Haryono No. 169 Malang e-mail: abiyyucuppy@gmail.com Abstrak Penelitian ini membahas standar kompensasi yang sesuai bagi gugatan non-expropriation dalam penyelesaian sengketa investasi internasional. Hal ini didasari karena adanya kekosongan hukum terkait standar kompensasi yang sesuai untuk pelanggaran non-expropriation, contohnya seperti pelanggaran prinsip fair and equitable treatment. Penelitian ini dilakuikan dengan metode penelitian yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Dari hasil penelitian yang dilakukan dengan metode diatas, penulis mendapati bahwa standar kompensasi yang sesuai atas pelanggaran non-expropriation tergantung kepada kategori kasusnya. Jika tribunal menemukan adanya pelanggaran non-expropriation sekaligus expropriation, maka standar kompensasinya diunifikasi pada expropriation yang umumnya menggunakan valuasi fair market value sebelum asset diambilalih negara host-state. Jika tribunal menemukan hanya terjadi pelanggaran non-expropriation saja, maka dilihat kadar kerugian yang dialami investor. Jika asset investor mengalami depresiasi massif atau kerugian jangka panjang, maka penyelesaian kompensasinya dianggap sama dengan expropriation yang umumnya menggunakan valuasi fair market value sebelum terjadi pelanggaran. Jika asset investor mengalami kerugian namun masih dapat beroperasi untuk menghasilkan keuntungan, maka kompensasinya menggunakan effective causality atau sejumlah dampak kerugian yang dihasilkan dari pelanggaran non-expropriation. Kata Kunci: standar kompensasi, non-expropriation, arbitrase investasi internasional Abstract This research studies the standard of compensation given over non-expropriation claims in international investment dispute resolution. This issue departs from a legal loophole regarding the standard of the compensation suitable to non-expropriation as in fair and equitable treatment. This research employed a normative-juridical method and statutory, conceptual, and case approaches. The research result reveals that the standard of compensation over non-expropriation violations will depend on the case categories. If the tribunal finds non-expropriation and expropriation violations, the standard of the compensation will be unified into the expropriation commonly referring to fair market value before the asset concerned is taken over by the host state. On the contrary, if the tribunal concerned only finds non-expropriation, it then will take into account how much loss investors have to bear. If the asset of an investor experiences massive depreciation or it involves long-term loss, the resolution of the compensation is deemed to be equal to the expropriation which usually refers to fair market value as the valuation before a violation takes place. If the asset owned by an investor faces a loss but it still operates and can provide profit, it then must refer to the effective causality regarding the loss raised by non-expropriation violations.
