Abstract

The purpose of this research is to determine the position of Tu’a Teno Gendang Curu regarding the transition of indigenous land rights over Tanah Lingko (Customary Land) to private ownership and to understand the legal consequences of the transfer of indigenous land rights over Lingko (Customary Land) to private ownership. This study is an empirical legal research that employs an approach involving interviews as the primary source of data and literature review, including books, regulations, and other scholarly writings related to this research. The conclusions drawn from this research include, firstly, the division of Gendang Curu's Lingko marks the beginning of the transfer of rights over customary land. In a broader context, this division reflects customary legal actions in jointly managing land resources. However, in a more specific context, the division of Lingko also signifies the individual management of land for collective purposes, where the control over the managed land becomes an individual right. The transfer of customary rights is considered a preliminary step towards privatizing land rights, acknowledged by Gendang Curu's customary law through the sanctioned division of Lingko by Tu’a Teno. Secondly, the transfer of indigenous land rights over Lingko to private ownership by Tu’a Teno Gendang Curu weakens indigenous rights and strengthens individual rights. This opens up opportunities for various legal actions such as land transactions, donations, and inheritance, culminating in land registration to ensure legal certainty. However, the consequence of this process is the loss of Tu’a Teno's position and role as the manager of customary land. Tu’a Teno will only serve as a witness in case of land disputes.

Abstract

The purpose of this study is to analyze the juridical ownership of customary land rights based on the decision of civil case Number: 13/Pdt.G/2021/Pn End. The type of research used by the author is Normative Legal research. The sources of legal materials used in this research are primary, secondary and tertiary legal materials. The method of processing legal materials through 4 (four) stages, namely identification of legal materials, inventory of legal materials, verification of legal materials and interpretation of legal materials which are then analyzed descriptively qualitatively. Based on the research results, the Plaintiff was unable to prove that the disputed object was his property and vice versa the Defendants were unable to prove that the disputed object was customary land belonging to the Kila Da Tribe. This is because there are inconsistencies regarding the structure, hierarchy, and mechanism of worship in the Customary Law Community that differ in the evidence of the Plaintiff and the Defendants. The Plaintiffs and Defendants were also unable to prove recognition by executive agencies regarding ownership of the disputed object. In addition, the Plaintiff was unable to prove that he was a legitimate heir as stipulated in Article 832 of the Civil Code. Likewise, the Defendants were unable to prove that they were the legitimate heirs of Kila Da from Wednesday Kila's descendants. The author argues that the consideration of the Panel of Judges in giving a decision in this case was correct, by rejecting the Plaintiff's claim in its entirety. Because all the arguments of the lawsuit regarding ownership of rights to customary land, cannot be proven by the Plaintiff.

Abstract

The purpose of this research is to find out the procedure of child adoption at the Oelamasi District Court and the judge's reasoning in granting the application for child adoption with prospective parents over 55 years old. The research method used is empirical research. The results showed (1) The child adoption procedure at the Oelamasi District Court is in accordance with the child adoption arrangements contained in the laws and regulations. Particularly in this case, the child who was adopted was not under the care of a social organization but under the care of the prospective adoptive parents. In addition, in this case the prospective adoptive parents did not fulfill one of the requirements for child adoption contained in Article 13 of the Government Regulation, which in turn is the authority of the judge in accepting or rejecting the application. (2) The judge's reasoning in granting the application for child adoption in Stipulation Number 5/Pdt.P/2023/PN Olm is by referring to the provisions of Article 28 B paragraphs (1) and (2) jo Article 28 D paragraph (1) of the 1945 Constitution of the Republic of Indonesia which prioritizes the principles of justice and the best interests of the child so that even though the age of the Plaintiffs no longer meets the requirements of the legislation because they are more than 55 (fifty five) years old does not have to hinder the noble intentions of the Plaintiffs to adopt a child.

Abstract

Belis is as a form of appreciation, or honor to the woman and her family, belis This also serves as a bond in the marital relationship, belis Having a marriage certification tool is a symbol of a woman's status with economic, social, and moral functions, and symbolizes femininity, belis also holds a very important meaning in traditional marriage. The main issue in this study are: (1) what is the process of determining belis and implemantion between belis in traditional marriages among the Roworeke indigenous community, Ende District (2) What are the legal consequences of between dowries in traditional marriages among the Roworeke indigenous community, Ende District? The research method used in this research is Juridical Empirical research, which means that in analyzing the problems it is done by combining legal materials (which are secondary data) with primary data obtained in the field. The legal sources and materials used are primary, secondary and tertiary legal materials. The results of this study indicate (1) what is the process of determining belis and implemantion between belis in traditional marriages among the Roworeke indigenous community, Ende District (2) The legal consequences that occur when belis is carried out fully, partially, and not at all.

Abstract

Kedudukan anak angkat dalam hak mewarisi menurut hukum perdata itu sama dengan anak kandung/anak sah maka, untuk itu ia berhak mewarisi harta warisan orang tua angkatnya menurut undang-undang atau mewarisi berdasarkan hukum waris testamentair apabila ia mendapatkan testament (hibah wasiat). Anak merupakan salah satu tujuan dari suatu perkawinan yaitu untuk meneruskan keturunannya, anak merupakan unsur yang penting serta mutlak bagi suatu keluarga yang menginginkannya, agar supaya ada generasi penerusnya. Pengangkatan anak adalah suatu perbuatan hukum yang mengalihkan seorang anak dari lingkungan kekuasaan orang tua, wali yang sah, atau orang lain yang bertanggung jawab atas perawatan, pendidikan dan membesarkan anak tersebut kedalam lingkungan keluarga angkat. Penelitian ini merupakan jenis penelitian hukum normtif yang mana datanya dikaji studi dokumen menggunakan berbagai data sekunder seperti peraturan, keputusan pengadilan, teori hukum, dan dapat berupa pendapat para sarjana. Hasil penelitian ini menunjukkan: (1) Bagaimana kedudukan anak angkat dalam mewarisi harta warisan orang tua angkat. (2) Untuk mengetahui akibat hukum dari kedudukan anak angkat dalam mewarisi harta warisan orang tua angkat. Berdasarkan analisis terhadap data yang diperoleh selama penelitian, maka penulis menyimpulkan antara lain  Bagaimana kedudukn anakangkat dalam hal mewarisi harta warisan orang tua angkat ditinjau dari hukum perdata kedudukan anak angkat dalam hak waris menurut hukum perdata itu sama dengan anak kandung/anak sah maka, untuk itu ia berhak mewarisi harta warisan orang tua angkatnyamenurut undang-undang atau mewaris berdasarkan hukum waris testamentair apabila ia mendapatkan testament (hibah wasiat).Pasal 10 pengangkatan anak angkat ini harus dilakukan dengan akta notaris.

Abstract

The need for the community for reception purposes is increasing, so people are starting to think about running a business, namely renting moving goods for reception purposes and one of them is a sound system. In doing a lease, of course, there is an agreement between the tenant and the renter, both an oral and written agreement. This study used empirical research methods. This research was conducted by data collection techniques, namely, interviews and document studies. Data that have been collected both through interviews and document studies, analyzed descriptively-qualitatively. The results of this study show that: (1) The implementation of the sound system rental agreement for reception purposes in Lokea Village is usually carried out orally and does not have many requirements and only relies on trust between related parties. In general, the tenant of the sound system for reception purposes in Lokea Village is from the bride's side, because of the custom of the Lokea community the reception will be held on the bride's side. (2) Obstacles from parties involved in this sound system rental agreement include trust factors, quality of goods rented, negligence on the part of the tenant and return of goods that exceed the term of the rental agreement. (3) The rights and obligations of the parties to this sound system rental agreement are that the lessee has the right to receive rent, receive compensation, and decide to whom this item will be rented, in addition to the lessee also Obliged to guarantee that the rented goods are in good condition for use and are obliged to install. The tenant has the right to use the rented item according to the agreement and is entitled to receive compensation in the form of a discount, besides that the tenant is also obliged to pay the rental price and maintain the rented item.

Abstract

This research discusses the juridical review of the sale and purchase of inherited land without the knowledge of other heirs in the civil law code. This research method uses normative legal research methods, namely library research methods. The results of this study indicate that the transfer of land rights through sale and purchase or inheritance and other legal events are in accordance with applicable regulations, namely the Basic Agrarian Law and Government Regulation No. 24 of 1997 to create legal certainty and justice for severe parties, all legal acts or legal events need to be contained in an authentic deed made before a Notary / PPAT and registered with the land office so that the legal act is valid and has legal force in order to avoid legal problems and disputes, as well as an analysis of the basis for the judge's consideration in Decision Number 10/PDT. G/2019/PN LBT the plaintiff's lawsuit was declared unacceptable or rejected because the main petitum of the lawsuit was rejected, the next petitum was also rejected because it was assessor / following the granting of the main petitum of the lawsuit regarding the unlawful act of the defendants was declared unacceptable.

Abstract

Land issue is a problem due to the existence of land that has great value in human life often gives birth to problems, in order to avoid the increasing number of problems that occur, the state is obliged to provide legal certainty on the right of ownership of land for the community.Research using empirical juridical research. The framework of this research set out with the conception of the land law which contains the principle of prudence in the issuance of certificates and their legal consequences in order to conclude a solution for the Kupang District Land Office in terms of issuing certificates in accordance with the provisions and principles attached. Based on the results of research and discussion, it can be seen that in terms of Administration, every community service has Terms and conditions and prohibitions. The precautionary principle applied by the Kupang regency Land Office in the legal aspects of the application of legislation must be in accordance with the conditions served as a responsibility. The legal consequences that can be caused if the precautionary principle is not applied in the issuance of certificates at the Kupang regency Land Office will result in a lack of responsibility in the process of Public Service which can be fatal in the application of laws and principles in the issuance of land certificates.

Abstract

The Constitutional Court's decision confirms that customary forests are no longer state forests. This decision concerns two issues, namely, regarding customary forests and conditional recognition of the existence of indigenous communities. Legal issues, what are the implications of the Constitutional Court's decision on the regulation of customary forests and its impact on the rights of customary law communities. Aims to determine the implications of the Constitutional Court's decision on customary forest regulation and its impact on the rights of customary law communities. Types of normative research. Library study data collection techniques. The types of approaches are the statutory approach, contextual approach, historical approach, comparative approach and analytical approach. Using primary and secondary legal materials. Qualitative descriptive analysis. The research results show that Constitutional Court Decision has implications for forestry regulation in the form of creating implementing regulations governing customary forests that have developed significantly. The impact of the decision on customary law communities is, namely, the positive impact, customary law communities are recognized as owners of customary forests and the negative impact, the conditionality of recognition of the existence of customary law communities is increasingly strengthened.
