TRADISI PEMBERIAN MAHAR PADA ‎MASYARAKAT BATAK KARO SUMATERA ‎UTARA PERSPEKTIF HUKUM ISLAM Jejen, Jejen

Abstract

This is a field research which focuses to answer two problems: first, how is the tradition of giving dowry by the people of Batak Karodi, Jaranguda-Merdeka-Batak Karo? Second, how is the Islamic legal analysis on the tradition of giving dowry by the people of Batak Karodi, Jaranguda-Merdeka-Batak Karo? The results of the research show that giving dowry to family and relative is a kind of obligation that must be carried out by bride. Karo society assumes dowry is as a reimbursement to a girl, because after marriage, a daughter joins her husband’s surname. Thus, woman whom is married should be replaced with a nominal. The provision of money or dowry by the Karo people is done in two steps: First, the provision of dowry from groom to bride done at the time of a legal ceremony. Second, the dowry of the groom is then given by bride to relatives who belong to the elements of rakut si telu. It is done in a ritual party. Based on the perspective of Islamic law, such tradition is not a part of Islamic law, because in Islam, dowry is an absolute right of woman and there is no obligation to give dowry to anyone. Moreover, giving dowry to family, in Islamic law, is only the extent of permitted rather than a liability.Penelitian ini merupakan penelitian lapangan (field research), yang dilakukan untuk menjawab dua permasalahan:Pertama, bagaimana deskripsi tradisi pemberian mahar pada masyarakat Batak Karo di Desa Jaranguda Kecamatan Merdeka Kabupaten Karo. Kedua, Bagaimana analisis hukum Islam terhadap tradisi pemberian mahar pada masyarakat Batak Karo di Desa Jaranguda Kecamatan Merdeka Kabupaten Karo. Hasil penelitian menunjukkan, bahwa pemberian mahar kepada keluarga atau kerabat merupakan suatu kewajiban yang harus dilakukan oleh pengantin perempuan. Masyarakat Karo mengasumsikan mahar sebagai alattukor (uang ganti) anak perempuan, karena setelah perkawinan, anak perempuan ikut marga suaminya. Jadi, perempuan yang menikah harus diganti dengan uang atau nominal harga. Pemberian mahar bagi masyarakat Karo dilakukan dengan dua tahapan: Pertama, pemberian mahar dari pengantin laki-laki kepada pengantin perempuan yang dilakukan pada saat akad nikah secara yuridis. Kedua, mahar dari pengantin laki-laki tersebut selanjutnya diberikan oleh pengantin perempuan kepada kerabat yang termasuk kedalam unsur rakut si telu. Pemberian mahar kepada keluarga dan kerabat perempuan dilaksanakan pada saat pelaksanaan ritual pesta adat yang dipandang lebih sakral. berdasarkan perspektif hukum Islam, tradisi di atas bukan merupakan bagian dari ketentuan hukum Islam, karena dalam Islam mahar merupakan hak mutlak perempuan dan tidak ada kewajiban untuk memberikan mahar kepada siapa pun, karena pemberian mahar kepada keluarga dalam hukum Islam hanya sebatas kebolehan bukan suatu kewajiban.Kata Kunci : Hukum Islam, Pemberian Mahar, dan Batak Karo.

Abstract

This training activity is part of the service program of the lecturers of the Indonesian Education Institute. Salawu Village is a destination for IPI Garut mathematics education teachers according to the needs in the field of education in the knowledge of new learning innovations. We offer Indonesian Realistic Mathematics Education (PMRI) as learning that can be applied in schools around Salawu, especially elementary school. The purpose of this service is to provide training to teachers in Salawu village about PMRI. The service method used is the method of community education, consultation, and training that involves demonstrations. Data on community service activities including photos of activities, answers to questionnaires and questions by participants. The number of participants who attended 25 people consisting of elementary school teachers and prospective PLP student candidates for teacher candidates in Salawu village. The result of this training is PMRI which can be well translated and can be applied by the teacher in his class immediately.
