Abstract

Perjanjian Pra Nikah sebagai salah satu bentuk perjanjian yang diatur dalam Undang-undang No.16 Tahun 2019 Tentang Perkawinan sebelumnya diatur dalam Undang-undang No.1 Tahun 1974. Masalah pokok dalam penelitian ini adalah (1)Bagaimanakah pengaturan perjanjian pra nikah menurut hukum perdata dan hukum adat di Kabupaten Manggarai, (2)Apakah dampak hukum apabilah salah satu pihak melakukan wanprestasi terhadap syarat-syarat perjanjian pra nikah di Kabupaten Manggarai. Penelitian ini dilakukan dengan teknik pengumpulan data yaitu, wawancara, dokumentasi dan studi kepustakaan. Data yang telah terkumpul baik melalui wawancara maupun dokumen, diperiksa satu persatu dan disusun secara sistematis sehingga tercapainya tujuan dari penelitian ini. Hasil penelitian ini menunjukan bahwa pengaturan perjanjian pra nikah dalam hukum perdata diatur dalam KUHP Pasal 139 sampai dengan Pasal 154. Sedangkan dalam prakteknya perjanjian pra nikah di Kabupaten Manggarai khususnya di Kelurahan Pitak dilaksanakan berdasarkan hukum adat yang berlaku di masyarakat. Upacara Ba Pangkang hingga upacara Pongo atau Tuke Mbaru merupakan pelaksanaan perjanjian pra nikah di Kabupaten Manggarai.

Abstract

Wanprestasi dalam Perjanjian Hutang Piutang artinya tidak memenuhi sesuatu yang diwajibkan seperti telah ditetapkan dalam perikatan, tidak terpenuhinya kewajiban oleh debitur. Rumusan masalah: (1) Bagaimanakah penyelesaian wanprestasi dalam perjanjian hutang piutang? (2) Apakah pertimbangan hakim terhadap wanprestasi dalam perjanjian hutang piutang ( dalam putusan nomor 129/Pdt.G/2019/PN Kpg)? Penelitian ini merupakan penelitian normatif. Untuk mendapatkan hasil penelitian tersebut, maka penelitian ini akan dilakukan dengan studi kepustakaan yang meliputi buku, jurnal, dan sember-sumber tertulis lainnya. Data dianalisis secara deskriptif-kualitatif. Hasil penelitian ini dapat disimpulkan: (1) Penyelesaian Wanprestasi di pengadilan, diberlakukan penyelesaian berdasarkan hukum acara perdata sebagaimana penyelesaian perkara-perkara perdata lainnya. Hal ini berarti dalam proses penyelesaiannya dapat dikenakan ganti rugi maupun sita jaminan apabila memang diperlukan dilaksanakan sita sebagaimana yang diatur dalam Pasal 277 HIR. Penyelesaian melalui jalur pengadilan atau jalur litigasi ini dimulai dengan pengajuan gugatan pada pengadilan negeri sebagai pengadilan tingkat pertama yang memeriksa dan memutus perkara. Proses persidangan dimulai dari pembacaan gugatan, replik duplik, pemeriksaan alat bukti, kesimpulan hingga penjatuhan putusan oleh majelis hakim. (2) Pertimbangan hakim terhadap wanprestasi dalam perjanjian hutang piutang dalam kasus ini majelis hakim memutuskan untuk gugatan penggugat dinyatakan tidak dapat diterima niet onvantklijke verklaard, maka penggugat dihukum untuk membayar ongkos perkara. Saran dari penelitian ini adalah Bagi pihak Pengadilan Negeri Kelas 1A Kupang agar masalah hutang piutang yang terjadi di wilayah kota kupang diperhatikan agar bagi para pihak yang ingin membuat perjanjian bisa mengikuti dan menepati sebuah proses perjanjian yang dibuat. Dan untuk pihak tergugat atau debitur agar suatu perjanjian yang sudah dibuat dengan pihak kreditur atau penggugat agar ditepati, apabila dalam perjalanan ada kendala atau masalah segera melaporkan ke pihak berwajib. Diharapkan kepada pihak tergugat agar melakukan sebuah pembayarn kepada pihak penggugat yang sesuai dengan bunga yang sudah ditentukan berdasarkan dengan perjanjian yang sudah dibuat.

Abstract

Gender's existence today is strongly influenced in every aspect of human life. One of them is the application of gender in customary inheritance law in Baumata Village, Taebenu District, Kupang Regency. This type of research is empirical research conducted in Baumata Village, Taebenu District, Kupang Regency and the data source used is primary data. Primary data is data obtained directly from the research location through direct interviews with respondents. Based on the results of this study is that the Baumata village community still maintains the position of inheritance rights, namely boys are still more dominant in getting inheritance rights but not to get the inheritance rights. The timor community in baumata village still maintains the inheritance rights distribution system because it still adheres to patrilineal culture.

Abstract

The purpose of this research is to determine the position of Tu’a Teno Gendang Curu regarding the transition of indigenous land rights over Tanah Lingko (Customary Land) to private ownership and to understand the legal consequences of the transfer of indigenous land rights over Lingko (Customary Land) to private ownership. This study is an empirical legal research that employs an approach involving interviews as the primary source of data and literature review, including books, regulations, and other scholarly writings related to this research. The conclusions drawn from this research include, firstly, the division of Gendang Curu's Lingko marks the beginning of the transfer of rights over customary land. In a broader context, this division reflects customary legal actions in jointly managing land resources. However, in a more specific context, the division of Lingko also signifies the individual management of land for collective purposes, where the control over the managed land becomes an individual right. The transfer of customary rights is considered a preliminary step towards privatizing land rights, acknowledged by Gendang Curu's customary law through the sanctioned division of Lingko by Tu’a Teno. Secondly, the transfer of indigenous land rights over Lingko to private ownership by Tu’a Teno Gendang Curu weakens indigenous rights and strengthens individual rights. This opens up opportunities for various legal actions such as land transactions, donations, and inheritance, culminating in land registration to ensure legal certainty. However, the consequence of this process is the loss of Tu’a Teno's position and role as the manager of customary land. Tu’a Teno will only serve as a witness in case of land disputes.

Abstract

The aim of this research is to determine the factors that drive the people in Cumbi Village, Manggarai Regency, to perform Cako customary marriages, to understand the process of Cako customary marriage in the traditional community of Cumbi Village, and to ascertain the validity of Cako customary marriages in the customary law of Cumbi Village, Manggarai Regency, in accordance with Law Number 1 of 1974 concerning Marriage. This study is an empirical legal research using an approach involving interviews as primary data sources and literature reviews, including books, regulations, and other scholarly writings related to the research. The conclusions of this study include, among others: Firstly, Cako customary marriages conducted in Cumbi Village are motivated by several factors, such as strengthening family ties, arranged by parents, preventing inheritance from shifting or dividing along other bloodlines, proximity of residence, lighter financial burden (belis), and preserving the Manggarai culture, as Cako customary marriages are part of Manggarai culture. Secondly, the procedure for Cako customary marriage in Cumbi Village begins with the Kamba Lembor Cako ceremony. The Cako marriage procedure is then followed by the courtship or weda rewa tuke mbaru stage. Subsequently, the event continues with the implementation of the marriage or cikat kina waga kaba. The last procedure is the escorting of the bride to the groom's house. Thirdly, Cako customary marriages in Cumbi Village can still be conducted in accordance with the customary law of Cumbi Village as long as they do not contradict positive law. Additionally, the Catholic Church, by providing dispensations for couples with blood relationship hindrances, can be a way for Cako customary marriages to be legally valid both religiously and according to positive legal regulations.

Abstract

Based on the results of the research that has been done, it can be concluded (1) In the process of dividing customary land rights according to Wesei Wehali customary law by the fukun (tribal head) in Umakatahan village, Central Malacca sub-district, Malacca district, the fukun or tribal chief provides information to oa'laen to provide invitations to indigenous peoples and village officials, sitting together in traditional houses (tur lia) and performing traditional rituals, and designating shared communal land objects. Abstract

One of the laws that is still valid in the process of inheritance is customary law which has its own norms that are separate from the applicable law. The inheritance procedure is prioritized by deliberation as the basis is the most important thing so that harmony and harmony in the family is maintained, inheritance has meaning and understanding as a method of transferring assets left by the heir to his heirs. Inheritance is the transfer of rights and obligations regarding the wealth of a deceased person to another who is still alive.
