The conclusions of this study include, among others: Firstly, Cako customary marriages conducted in Cumbi Village are motivated by several factors, such as strengthening family ties, arranged by parents, preventing inheritance from shifting or dividing along other bloodlines, proximity of residence, lighter financial burden (belis), and preserving the Manggarai culture, as Cako customary marriages are part of Manggarai culture. Secondly, the procedure for Cako customary marriage in Cumbi Village begins with the Kamba Lembor Cako ceremony. The Cako marriage procedure is then followed by the courtship or weda rewa tuke mbaru stage. Subsequently, the event continues with the implementation of the marriage or cikat kina waga kaba. The last procedure is the escorting of the bride to the groom's house. Thirdly, Cako customary marriages in Cumbi Village can still be conducted in accordance with the customary law of Cumbi Village as long as they do not contradict positive law. Additionally, the Catholic Church, by providing dispensations for couples with blood relationship hindrances, can be a way for Cako customary marriages to be legally valid both religiously and according to positive legal regulations.

Abstract

The rapid development of digital banking has improved the efficiency and accessibility of financial services while simultaneously increasing the risk of cybercrime, particularly phishing, unauthorized access, and the loss of customers' funds. This study aims to analyze the legal protection available to customers who suffer financial losses due to balance depletion in the BRIMO application and to examine the legal liability of banks under Law Number 10 of 1998 concerning Banking. This research employed normative legal research using statutory and conceptual approaches. The legal materials consisted of primary, secondary, and tertiary legal sources analyzed through qualitative descriptive methods. The findings indicate that legal protection for banking customers is provided through preventive measures, including the application of the prudential principle, information technology risk management, personal data protection, and customer education, as well as repressive measures through dispute resolution mechanisms. However, the existing legal framework has not specifically regulated the allocation of liability in digital banking transactions. Banks may be held liable when losses result from weaknesses in security systems or failures in implementing risk management. Therefore, more specific regulations are required to strengthen legal certainty and ensure balanced legal protection for both banks and customers in the digital banking sector.

Abstract

Background: A song is an artistic work created through the integration of melody, lyrics, and musical arrangement. In the digital era, the protection of song royalties has become increasingly important due to rapid technological developments that facilitate copyright infringement, particularly piracy, which undermines creators’ economic rights. Economic rights, including the right to receive royalties, are explicitly protected under Law Number 28 of 2014 on Copyright. Objective: This study examines the mechanism for distributing song royalties under the Copyright Law and evaluates the accountability and legal protection afforded in the distribution of royalties from the perspective of justice for songwriters. Methods: Using a normative legal research method with a statutory approach, this study analyzes relevant legal provisions governing copyright and royalties. Results: The findings show that royalty payments, as stipulated in Article 87 of Law Number 28 of 2014, are managed through Lembaga Manajemen Kolektif (LMK) to ensure the effective fulfillment of creators’ economic rights arising from the commercial use of copyrighted works. Royalties are mandatory when songs and/or music are used commercially in circumstances covered by the applicable copyright regulations. In Indonesia, the management of royalties for songs and/or music involves Lembaga Manajemen Kolektif Nasional (LMKN), which is authorized to collect, administer, and distribute royalties in accordance with the applicable legal framework. Conclusion: The study recommends enhancing public awareness of copyright and royalty obligations among both creators and users of music. It also suggests revising the Copyright Law, particularly regarding the determination of royalty rates, to provide greater legal certainty rather than relying solely on abstract standards of fairness and reasonableness.
