to imprisonment. The juridical implication for mujbir guardians is that they cannot marry off their underage daughters without the consent of the daughter being married.  Pemaksaan perkawinan anak merupakan bentuk pemidanaan pasca lahirnya UU Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual. Hadirnya UU tersebut telah memberikan nuansa baru terhadap perubahan hukum perkawinan di Indonesia. Penelitian ini bertujuan untuk menganalisis eksistensi pembaharuan hukum perkawinan Islam di Indonesia melalui pemidaan terhadap Pelaku pemaksaan perkawinan anak dan implikasi yuridis terhadap wali mujbir dalam perkawinan. Penelitian ini menggunakan jenis penelitian hukum normatif karena penulis menganalisis norma hukum yang terdapat dalam UU TPKS dalam konteks pembaharuan hukum keluarga Islam dan implikasi yuridis keberadaan UU tersebut terhadap kewenangan wali mujbir dalam menikahkan anak. data diperoleh dengan cara studi literatur bahan di perpustakaan, jurnal dan hasil penelitian. Bahan hukum primer yang digunakan terdiri dari UU TPKS, UU Perkawinan. Bahan hukum sekunder yaitu buku, jurnal dan hasil penelitian, sedangkan bahan hukum tersier yaitu kamus hukum dan ensiklopedia hukum Islam. Hasil penelitian menunjukkan bahwa hadirnya UU TPKS merupakan jawaban konkrit terhadap permasalahan yang dihadapi oleh anak khususnya pemaksaan perkawinan yang terjadi di tengah-tengah masyarakat. Penetapan hukuman pada kasus pemaksaan perkawinan merupakan bentuk hukuman ta’zir dan dapat dibenarkan dalam ajaran Islam dengan tujuan untuk mewujudkan kemaslahatan bagi anak serta menjamin terwujudnya maqashid syari’ah. Hadirnya UU TPKS telah berkontribusi dalam upaya pembaharuan hukum keluarga Islam. wali yang memaksakan perkawinan anak dapat dikenakan dengan hukuman penjara. Implikasi yuridis bagi wali mujbir yaitu tidak dapat menikahkan anak perempuannya yang masih di bawah umur tanpa persetujuan dari anak perempuan yang dinikahkan.
