Abstract

Kehadiran wirausaha di Indonesia saat ini penting dengan melihat keadaan perekonomian di Indonesia sedang mengalami ketidakpastian dan dinamika perekonomian global. Beberapa sektor usaha berkembang pesat seiring meningkatnya aktivitas kewirausahaan yang mengakibatkan adanya pertumbuhan perekonomian di Indonesia. Pertumbuhan perekonomian Indonesia ditandai dengan berkurangnya tingkat pengangguran. Berkurangnya Tingkat pengangguran di Indonesia merupakan salah satu dampak dari Kewirausahaan. Hal ini dikarenakan kewirausahaan merupakan hasil kreatifitas yang produktif yang memiliki nilai ekonomi, dengan begitu secara tidak langsung dapat membuka lapangan pekerjaan dan menciptakan kesejahteraan Masyarakat. Pada level mahasiswa dimana sedang mengalami fase pertumbuhan serta perkembangan yakni usia 16—30 Tahun sesuai yang tertuang di Undang-Undang Nomor 40 Tahun 2009 yang dinilai penting diberikan bekal ilmu kewirausahaan Ditingkat Universitas. Tujuan penelitian ini adalah diperlukan Peran penting dari Universitas dengan para praktisi mengajar kewirausahaan dalam membangun ekosistem kewirausahaan. Metode penelitian ini menggunakan doctrinal, dengan pendekatan peraturan perundang-undangan (statute approach). Hasil dari penelitian ini adalah praktisi pengajar kewirausahaan sebagai kepanjangan tangan dari Universitas menjadi kunci utama munculnya para wirausahaan baru dengan membawa pengalaman dan pengetahuan mengenai ilmu kewirausahaan yang dijadikan bekal setelah selesai masa perkuliahan. Kesimpulan dari penelitian ini adalah universitas memiliki peran penting dalam membangun ekosistem kewirausahaan pemuda sesuai dalam Peraturan Menteri Pemuda dan Olahraga RI Nomor 1 Tahun 2023. Dengan begitu akan banyak melahirkan wirausahaan-wirausahaan muda yang kreatif serta inovatif yang siap menghadapi tantangan di era globalisasi.

Abstract

Insurance functions as a risk management instrument that provides legal protection and certainty of rights for policyholders. However, in practice, the implementation of the Financial Recovery Plan (Rencana Penyehatan Keuangan/RPK) at AJB Bumiputera 1912 raises significant legal issues concerning the fulfillment of policyholders’ rights, particularly through the Policy Benefit Reduction (Penurunan Nilai Manfaat/PNM) scheme, which potentially disadvantages policyholders.This study aims to analyze the legal certainty of policyholders within the implementation of the RPK and to examine the available forms of legal protection. The research employs a normative juridical (doctrinal) method using statutory and conceptual approaches, supported by theories of legal certainty, insurance contracts, and risk transfer. The findings indicate that the implementation of the RPK has not provided adequate legal certainty for policyholders, as reflected in the suboptimal realization of the company’s financial obligations and the gap between projected and actual debt settlement outcomes. Furthermore, the application of the PNM scheme has created legal complications, particularly for policyholders who reject the scheme, resulting in the loss of membership status and limited participation in governance mechanisms, such as the election of the Policyholders’ Representative Body (BPA). This study highlights the existence of significant legal protection gaps for policyholders, emphasizing the need for stronger regulatory frameworks, more effective supervision, and dispute resolution mechanisms that ensure fairness and legal certainty within the insurance sector.Keywords: Legal Certainty, Policyholders, Mutual Insurance, Financial Recovery Plan

Abstract

Background: Every person has the right to own a domain name based on the principle of first come first served registration. However, cybersquatting occurs when domain names are registered earlier using registered trademarks or other well-known names, causing harm and violating the rights of others. Cybersquatting poses legal issues because perpetrators exploit weaknesses or gaps in the first-come, first-served principle, which does not involve substantive examination. The principle of good faith plays an important role in protecting those harmed by domain name registrations under the law, especially considering that Indonesian legislation has not yet specifically regulated cybersquatting. Research Metodes: This research employs a doctrinal research method, which involves examining legal principles, norms, doctrines, and relevant statutory provisions, both from primary and secondary legal sources, to answer the research questions raised in the study. Findings: This research shows that, besides the Law on Information and Electronic Transactions, the principle of good faith in the context of domain names is also found in several other regulations, namely the Trademark Law, Uniform Domain Name Dispute Resolution Policy (UDRP), and PANDI Policy. Referring to these regulations, the principle of good faith has specific forms and limitations that can serve as benchmarks to assess whether the process of registering and using a domain name violates good faith, where violations of this principle may be indicated as acts of cybersquatting. Good faith can be used as a legal protection instrument to prevent and resolve cybersquatting, even though there is no specific regulation regarding cybersquatting in Indonesia. However, prevention still needs improvement because the domain name registration system lacks substantive examination related to trademarks, thus leaving opportunities for domain registrations that potentially infringe on the trademark rights of others. Conclusion: There is a need to establish a stricter examination mechanism within the domain name registration system to prevent cybersquatting from occurring at the initial stage of registration. Given the strong correlation between domain names and trademarks, the absence of a trademark-linked examination process allows the registration of domain names that may potentially conflict with the trademark rights of other parties. This measure would also serve to strengthen the authority of registrars and registries to reject domain name applications that do not meet the requirements of good faith, thereby helping to prevent acts of cybersquatting.
