Abstract

This article discusses the concept of reintegration in the implementation maqashid sharia of the customary law: Adat Basandi Syara', Syara' basandi Kitabullah (ABSSBK) in Minangkabau cultural region. This paper provides a scientific answer, how it should be, in practice, maqashid sharia as an integral part in ABSSBK. To collect, to analyze, and to interpret the data comparative literature was used. The basic values were compared with the concept of maqashid sharia ABSSBK. The result showed that the terms of syara’ found in the philosophy of ABSSBK have the similar characteristics to maqashid sharia, yet the device has not formulated detailed practicesl. The implications and significance showed clear link between the value (axiology) syara and maqashid sharia. Therefore, maqashid sharia can be referred in establishing ABSSBK as a basis of thought, movement and arbitration of nation-state.

Abstract

This article discusses the dynamics of purification and syncretization of the tradition of burning incense and balimau in the Minangkabau community. The aim is to explain how the dialogic-wise pattern of da'wah is against local traditions or wisdom. The method used is critical discourse analysis of the dominance of purification and syncretization discourses in da'wah. The temporary conclusion is that the pattern of preaching which should be dialogic-wise is still interpreted as a stage of purification of practices that are claimed to be syncretic. The implication is that dialogic-wise preaching becomes one of the da'wah patterns that can be mainstreamed in understanding the plurality of cultures and traditions.

Abstract

Pengantar buku Menjinakkan Islam, Strategi Politik Orde Baru ini ditulis oleh Fadlizon, WakilKetua DPR RI (2014-2015), bertajuk Kekuatan Islam Politik dalam Pentas Demokrasi. Fadlizonmengemukakan kilasan sejarah Islam dan umat Islam dalam tradisi politik di Indonesia. Sebagaikelompok mayoritas dalam populasi, umat Islam Indonesia sangat berpengaruh terhadap arahpembangunan demokrasi. Meskipun demikian, dalam perjalananannya Islam Politik di Indonesiatelah mengalami pasang surut, terutama dalam hubungannya dengan rezim yang tengah berkuasa.

Abstract

Abstract

The living fiqh is derived from the living al-Quran and the living al-Hadith. It requires refining its formulation and methodological model as a contemporary socio-anthropological approach to fiqh. This article discusses the formulation of the concept of the living fiqh both deductively and inductively-abductively. The aim is to formulate and present this conception as a new approach or model of study and evaluation of fiqh practice in the contemporary era. The method used is abductive construction based on integrating fiqh into the behavior of its participants in various cultural clusters of Islamic society. The result found in this research is the formulation of the concept of The Living Fiqh as an explanation for society's acceptance of fiqh not only as knowledge but also as a practical guide in their lives. The implication is the availability of a sociological framework of fiqh that can explain the integration of fiqh in the daily life of Muslim communities spread across various models of cultural practices.

Abstract

: Qurbani is perceived to be performed by people who have a lot of money, but in practice, financial capability is not the main reason why people perform qurbani. This article discusses what factors are the segmentation and motivation for performing qurbani and divides them into several reasons for qurbani participants based on age, gender, economic level, and education level. Furthermore, the segmentation of qurbani participants that has been determined is analyzed from the perspective of legal awareness, which is an indicator of the level of knowledge, understanding, attitude, and behavior. The purpose of the descriptive description of the segmentation and legal awareness of qurbani performers is to reveal the motivation of qurbani performers based on the experience of the people of West Sumatra. The method used is a mixed method (mix method), namely a qualitative-descriptive approach and a quantitative approach. The quantitative approach will measure the percentage based on the segmentation of qurbani participants, namely based on age, gender, education, and region The qualitative approach was used to analyze the qurbani participants' motivation, religious level, and legal awareness. The results showed that the segmentation of qurbani participants from the middle class is higher, as many as 42% of the total qurbani participants. The dominance of West Sumatran people's motivation for qurbani is influenced by the level of religiosity fostered through religious teachings and Ulama fatwas, while economic motivation is only one of the supporting factors, because materially, even though the community does not have economic stability, they are still enthusiastic about becoming qurbani participants with motivations based on the pattern of preparing qurbani costs and the preparation period. Furthermore, it was concluded that qurbani participants in West Sumatra have high legal awareness, this can be seen in the high level of understanding and knowledge of the qurbani law, as well as positive attitudes driven by religiosity, which strengthens social solidarity and community unity. This research implies that the participation, segmentation, and motivation of qurbani performers are not solely related to economic security, but rather to high levels of religiosity and legal awareness.

Abstract

Tuanku in Minangkabau culture is a reflection of how these institutions are involved in the nation-state political process and religious mission. This article describes his involvement in the endless identity friction between state, religious and adat actors. Data were collected using a social network analysis method that highlights Tuanku's identity through a genealogical approach. In addition, interviews were optimized to confirm prior critical sociological research. The formulation of al-'urf is also used to interpret the crossing of normative and cultural texts. The results of this study indicate that Tuanku's involvement in Minangkabau largely determines the quality of the success of the state and religion in realizing their political and missionary strength. The implication is to recognize important points that are known in the friction of these three elements of identity, so that they can be useful for the development of knowledge in the field of Islamic law and social science.

Abstract

This article explores the issue of ethnographic-based interlegality of living fiqh in Minangkabau marriage practices. The purpose is to explain the uniqueness of negotiation and the embodiment of Islamic jurisprudence within Minangkabau socio-cultural settings. This study emphasizes the cognitive biases of the dichotomy between local-global, peripheral-central, and traditional-modern. The data examined came from the experience of the Minangkabau community in internalizing Islamic marriage law as a living legal practice, ranging from the marriage procedure, marriage contract, walimah, mediation, to divorce. This research collected, analyzed, and interpreted empirical legal data that reveals the integration of Islamic, customary and state legal norms in marriage practice. The findings of this study show the existence of a legal tripartite legal construction: first, the practice of customary marriage formed by Islamic jurisprudence. Second, the awareness of Islamic law is influenced by customary law. Third, the regulatory intervention of the state that wants the formation of harmonization between customs and Islam. This study has implications for living fiqh literacy which shows the universal principles of sharia law in cross-cultural life.
