Abstract

This paper aims to describe the supervision of the Central Kalimantan regional head election during the pandemic. The problem is focused on how the description of election supervision by Election Supervisory Agency? and what constraint are faced and their solutions in the context of local wisdom?. The research type is descriptive qualitative. Data Collecting through interviews, observation, and literature study. The data obtained were analyzed descriptively using the Mile and Huberman model. This study shows several things: First, the implementation of supervision is more on tasks outside the crucial task of Bawaslu, namely the supervision of the pandemic health protocols as an additional task burden. Second, the obstacles faced by Bawaslu starting from the preparation, voting, and post-voting. Namely: Updating and determining the voter list was constrained by the Work From Home and Large-Scale Social Restrictions policies; Procurement and distribution of logistics whose suppliers had not yet recovered from the impact of the pandemic; Some officials were reluctant and resigned because of the rapid test rules; distorted ballot papers; The officers' lack of compliance with the working mechanism that had been determined. Third, The context of local wisdom in the supervision of Pilkada in Central Kalimantan, namely: Balanga, Huma Betang, Ma'mapas Lewu, Isen mulang, and Dayak Greetings: Tabe salamat lingu nalatai, Salam Sujud Karendem malempang, Adil ka’ Talino bacura’mi ka’ Saruga, Basengat kajubata.

Abstract

Kewenangan dari Mahkamah Konstitusi Republik Indonesia berdasarkan UUD NKRI Tahun 1945 serta Undang-Undang Mahkamah Konstitusi antara lain memutus perselisihan tentang hasil pemilihan umum termasuk didalamnya adalah perselisihan hasil pemilihan kepala daerah. Adapun yang dimaksud dengan perselisihan hasil adalah perselisihan terkait dengan hasil penghitungan suara pasca/setelah pemilihan. Mahkamah berpendapat bahwa tidak boleh ada pihak yang diuntungkan dalam perolehan suara akibat terjadinya pelanggaran konstitusi dan prinsip keadilan dalam penyelengaraan Pemilu termasuk Pemilukada, yang harus dilakukan secara demokratis dan tidak melanggar asas-asas pemilihan umum yaitu langsung, umum, bebas, rahasia, jujur dan adil. Penyelesaian sengketa PHPUKada yang dilakukan oleh Mahkamah Konstitusi merupakan suatu solusi yang dianggap mampu menyelesaikan persoalan hasil pemilihan umum dan pemilihan umum kepala daerah, mengingat persoalan sengketa PHPU merupakan salah satu kewenangan yang dimiliki oleh Mahkamah Konstitusi sebagaimana diatur dalam UUD NKRI Pasal 24 C serta pada Undang-Undang Mahkamah Konstitusi. Metode yang digunakan adalah metode penelitan yuridis normatif. Tujuan dari penelitian ini adalah mengetahui kewenangan Mahkamah Konstitusi dalam memutuskan perselisihan hasil Pemilihan Umum Kepala Daerah dalam perspektif hukum progresif. Progresifnya tindakan Mahkamah Konstitusi dinilai sebagai sebuah terobosan baru yang sangat positif dalam perkembangan sistem hukum di Indonesia untuk menangkis anggapan yang selama ini bahwa hakim hanyalah dianggap sebagai corong undang-undang.

Abstract

Plurality is a social fact that cannot be avoided in Indonesia. The diversity of Indonesian people's tribes, religions, races, languages ??and religions shows their diversity. The founders of the Republic of Indonesia used the basic philosophy of "unity in diversity" to show the diverse social reality of the Indonesian nation, and the basic philosophy of "tunggal ika" to show the desire to unite the entire Indonesian nation into one. With the combination of the two, the philosophical motto of the Indonesian nation is "Unity in Diversity", which means unity in diversity. Apart from various different societal systems and structures, this community has unique norms that are considered customs and are adhered to by its community members. Customary law communities are genealogical or territorial communities that are prosperous and have citizens who are different from members of other legal communities and can act as independent and independent legal subjects. One of the problems in administering customary law communities is the existence of customary institutions. The problem currently occurring is that there is no clear and integrated mechanism for recognition and protection procedures. Regulations regarding procedural mechanisms for recognizing the rights of customary law communities through sectoral legislation are often not adhered to by various parties, in fact the nature of the regulations which do not focus on specifically regulating customary law community institutions has an impact on ineffective implementation even though customary institutions have relevance to the Indonesian constitution. The existing mechanism only concerns the process of identification, verification and determining its existence, which makes it increasingly pressured by development activities that do not pay attention to traditional rights and threaten local wisdom.

Abstract

This study purpose to analyze a decision made by Constitutional Court Number 70/PUU-XXII/2024 and the decision made by Supreme Court Number 23 P/HUM/2024  Relate to the age limit for a region head candidates. In the context of the hierarchy of norms in Indonesia, the dualism of authority to examine laws and regulations by the Supreme Court and the Constitutional Court often leads to conflicts of substance. The study used in this research is a type of normative juridical research method by approaching the law and case studies to assess whether there is a conflict of norms and legal vacuum. The results show that there are differences in interpretation between the two institutions regarding the minimum age of candidates for regional heads, which has an impact on legal uncertainty. To overcome this problem, it is necessary to reform the mechanism for testing statutory instruments, including the proposal for a single test at the Constitutional Court or the addition of norms to the Supreme Court Law regarding the validity of decisions in the event of changes in statutory norms. Research with the title analysis of this is expected to be a contribution to the optimization of the legal system in Indonesia.

Abstract

Constitutional Court Decision No. 68/PUU-XII/2014 is an important milestone in the legal debate regarding the validity of interfaith marriages in Indonesia. Although the decision does not change the normative provisions in Article 2 paragraph (1) of Law No. 1/1974 on Marriage, the implications for the position of children from interfaith marriages are very real. Children born from such relationships often face administrative obstacles, uncertainty of legal status, and potential discrimination in obtaining their basic rights as citizens. This study aims to analyze the juridical implications of the Constitutional Court's decision on the legal protection of children from interfaith marriages, and to encourage the formulation of affirmative policies that guarantee the protection of children's rights as a whole. The research method used is normative juridical with the approach of legislation and analysis of court decisions. The results of the study show that derivative regulations and concrete steps are needed from the state to ensure recognition of the legal status of children, in line with the constitutional principles of child protection and respect for human rights.

Abstract

Ketidakteraturan rute dan jam operasional keluar masuk kendaraan angkutan barang dalam beroperasi di jalan raya dapat membahayakan keselamatan pengendara lain dan dapat menimbulkan kepadatan yang menggangu aktivitas masyarakat pada rute dan jam sibuk di Kota Palangka Raya. Untuk mengatasi masalah tersebut, Pemerintah Kota Palangka Raya menerbitkan Peraturan Walikota Palangka Raya Nomor 10 Tahun 2023 tentang Pengaturan Rute dan Jam Operasional Keluar Masuk Kendaraan Angkutan Barang di Kota Palangka Raya. Penelitian ini bertujuan untuk menggali pemahaman tentang penerapan kebijakan tersebut serta memahami hambatan pelaksanaannya. Dengan metode yuridis empiris melalui observasi, wawancara, dan analisis data media online, ditemukan bahwa implementasi peraturan ini belum sepenuhnya efektif karena kurangnya koordinasi antar instansi terkait, minimnya sosialisasi, dan keterbatasan sumber daya manusia. Untuk sementara, Dinas Perhubungan Kota Palangka Raya melakukan inovasi "Sistem Layanan Citra Perhubungan”. Namun, inovasi ini hanya merupakan solusi jangka pendek. Penelitian ini merekomendasikan pembentukan tim koordinasi lintas sektor untuk mempercepat implementasi yang lebih berkelanjutan.
