Abstract

Penelitian ini bertujuan untuk menganalisis secara yuridis normatif kedudukan Ibu Kota Negara (IKN) Nusantara dalam perspektif sistem ketatanegaraan Indonesia. Metodologi yang digunakan adalah analisis hukum normatif dengan menggunakan analisis konseptual dan UUD, serta analisis hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa secara formal, pemindahan ibu kota negara memiliki dasar hukum yang sah berdasarkan pada Undang-Undang Nomor 3 Tahun 2022 dan tidak bertentangan dengan Undang-Undang Nomor 3 Republik Indonesia Tahun 1945. Namun, secara substansial, terdapat implikasi terhadap prinsip-prinsip konstitusional, khususnya terkait dengan desentralisasi, demokrasi, dan pembagian kekuasaan. Kedudukan Otorita IKN yang berada di bawah Presiden mencerminkan model pemerintahan yang cenderung sentralistik dan berbeda dari mekanisme pemerintahan daerah pada umumnya. Penelitian ini menyimpulkan bahwa meskipun kebijakan pemindahan ibu kota negara memiliki legitimasi hukum, diperlukan penguatan aspek demokrasi, transparansi, dan akuntabilitas dalam implementasinya. Penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan ilmu hukum tata negara serta menjadi bahan pertimbangan dalam perumusan kebijakan yang lebih sesuai dengan prinsip konstitusional.

Abstract

Social media has become a primary tool for election campaigns in Indonesia, but it has also fueled the rise of hate speech practices that have the potential to disrupt democracy and social stability. This study aims to analyze the implementation of law enforcement against hate speech through social media in election campaign activities within the jurisdiction of the Central Kalimantan Regional Police and to identify the obstacles faced by law enforcement officers. The research method used is empirical juridical with a descriptive approach through literature studies and interviews with the Central Kalimantan Regional Police. The results of the study indicate that the implementation of law enforcement against hate speech through social media in election campaign activities within the jurisdiction of the Central Kalimantan Regional Police is carried out through three main approaches: preventive, pre-emptive, and repressive. Preventive efforts are carried out through legal socialization, digital literacy education, and cyber patrols. Pre-emptive efforts are carried out through early detection of potential violations and coordination with Bawaslu, KPU, and Kominfo. Meanwhile, repressive efforts are carried out through investigations, inquiries, and prosecutions based on the law. However, this implementation is less effective and still faces several obstacles. Preventive efforts face challenges such as weak outreach and early monitoring, preemptive efforts face challenges such as a lack of early detection and a structured persuasive approach, and repressive efforts face challenges such as technical digital evidence and inconsistent law enforcement. These challenges indicate that the Central Kalimantan Regional Police (Polda Kalteng) still faces several shortcomings in handling hate speech cases on social media during election campaigns. These challenges stem from unclear and overlapping regulations between election criminal provisions, the Electronic Information and Transactions Law, and technical regulations governing election organizers, leading to differing interpretations among law enforcement agencies. Therefore, it is necessary to strengthen inter-agency coordination and increase the capacity of law enforcement officers to handle hate speech cases during election campaigns so that they can be implemented effectively and fairly.

Abstract

This article analyzes the juridical management of the customary territory and customary forest of Lewu Tehang within the framework of the customary law of the Dayak Ngaju Lewu Tehang. This research was researched with empirical juridical and normative juridical research methods aimed at uncovering the alignment between the norms of Dayak customary law ngaju lewu tehang and national regulations, including the recognition of indigenous peoples' rights to customary forests. Based on Article 18B paragraph (2) of the 1945 Constitution: the Indonesian state recognizes and respects the unity and unity of customary law communities and their rights as long as they are alive and in accordance with the development of society and the principles of the Republic of Indonesia. Based on this Law, the unitary state of the Republic of Indonesia recognizes and protects the existence of customary law communities, so with Law no. 6 of 2014 concerning villages and the decision of the Minister of Environment and Forestry of the Republic of Indonesia. That after there is a recognition from the Regent of Gunung Mas regarding the protection and recognition of Indigenous peoples, it is necessary to make regulations on the management of customary territories; The rules of Lewu Tehang customary rules so far have only been oral, so it needs to be made in writing, to be a guideline for the customary law community and other related parties; Customary territories need to be managed for the welfare of customary law communities, which are sustainable
