Abstract

PT Sumber Mineral Nusantara (SMN) berdasarkan informasi resmi yang diunggah di laman Minerba One Data Indonesia (MODI) Kementerian Energi dan Sumber Daya Mineral (ESDM) RI, mendapatkan izin untuk menjalankan aktivitas produksi/eksploitasi tambang emas di Kabupaten Trenggalek. Izin Usaha Pertambangan (IUP) Nomor P2T/57/15/02/VI/2019 kepada PT SMN itu berlaku selama 10 tahun terhitung mulai tanggal 24 Juni 2019 hingga 24 Juni 2029 dengan luas lahan mencapai 12.813 hektare. Bupati Trenggalek Nur Arifin pada awalnya mendukung kegiatan eksplorasi oleh PT SMN karena pihaknya ingin tahu seperti apa potensi sumber daya alam di Trenggalek. Namun sampai dengan ijin tambang emas terbit tidak ada kejelasan apa keuntungan yang didapatkan masyarakat Trenggalek dan bagaimana mengatasi dampak kerusakan lingkungan setelah kegiatan tambang dilakukan. Akhirnya muncul konflik dan gelombang penolakan dari masyarakat atas kegiatan eksplorasi di Desa Sumberbening, Kecamatan Dongko maupun Desa Dukuh, Kecamatan Watulimo, Kabupaten Trenggalek. Perlu dilakukan advokasi kepada masyarakat terkait regulasi pertambangan dan sosialisasi atas hak-hak yang harus dipenuhi oleh perusahaan pertambangan kepada masyarakat.

Abstract

Rape is an act of forcing sexual intercourse in any form against one's will or against one's will. This form of crime knows no gender, age, socioeconomic status, place, and time. Commitment and firmness in upholding human rights and guaranteeing that all citizens have equal standing before the law. Rape victims do receive attention, but often the attention given by human rights defenders is only partial, not optimal and is only used as an object of research. Legal protection is the most important thing in the elements of a rule of law, because legal protection is the right of every citizen and the obligation of the state as the organizer of protection. Normative juridical research methods, how to analyze library materials, namely primary and secondary legal materials. That humans must get protection from things that take away human rights in life, so women's human rights must be protected, respected, maintained, and cannot be ignored, reduced, or seized by anyone. It is a fact that acts of violence against women are a constant threat to women anywhere in the world and acts of violence against women have become a global issue. Law enforcement officials must simultaneously respect justice and human rights, although the balance between respect for truth and justice and respect for and uphold human rights values in resolving criminal incidents is very difficult to define. However, this difficulty should not become a narrow and rigid technical reason in giving the perpetrators of criminal acts freedom to freely move around in society.

Abstract

This study presents an in-depth review of the negative impacts of online gambling practices, particularly in the social, economic, and psychological contexts, in accordance with the latest regulations set out in Law No. 1 of 2024. This study uses a qualitative approach with a literature review method to analyze the negative impact of online gambling from a socio-economic and psychological perspective, as well as evaluating its compatibility with Law No. 1 of 2024 on the Second Amendment to Law No. 11 of 2008 on Electronic Information and Transactions. This article presents a new understanding of the impact of online gambling by comprehensively considering social, economic, and psychological aspects, as well as highlighting relevant recent regulatory changes. The results show that the practice of online gambling has a significant negative impact on various aspects of people’s lives, including financial problems, social conflicts, and mental health issues. In the context of Law No. 1 Year 2024, this study confirms the need for more decisive action in addressing the negative impacts of online gambling, both through stricter regulations and more effective rehabilitation programs.

Abstract

Adopted children and the process of adopting children by single parents are examined from a legal perspective in this article. The research methodology takes a normative legal stance by reviewing relevant laws and court decisions. With an emphasis on the differences and recent changes in the applicable legal requirements, this article provides a thorough understanding of the situation of adopted children and single parent adoption procedures. The legal consequences, processes, and rights of adopted children, including adopted children adopted by single parent s, are discussed in this paper. In response to the issue statement, key points are raised. The findings of this study highlight the adequate protection of children adopted by single parents and the reform of the child adoption system.

Abstract

Brands play an important role in the business world, which is related to the rapid growth of the trade sector and even unites the business world as a single market. Even so, what happened in this area was not as anticipated by Law no. 15 of 2001 which has been modified into Law no. 20 of 2016 No. 3, namely that there are still many violations and disputes found. This writing applies a normative juridical approach. The type of research used is descriptive research. The data used is secondary data in the form of primary legal data, secondary legal data and tertiary legal data. The results of this research are that Utami Silver violates Article 76 and can be charged under Article 91 of the Trademark Law no. 15 of 2001 because Utami Silver markets jewelry with similar products. Abstract

Sexual violence against children is a serious problem in Indonesia that can have long-term detrimental impacts on victims. This article aims to analyze legal protection for child victims of sexual violence from a juridical perspective. Through a study of relevant literature and journals, this article describes the meaning of sexual violence against children, the impact and consequences for victims, existing legal protection, as well as the obstacles and challenges faced in implementing this legal protection. In its analysis, this article reveals that sexual violence against children includes various acts involving coercion or sexual abuse of minors. The impact is physically, emotionally and psychologically devastating for the victim, which can continue into adulthood. Legal protection for child victims of sexual violence is based on national and international legal frameworks, which guarantee children's rights and provide legal instruments to uphold justice. However, the implementation of legal protection for child victims of sexual violence is faced with complex obstacles and challenges. Some of the main challenges include low public awareness, lack of access to adequate support services, limited resources, low capacity of law enforcement agencies, and justice processes that require a more sensitive understanding of children. To overcome this challenge, this article recommends efforts to increase public awareness, strengthen legal systems and policies, increase the capacity of law enforcement agencies, and increase victims' access to support services. With these steps, it is hoped that legal protection for child victims of sexual violence can be improved, victims receive justice, and prevention of sexual violence against children becomes a priority that is implemented comprehensively and sustainably. Increasing public awareness, strengthening the legal system, increasing the capacity of law enforcement agencies, and increasing victims' access to support services will play an important role in protecting children from sexual violence and creating a safe environment for their future.

Abstract

Cases of murder of children by biological mothers in Indonesia still occur frequently and are in the public spotlight. In the case study of Decision Number 333/PID.SUS/2021/PN BKS, a biological mother was charged with the murder of her own biological child who was only 9 months old. In the indictment, the public prosecutor used Article 75 paragraph (2) of the Republic of Indonesia Law Number 36 of 2009 concerning Health as a legal basis for charging the perpetrators. The article states that anyone who violates health provisions that causes the death of another person can be charged with imprisonment. In terms of juridical payments, Article 75 paragraph (2) of the Republic of Indonesia Law Number 36 of 2009 concerning Health is indeed relevant to the case of child murder by the biological mother. However, in this case, there were several weaknesses in the public prosecutor's indictment. First, there is no medical evidence indicating that the child's health was seriously impaired due to the mother's violent or negligent actions. Second, there is no strong evidence that the mother's violent actions or actions were detrimental to killing her child. In an effort to prevent cases of killing children by biological mothers in the future, the government also needs to increase public awareness about the importance of child health and protection. Education on how to care for children properly and how to deal with stress in pregnant women or mothers with young children also needs to be improved. In addition, the government also needs to strengthen supervision of acts of violence or negligence against children to prevent cases of homicide by parents or guardians that harm the health and life of children.

Abstract

Rape Rape is a form of sexual violence that is rampant in Indonesia. Rape is also an act that often occurs repeatedly so it is called ongoing rape. This crime is a concrete problem to be handled in the existing justice system. Punishment for rape often causes inequality for its victims because the existing punishment is considered disproportionate to the losses experienced by the victim. This paper qualitatively analyzes the judge's considerations and the application of punishment in the crime of ongoing rape based on the decision of the Surakarta District Court Number 8/Pid.B/2024/Pn.Skt. This paper applies the normative legal method with a case approach from the decision of the Surakarta District Court which shows that the judge's considerations are based on legal, philosophical, and sociological aspects. In the decision, the application of Article 285 and Article 64 paragraph (1) of the Criminal Code is relevant but the application of the threat of punishment is not optimal.
