Abstract

Decision of Criminal Act of Corruption Court at the IA Jayapura District Court Number 05/Pid.Sus-TPK/2015/PN.Jap, and (2) Decision Number 06/ Pid.Sus-TPK/2015/PN.Jap. Both decisions show the application of participated doctrine, both in the indictment, the prosecution of the prosecutor, and the basis of the judges judgment to result the decisions to the offenders. There are 2 (two) findings to be disclosed in the analysis of these decisions are (1) the participated doctrine which is applied apparently in their application are within separate prosecution areas between the two indictments, thereby treating the participants in the participated doctrine equally with the independent offender, even impressed as a convergence offense, (2) with prosecution in the indictment, the prosecutor and judge in applying the participated doctrine in these two decisions tend to be restrictive in view that the offender is compared to the dader not as part of the producers entity (verzamen term) in which there are qualities of offenders who can be distinguished between pleger, doenpleger, medepleger, uitlokker or medeplichtigheid.

Abstract

The element of unlawful (UMH – Unsur Melawan Hukum) in the Criminal Act of Corruption in the criminal justice practice shows a varied view between the prosecutor and the judge in making the decision to the defendant. The object of this study is related to the element of unlawful in corruption by using normative juridical method. The result shows that there are variations of the view is caused by (1) UMH, both formal and material, especially formal UMH in the criminal act of corruption is always seen as a bestanddeel element that gives character to other elements, with no prove UMH then other elements are considered unnecessary to be proved again, (2) UMH is considered as a stilzwijgend element which views each delict contained in UMH regardless of written or not in the formulation of a criminal article, but this leads to further debate which is necessary or not to be proved by the public prosecutor if UMH is not expressly written (as in article 2 paragraph (1) UUTPK) in the formulation of a criminal article. However, this is channeled by the view that if it is not clearly stated in the criminal article as in article 3 of UUTPK, it can be understood by applying genus-species approach to UMH as meant in article 2 paragraph (1) UUTPK as genus of UMH in TPK, then UMH its species in article 3 of UUTPK is understood from the element of misusing authority, opportunity, and position that existed on the corruptor.

Abstract

This study aims to reveal and analyze the comparative implementation of law enforcement against the crime of trade in protected animals in Indonesia, and to understand and analyze the form of policy recommendations on the crime of trade in protected wildlife in Jayapura City. The research method used focuses on normative juridical research by prioritizing secondary data sourced from primary legal materials, secondary legal materials, and tertiary legal materials, as well as statutory, conceptual, analytical approaches, legal history, and comparative legal approaches. The data obtained were processed using qualitative analysis techniques with three workflows; data reduction, data presentation, and verification (conclusion). The results of this study found that in a comparative analysis of cases of criminal acts of trade in protected wildlife that occurred in Aceh, Kalimantan, Surabaya, and Jayapura, the decisions against the defendants did not have a significant deterrent effect. The four cases show that the punishments given were lighter than the sanctions that should have been received according to the existing regulations. Even though the purpose of punishment for prevention, in reality, has not been fulfilled. This is because the penalty for the accused does not create a deterrent effect. Policy recommendations offered from the results of this study are the need for collaboration with stakeholders such as civil society, the private sector, local communities, and governments, and on a broad scale to stop the killing, trade, and demand for wildlife products. Then, strengthen institutional, legal, and regulatory systems to deal effectively with wildlife-related violations. In addition, in the implementation of these laws and regulations, it is necessary to ensure the effective monitoring and management of legal trade. Also, there must be a policy to prevent trade in protected wild animals which should give a deterrent effect to perpetrators based on security. Copyright © 2023 JEB. All rights reserved.

Abstract

This research examines the collaboration between the Indonesian National Police and the Keerom District Revenue Office in assessing and controlling local revenue leakage. The study uses qualitative descriptive methods and data from the post-reform period. Data is collected through purposive sampling, including interviews, observations, and documentation. The findings highlight the importance of collaboration between the Police and the Revenue Office in identifying and addressing revenue leakage issues. This collaboration involves task sharing, resource allocation, and coordination mechanisms. By working together, they can identify sources of leakage, evaluate the impact on local finances, and develop appropriate measures. The study concludes that this collaboration has positive effects on increasing local revenue, improving financial management efficiency, and enhancing public trust in local government. To further improve the welfare of people in Keerom Regency, concrete steps are needed to maintain and enhance this collaboration

Abstract

Tujuan kegiatan Pendampingan hukum ini adalah untuk Tujuan dari kegiatan ini adalah untuk memberikan layanan bantuan dan pendampingan hukum kepada pelaku usaha mikro dan kecil yang memiliki permasalahan hukum berkaitan dengan usahanya dan meningkatkan literasi hukum kepada usaha mikro dan kecil di daerah distrik kemtuk gresi. Metode yang akan digunakan dalam kegiatan ini adalah metode partisipatif. Bentuk kegiatan yang akan dilakukan diantaranya adalah Konsultasi permasalahan, dan pendampingan.

Abstract

The low level of legal awareness among students regarding the latent dangers of corruption remains a hot topic. The objective of this Community Service program is to enhance the legal knowledge and awareness of students at Jayapura State High School 4 regarding the definition of corruption, its types or forms, causes and impacts, as well as the legal provisions governing corruption-related criminal offenses and their penalties. Additionally, this activity aims to instill anti-corruption education as part of secondary school education. The methods used include interactive legal counseling, case simulations, group discussions, role-playing, and evaluations of 73 students. After the implementation of the community service program, there was a significant increase in understanding and attitudes toward anti-corruption, with students scoring very high increasing from 5.5% to 67.1%. This success was due to the active role of teachers, principals, and the faculty-student team in creating a collaborative learning environment and setting an example in applying anti-corruption values during the community service program. This program is not only about disseminating knowledge but also about building students' character so that they are willing and able to combat and report all forms of corruption, as well as internalize the nine core anti-corruption values such as honesty, responsibility, discipline, independence, hard work, simplicity, courage, compassion, and justice. The proposed solutions focus on improving communication and developing new approaches to student engagement, ensuring the sustainability of this program. ABSTRAK Rendahnya kesadaran hukum siswa tentang bahaya laten korupsi masih menjadi isu yang hangat. Tujuan dari Pengabdian kepada Masyarakat ini untuk meningkatkan pengetahuan dan kesadaran hukum siswa SMA Negeri 4 Jayapura tentang pengertian korupsi, jenis atau bentuk, penyebab dan dampak korupsi, serta ketentuan hukum yang mengatur tindak pidana korupsi dan ancaman pidananya. Selain itu, kegiatan ini juga bertujuan untuk menanamkan pendidikan antikorupsi sebagai bagian dari pendidikan sekolah menengah. Metode yang digunakan adalah penyuluhan hukum interaktif, simulasi kasus, diskusi kelompok, bermain peran (roleplay), serta evaluasi terhadap 73 siswa. Setelah pelaksanaan pengabdian menunjukkan adanya peningkatan yang signifikan dalam pemahaman dan sikap antikorupsi, dengan siswa yang berada pada nilai sangat tinggi meningkat dari 5,5% menjadi 67,1%. Keberhasilan ini tidak lepas dari peran aktif guru, kepala sekolah, serta tim dosen-mahasiswa dalam menciptakan iklim belajar bersama dan memberikan contoh dalam menerapkan nilai-nilai antikorupsi pada pelaksanaan pengabdian. Program ini tidak hanya untuk menyebarkan pengetahuan, tetapi juga membangun karakter siswa agar mau dan mampu melawan dan melaporkan segala bentuk korupsi, serta menghayati sembilan nilai inti antikorupsi seperti kejujuran, tanggung jawab, disiplin, kemandirian, kerja keras, kesederhanaan, keberanian, kepedulian, dan keadilan. Solusi yang diusulkan berfokus pada peningkatan komunikasi, pengembangan pendekatan baru dalam keterlibatan siswa sekolah, yang memungkinkan keberlanjutan program ini.
