Abstract

This article investigates an involvement of the government of the Municipaltiy of Padang in West Sumatra in managing zakat institution, namely BAZDA (Badan Amil Zakat Daerah). It argues that the intentions of the mayor in managing the zakat institution aimed to provide an alternative financial source in order to support his position at the mayor. Zakat payers (Muzakki), collector (ʿamil), kinds of property obligated to pay its zakat (māl) and recipients (mustaḥiq) are mainly the matters that link to his authority. The zakat revenue initially was mainly distributed to recipients in form of charity, but since 2010 it has gradually shifted to financialize busninesse run by the poor and needy. The mayor received resistances from many people, but they are mainly in form of individual resistance that are lacking to force the mayor to change his policy. In addition, the emerging resistance is rooted in different values between the mayor and resisters.

Abstract

The study of traditional Minangkabau society has stimulated a considerable amount of work on the nature of social change in West Sumatra. In Minangkabau one of the central themes of its intellectual history is the search for the formulation of the relationship between adat and Islam. As a result, some scholarly debated has concentrated on how a matrilineal society, such as Minangkabau, can become one of the most thoroughly Islamized ethnic groups. Abstract

This article covers the efforts being made by two regions of Indonesia to implement Islamic law, that is, Aceh and West Sumatra. As one of the Special Autonomous Regions in Indonesia, Aceh has far greater freedom and authority to make its own rules and regulations, which includes the use of Islamic law as the rule of law in the area. In order to achieve this objective, the government of Aceh has introduced a regulation regarding the implementation of Islamic law and is quite extensive in that it covers aqidah (Islamic beliefs), ibadah (matters of worship), muamalah (dealings between people), akhlak (character), pendidikan (education), dakwah, baitul mal (the treasury), kemasyarakatan (social matters), syiar Islam (Islamic propogation), pembelaan Islam (defending Islam), peradilan (judicature), jinayat, munakahat (marriage) and waris (inheritance). This means that Islamic law should in theory govern almost all aspects of Islamic law and daily life.DOI: 10.15408/sdi.v13i3.560

Abstract

This article will discuss the impact of implementation of Sharia law in Aceh to other provinces in Indonesia, including West Sumatera. Considering the development of various regional regulations in West Sumatra, there are some things that need to be noted. First, the desire to make regional regulations consuisting sharia is more dominated by the desires of certain political parties. It is not supported by other government agencies in the form of existing local regulation follow-up even though the political party always claims that the regulation is the desire of the wider community. Consequently, it is difficult to reject the impression that the presence of these regulations is solely for the political interests of parties, or the interests of heads of government. Second, the emergence of these regulations is highly determined by the figures driving the emergence of these regulations. So, when they are no longer in their positions, then the attention to the implementation of these regulations is reduced or nonexistent. Third, there are differences of opinion or understanding among regional leaders that overcoming the problem of poverty, problems in education and the economy is far more important than just making sharia regulations. As a result of the accumulation of these three things, the momentum of the emergence of the need for sharia regulations often appears and then disappears and then reappears following certain events in the community; like in the month of Ramadan or other Islamic celebrations. Abstrak: Artikel ini akan membahas dampak penerapan syariat Islam di Aceh terhadap provinsi lain di Indonesia, termasuk Sumatera Barat. Melihat perkembangan berbagai peraturan daerah di Sumatera Barat, ada beberapa hal yang perlu diperhatikan. Pertama, keinginan untuk membuat peraturan daerah yang menganut syariah lebih didominasi oleh keinginan partai politik tertentu. Hal tersebut tidak didukung oleh instansi pemerintah lainnya berupa tindak lanjut perda yang ada, meskipun partai politik selalu mengklaim bahwa perda tersebut merupakan keinginan masyarakat luas. Akibatnya, sulit untuk menolak kesan bahwa kehadiran peraturan tersebut semata-mata untuk kepentingan politik partai, atau kepentingan kepala pemerintahan. Kedua, munculnya peraturan-peraturan tersebut sangat ditentukan oleh tokoh-tokoh pendorong munculnya peraturan-peraturan tersebut. Jadi, ketika mereka tidak lagi pada posisinya, maka perhatian terhadap pelaksanaan peraturan tersebut berkurang atau tidak ada. Ketiga, adanya perbedaan pendapat atau pemahaman di antara para pemimpin daerah bahwa mengatasi masalah kemiskinan, masalah pendidikan dan ekonomi jauh lebih penting daripada hanya membuat peraturan syariah. Akibat akumulasi dari ketiga hal tersebut, momentum munculnya kebutuhan akan peraturan syariah seringkali muncul, kemudian menghilang dan kemudian muncul kembali mengikuti peristiwa-peristiwa tertentu di masyarakat; seperti di bulan Ramadhan atau perayaan Islam lainnya. Abstract

The article unravels the roles of buyas (charismatic scholar of the community) in coping with confidence issues amongst politicians who competed in the Limapuluh Kota Regency’ 2015 Regional Election in West Sumatra. The study aims to answer the following questions: first, what are the politicians’ motives to seek audience from the buya? Second, what are rituals and statements that the buya provide? As part of a qualitative research conducted within the Regency, the data were collected through in-depth interviews to four buyas and four candidates. The interview results were then analyzed through qualitative approaches. The result of the study indicates that politicians and their canvassers performed ‘political safari’ by visiting buyas upon becoming candidate hopefuls or being pronounced candidates by the Election Committee. It is worth noting that although buyas never rejected any politician or canvasser who wished to meet them, they were never involved in direct campaigns with the candidates or canvassers. In essence, buyas provide politicians a sense of legitimacy at a time when they are losing confidence in themselves. Eventually, as in all political competitions, there will always be victors and losers.

Abstract

Permasalahan dalam penelitian ini adalah: (1) Bagaimana kedudukan harta bawaan suami atau isteri yang telah meninggal dunia di Kecamatan Pariaman Utara, (2) Bagaimana praktik pembagian kewarisan harta bawaan suami atau isteri yang telah meninggal dunia di Kecamatan Pariaman Utara, dan (3) Bagaimana pandangan hukum Islam mengenai praktik pembagian kewarisan harta bawaan suami atau isteri yang telah meninggal dunia di Kecamatan Pariaman Utara. Adapun tujuan dalam penelitian ini adalah: (1) Untuk mengetahui bagaimana kedudukan harta bawaan suami atau isteri yang telah meninggal dunia di Kecamatan Pariaman Utara, (2) Untuk mengetahui praktik pembagian kewarisan harta bawaan suami atau isteri yang telah meninggal dunia di Kecamatan Pariaman Utara, (3) Untuk mengetahui pandangan hukum Islam mengenai praktik pembagian kewarisan harta bawaan suami atau isteri yang telah meninggal dunia di Kecamatan Pariaman Utara. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian Kualitatif, dengan jenis penelitian Antropologi Hukum, dengan menggunakan Analisis Komparatif. Hasil penelitian ini mengungkapkan bahwa: (1) Kedudukan harta bawaan suami atau isteri yang telah meninggal dunia, para Ninik Mamak di Kec. Pariaman Utara Kota Pariaman sepakat, bahwa harta bawaan suami atau isteri yang meninggal dunia merupakan milik pribadi si mayit dan milik sanak family keluarga si mayit, (2) Praktik pembagian kewarisan harta bawaan suami atau isteri yang meninggal dunia di Kecamatan Pariaman Utara menjelaskan, ayah atau ibu dari suami atau isteri yang meninggal dunia mendapatkan 2/3 bagian dari harta yang ditinggalkan, jika meninggalkan anak (cucu). Namun, apabila si mayit tidak meninggalkan anak, maka seluruh harta bawaan si mayit dikembalikan kepada lambung suami atau isteri yang telah meninggal dunia, dari pihak ibu. Apabila si mayit memiliki kakak, adik atau kemenakan, mereka bisa mendapatkan harta bawaan si mayit 1/6, ¼, atau 1/3, sebagai “baso basi atau “raso dan pareso” dari ayah atau ibu si mayit. Tujuannya, agar tidak ada terjadi penuntut nantinya atau perkelahian antar keluarga si mayit. (3) Menurut hukum kewarisan Islam yang sebagaimana huruf ” م “ yang terdapat di dalam surat an-Nisa’ ayat 7 makna (مِّمَّا تَرَكَ) mengandung arti “apa-apa” yang juga masih bersifat umum dan mencakup semua harta yang ditinggalkan oleh seseorang yang meninggal dunia, miskipun harta itu merupakan harta bawaan suami atau isteri. Sebab hukum Islam tidak mengenal adanya harta bawaan suami atau isteri, karena setiap harta yang ditinggalkan oleh si mayit merupakan harta warisan tanpa harus dipandang dari mana sumber harta itu berasal

Abstract

The living fiqh is derived from the living al-Quran and the living al-Hadith. It requires refining its formulation and methodological model as a contemporary socio-anthropological approach to fiqh. This article discusses the formulation of the concept of the living fiqh both deductively and inductively-abductively. The aim is to formulate and present this conception as a new approach or model of study and evaluation of fiqh practice in the contemporary era. The method used is abductive construction based on integrating fiqh into the behavior of its participants in various cultural clusters of Islamic society. The result found in this research is the formulation of the concept of The Living Fiqh as an explanation for society's acceptance of fiqh not only as knowledge but also as a practical guide in their lives. The implication is the availability of a sociological framework of fiqh that can explain the integration of fiqh in the daily life of Muslim communities spread across various models of cultural practices.

Abstract

The supremacy of fiqh in Indonesian, and Southeast Asian, Islam has been widely acclaimed; the subject concerning the affairs of daily life, the core substance of fiqh, has its fertile grounds in Muslims religious ideas and practices. This article presents a historical analysis how the fiqh became popular in the region, which can be traced back to the 19th century. Taking Malay kitab jawi as the main subject of discussion, the shifting of religious concerns among the ‘ulamā’ (Muslim scholars) was of crucial significance. They increasingly engaged in dealing with the Muslims’ need of guidance in primarily prescriptions for worship (‘ubūdiyah). This study traces the historical aspect in the spread of the Shafii school, along with the development of the Malay textual tradition.  As a result, kitab jawi on fiqh by Southeast Asian ‘ulamā’ grew considerably, in both number and religious authority, in line with the rise of learning institutions (pondok), leading the subject to appear as religiously essential to be produced, and reproduced, to become an established school for Muslims of the region.

The research objective in this study is to look at community customs in maintaining the baralek tradition so that the implementation of baralek is used as a condition for marriage contracts in the Sungai Nanam community, Lembah Gumanti District, Solok Regency. Formulation of the problem of how the baralek process is carried out and looking at the necessity of baralek and looking at the impact of Islamic law on the necessity of baralek in the Sungai Nanam community, Lembah Gumanti District, Solok Regency. Type of field research (field research. Data collection techniques through observation, interviews and documentation. The results of this research are: first, the procession for implementing the baralek obligation in the Sungai Nanam community was initially carried out with manyilau, after that the procession of proposing marriage, mahanta siriah, balatak tando, new marriage contract Entering the baralek procession, the factors that require the implementation of baralek are customs, social status, economics and education. According to traditional Islamic law, the requirement to carry out baralek as a condition of the marriage contract in the Nanam River community is included in the category that is more detrimental because after the implementation of baralek there is a debt that must be incurred. paid by the family and the bride and groom can be classified as 'urf-fasid if it is done excessively.
