Abstract

This study aims to determine the literacy level of elementary school children from grade 1 to grade 3 in Kupang Regency, East Nusa Tenggara (NTT) based on four basic literacy skills, namely: (1) letter knowledge; (2) vocabulary or vocabulary; (3) reading fluency; (4) reading comprehension. The status of this research is a collaboration between the Nusa Cendana University Research Institute and the Sayangi Tunas Cilik Foundation (YSTC) Kupang. The study was conducted at 56 elementary schools spread over 7 sub-districts in Kupang Regency, NTT. The study population was 5085 children. Sampling of children in this study used the Slovin formula with an error rate of 2%. Samples were taken of as many as 1678 children. Data on children's literacy skills were taken using standardized tools from YSTC. These tools are already available in the form of a digital questionnaire. Data collection using a tablet with a face-to-face interview method (1 child with 1 enumerator). As many as 60% of children in the lower grades (grades I, II, III) of Elementary Schools in Kupang Regency are able to read. The specific findings of this study: (1) girls have higher literacy skills in the five basic literacy skills. (2) the role of the mother is more dominant in helping children read at home. (3) the higher the level (grade) the smaller the difference in literacy skills between boys and girls.

Abstract

Otoritas Jasa Keuangan adalah lembaga pengawas jasa keuangan yang mempunyai wewenang pengaturan, pengawasan, pemeriksaan dan penyidikan pada lembaga jasa keuangan termasuk pinjaman uang online oleh layanan pendanaan bersama berbasis teknologi informasi. penelitian ini bertujuan untuk mengetahui: (1) Bagaimana peran Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang online oleh layanan pendanaan bersama berbasis teknologi informasi (2) Upaya-upaya yang sudah dilakukan Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang secara online oleh layanan pendanaan bersama berbasis teknologi informasi. Penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan metode deskriptif analisis. Bahan hukum penelitian ini menggunakan bahan hukprimer, sekunder dan tersier. Hasil penelitian ini dapat disimpulkan: (1) Peran Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang secara online oleh layanan pendanaan bersama berbasis teknologi informasi adalah mengeluarkan regulasi untuk mengatur dan mengawasi. (2) Upaya-upaya yang sudah dilakukan Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang secara online oleh layanan pendanaan bersama berbasis teknologi informasi adalah melakukan edukasi,menghimbau masyarakat untuk selalu mengecek legalitas pinjaman online ketika menerima penawaran, mengeluarkan layanan baru guna meningkatkan perlindungan konsumen yaitu Consumer Support Technology (CST) berupa Chatbot CST dan Otoritas Jasa Keuangan bersama dengan 11 kementerian berkoordinasi membentuk Satgas Waspada Investasi (SWI) untuk memberantas pinjaman online ilegal yang meresahkan dan merugikan masyarakat.

Abstract

The Financial Services Authority is a financial services supervisory institution that has the authority to regulate, supervise, examine, and investigate financial services institutions including online money loans by information technology-based joint funding services. The formulation of this research problem: (1) What is the role of the Financial Services Authority in handling online money loan offers by information technology- based joint funding services? (2) what efforts have the Financial Services Authority made in handling online money loan offers by information technology-based joint funding services? The research used is normative legal research using the descriptive analysis method. This research uses primary, secondary, and tertiary legal materials. The results of this study can be concluded: (1) The role of the Financial Services Authority in handling online money loan offers by information technology-based joint funding services is to issue regulations to regulate and supervise. (2) The efforts that have been made by the Financial Services Authority in handling online money loan offers by information technology-based joint funding services are conducting education, urging the public to always check the legality of online loans when receiving offers, issuing new services to improve consumer protection, namely Consumer Support Technology (CST) in the form of Chatbot CST and the Financial Services Authority together with 11 ministries coordinating to form the Investment Alert Task Force (SWI) to eradicate illegal online loans that are troubling and detrimental to the community.

Abstract

Waja merupakan upaya pemutusan hubungan perkawinan adat karena salah satu pihak melakukan kesalahan ataupun keduanya telah bersepakat untuk berpisah. Waja juga merupakan suatu upaya untuk mengurangi dan meredahkan konflik yang terjadi dalam hubungan perkawinan. Waja dianggap dapat mengurangi dan meredahkan konflik karena waja itu sendiri dalam masyarakat adat Bajawa dianggap sebagai sebuah pengadilan resmi yang dapat mengesahkan perceraian yang telah terjadi. Penelitian ini bertujuan untuk mengetahui bilamana pemberian sanksi dalam perceraian adat di Desa Inerie, Kecamatan Inerie, Kabupaten Ngada dilaksanakan dan jenis sanksi yang diberikan dalam perceraian adat di Desa Inerie, Kecamatan Inerie, Kabupaten Ngada. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris. Adapun sumber dan jenis data dalam penelitian ini adalah data primer yang diperoleh dari hasil studi lapangan dengan wawancara. Data sekunder diperoleh dari studi kepustakaan. Data yang diperoleh kemudian diolah dengan cara memeriksa dan mengoreksi data. Setelah data diolah kemudian dianalisis secara kualitatif. Berdasarkan hasil penelitian dan pembahasan maka dapat disimpulkan bahwa Waja/mozo dilaksanakan ketika pasangan yang sudah sah secara perkawinan adat melakukan pelanggaran terhadap perjanjian-perjanjian dalam perkawinan dan memilih untuk tidak melanjutkan perkawinan untuk disahkan secara agama. Dalam rangkaian pelaksanaan waja, ada ritual yang disebut dengan nata rogho to deka bhela bhai dan diikuti dengan sebhe kepe. Sanksi adat yang diberikan dalam waja adalah sanksi materil, yaitu berupa hewan (kuda/kerbau) untuk laki-laki yang melanggar perjanjan kawin dan yang ingin berpisah. Untuk perempuan yang melanggar perjanjian kawin dan ingin berpisah maka dikenakan sanksi berupa hewan (kuda/kerbau) dan pengembalian mahar yang telah diberikan oleh laki-laki pada saat perkawinan adat.

Abstract

The purpose of this research is to analyze the implementation of Complete Systematic Land Registration (PTSL) and the inhibiting factors based on the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 6 of 2018 concerning (PTSL) in Bajawa City. This research is an empirical legal research conducted at the Ngada Regency Land Office. Data collection techniques using interview techniques and literature / document studies. The data used are primary data, secondary data and tertiary data. This research was conducted in Bajawa City, Ngada Regency, East Nusa Tenggara. The results of data management were analyzed descriptively using qualitative methods. Based on the results of the research and discussion, it can be seen that the Implementation of the Complete Systematic Land Registration (PTSL) Programme in Bajawa City, Ngada Regency, has been running well in the two Villages/Kelurahan Lebijaga and Desa/Kelurahan Bajawa both seen from the achievement of the 2022 programme target. The inhibiting factor in the Ngada Regency Land Office is that work performance is still not optimal due to the lack of apparatus. Facilities and infrastructure are also still lacking, especially for two-wheeled vehicles and four-wheeled vehicles as well as office equipment such as computers and laptops.

Abstract

Land is one of the most needed investments from time to time. The demand for land is starting to show with the increasingly rapid human growth, while the land for land is not increasing. In de facto, there are still tribal lands in NTT, but the power of indigenous peoples over tribal lands is no longer fully because what was previously considered as shared land, as a result of the individualization process has changed to individual ownership, this is partly because there are no regulations governing the existence of indigenous peoples and customary land or customary land. The lack of protection for indigenous peoples in Kupang Regency not only means that it has not been recognized by the state but also causes the existence and wealth of indigenous peoples, including customary lands, to be vulnerable to various interests both from within the indigenous peoples themselves and pressure from outsiders. This Community Service activity aims to explain in detail the existence of customary land in Kupang Regency, how important and urgent it is to provide protection for customary law communities and what kind of protection mechanism from the state is considered appropriate to the current characteristics of the Kupang Regency customary law community. The method used in this activity is lecture and question and answer. The results of the activity showed that the community was very enthusiastic about hearing and listening carefully to the explanations presented by the resource persons so that interesting discussions ensued. Through this activity, the community also gains new knowledge related to the existence of customary land. From the results of this activity it can also be concluded that the implementation of the activity in general went well because of the collaboration with various parties in the target location, namely the Kuimasi Village Office, Fatuleu District, Kupang Regency and also the target community (participants namely village officials, community leaders and the community ) in Kuimasi Village, Fatuleu Sub-district, Kupang Regency really hopes for further socialization in the field of law.

Abstract

Savings and Loans Cooperatives generally provide services to ensure the welfare of their members and make it easier to fulfill their members' living needs. In accordance with the nature of loan cooperatives or credit cooperatives, the main aim of the operation of these cooperatives is as an alternative means of borrowing money or credit. The formulation of the problem in this research is: (1) What are the responsibilities of the cooperative management in settling members' arrears at KSP Serviam Penfui Branch? (2) What factors hinder the management's responsibility in settling arrears at KSP Serviam Penfui Branch? This research is a type of empirical legal research where the data is obtained directly from the research location. This research uses data collection techniques by means of interviews and literature study. The data collected is then analyzed and then presented in a qualitative descriptive manner. The results of this research show: (1) The responsibility of the management of the KSP Serviam Penfui Branch cooperative in settling arrears is to provide members with an extension of time if the member experiences total arrears. The extension of time given is a delay of 10 days, a warning will be given by telephone or a first warning letter will be sent. For members who have postponed 30 days, a home visit will be made or a second warning letter will be sent. Members who have delayed 40 days or more will be visited at home or sent a third warning letter, accompanied by threats and sanctions, and offered to reschedule loan payments. If all the steps above are not fulfilled, the management meeting will decide to take legal action. By taking action to resolve arrears, it is hoped that members will be more orderly in repaying loans. (2) The factors causing arrears in service cooperatives are as follows: Weak supervisory system for cooperative management, lack of coordination between departments, lack of accuracy in analyzing credit provision, financial conditions of members, due to natural disasters, and business failure.

Abstract

An endorsement cooperation agreement (Endorsement Agreement) is a collaboration or contract entered into by two parties via social media. This collaboration is not like other agreements, namely written, but all forms of agreement are made via social media based on the principle of freedom of contract. So that in its implementation, defaults often occur by one party or two parties. The purpose of this research is to find out how the Endorsment Agreement between Kopi Papa Ganteng and Instagram Celebrities is implemented and how to resolve disputes regarding default on the Endorsement Agreement between Kopi Papa Ganteng and Instagram Celebrities. The research method used is an empirical legal research method where researchers obtain data directly from the field and obtain information regarding research studies from Kopi Papa Ganteng and Instagram celebrities in Kupang City. Data collection techniques are by means of interviews and literature studies in the form of books, laws and regulations and other materials related to the problem being studied. The results of this research show that: First, the implementation of the Agreement between Kopi Papa Ganteng and Instagram Celebrities meets the requirements for the validity of the agreement in Article 1320 of the Civil Code where: there is an agreement between the parties, according to those who made it, there is a certain thing and there is a lawful cause. Kopi Papa Ganteng will contact celebgrams via social media, to endorse several Kopi Papa Ganteng drink products individually. If the celebrity agrees, the endorser provides a price list to Kopi Papa Ganteng. Then, after approval, the endorsement fee payment transaction process occurs, which in this case is 50% and will be paid off after being posted by the celebgram. Second, dispute resolution for celebgrams and Kopi Papa Ganteng regarding non-compliance with the Endorsment Agreement is carried out through amicable settlement without reporting to the authorities. And all disputes were resolved thoroughly by Kopi Papa Ganteng and celebgram. Out-of-court dispute resolution is regulated in Law of the Republic of Indonesia no. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution.

Abstract

This research aims to find out legal protection for consumers as well as the inhibiting factors in efforts to stabilize rice prices in terms of Law Number 8 of 1999 concerning Consumer Protection. The research method used in this research is Normative Juridical, meaning research conducted to analyze data in literature using currently applicable legal regulations. The legal sources and materials used are primary, secondary and tertiary legal materials. The research results show that the price of rice has experienced significant price fluctuations in recent years, this is due to factors such as decreasing rice production but increasing demand for rice. So the government is making every effort to overcome this problem in order to protect the public, especially consumers who have difficulty getting or buying rice at quite high prices. There are two ways of protection carried out by the government, namely preventive and repressive protection.
