Abstract

The banking industry in its development in Indonesia is inseparable from the problems of the problem. The problems are caused by not understanding regulations in banking practices, such as regulation on Know Your Customer Principle.Know Your Customer Principle regulated in Bank Indonesia Regulation No. 5/23/PBI/Tahun 2003, dated October 23, 2003 is one attempt to realize the prudential principle which is a legal principle in the Banking Act. Thus, the importance of Know Your Customer Principle so that the application does not just apply nationally, but internationally as well. Even recommended by the Basel Committee on Banking Supervision, which is contained in the organizational committee of the Bank for  International Settlements.Know Your Customer Principle is not only related to “the healthiest” of a bank, but also beneficial to prevent the occurrence of suspicious transactions from customers that lead to the act of money laundering.Keywords: Legal Principle - Know Your Customer Principle - Principle of prudential

Abstract

Indonesia is a country that has ratified the 1981 New York Convention through Presidential Decree Number 34 of 1981, so that foreign or international arbitral awards can be implemented in Indonesia after being registered by the arbitrator or his proxy at the Central Jakarta District Court. Advocates can be appointed as attorney for arbitrators to register international arbitral awards. However, currently there are still few Indonesian advocates who understand the registration and implementation of international arbitral awards in Indonesia. We organize national seminars on arbitration socialization or training, particularly on the registration of foreign arbitral awards. This socialization implementation  was designed using a partner participation approach as socialization and training participants. After attending the outreach seminar, the advocates understood and mastered the process of registering international arbitral awards in Indonesia.

Abstract

Penelitian ini bertujuan mendalami peran penerjemah tersumpah (sworn translator) dalam kontrak dagang internasional. Pengalihbahasaan naskah-naskah kontrak kerja sama bisnis internasional sepatutnya dilakukan penerjemah tersumpah karena penerjemahan naskah-naskah penting tersebut memerlukan kecermatan dan akurasi tinggi.   Penerjemah tersumpah pasti sudah lulus dari berbagai ujian atau saringan yang sangat ketat. Akurasi penerjemahan tak bisa ditawar-tawar lagi karena kekeliruan penerjemahan pasti akan menjadi masalah besar dalam proses dagang atau bisnis, apalagi pada level internasional. Hal lain yang diharapkan dari penerjemah tersumpah ialah kemampuannya menjaga rahasia institusi atau perusahaan. Selain itu, penerjemah tersumpah juga memiliki kode etik yang harus ditaati dan selama ini jarang terjadi pelanggaran atas kode etik tersebut. Hasil kerja para penerjemah tersumpah pun bernomor, dicap oleh penerjemah tersumpah, dan dilaporkan ke Kementerian Hukum dan HAM (Kemenkumham) sehingga pertanggungjawabannya lebih terjamin. Penelitian ini menggunakan metode deskriptif-analitis dan yuridis-normatif dengan  menggunakan data kepustakaan (library research) dan wawancara (interview) dengan ahlinya (purposive sampling). Wawancara dilakukan dengan mengundang seorang penerjemah tersumpah yang juga ketua umum Himpunan Penerjemah Indonesia (HPI) dalam diskusi kelompok terpumpun (focus group discussion/FGD) secara hibrid. Penerjemah tersumpah tersebut sangat berpengalaman dan kemampuannya pun sudah sangat teruji. Intinya, peran penerjemah tersumpah makin diperlukan dalam era globalisasi ini karena makin banyak naskah perjanjian dagang internasional yang harus dialihbahasakan secara akurat dan sahih untuk menjaga keberlangsungan bisnis secara internasional.Kata Kunci: Penerjemah, Tersumpah, Kontrak, Dagang, Internasional This research aims to explore the role of sworn translators in international trade contracts. The translation of international business cooperation contract texts should be carried out by sworn translators because translating these important texts requires high precision and accuracy. Sworn translators must have passed various very strict tests. Translation accuracy is non-negotiable because translation errors will definitely become a big problem in trade or business processes, especially at the international level. Another thing that is expected from a sworn translator is the ability to maintain institutional or company secrets. Apart from that, sworn translators also have a code of ethics that must be adhered and so far violations of this code of ethics have rarely occurred. The work of sworn translators is also numbered, stamped by the sworn translator, and reported to the Ministry of Law and Human Rights so that accountability is more guaranteed. This research uses descriptive-analytical and juridical-normative methods using library research and interviews with experts (purposive sampling). The interview was conducted by inviting a sworn translator who is also the chairman of the Indonesian Translators Association (HPI) in a hybrid focused group discussion (FGD). This sworn translator is very experienced and his abilities have been highly tested. Apart from that, input and suggestions from the audience who are very interested in the work of sworn translators are also accommodated. In essence, the role of sworn translators is increasingly necessary in this era of globalization because more and more international trade agreement texts must be translated accurately and validly to maintain international business continuity.Keywords: Sworn, Translator, International, Trade, Contract

Abstract

This article aims at determining, describing, and analyzing the application of intellectual property rights through mediation & arbitration from the perspective of Indonesian law and its practice in the Arbitration Regulations of the Indonesian National Arbitration Board. Intellectual Property dispute resolution among the disputing parties by mediation and arbitration (out-of-state court settlement) has not been effective because of limited and lack of socialization from the Government or mediation and arbitration institution. The resolution of IPR disputes has not been effective, this is evident from the results of discussions with the DJKI and the West Java Kanwilkumham, which are still few IPR cases that have been registered to be resolved. Likewise, very few IPR cases have been submitted to the Dispute Resolution Institution.

Abstract

Arbitration is a mechanism for resolving civil disputes outside traditional courts, governed by a written arbitration agreement between the disputing parties. Limited to commercial and specific disputes like banking, an arbitration tribunal, consisting of arbitrators, hears and decides these matters. In Indonesia, Law Number 30 of 1999 states that the appointment of two arbitrators grants them authority to select a third. Meanwhile, Russian laws, such as Federal Law No. 382-FZ and Law No. 5338-1, empower the Nomination Committee of Permanent Arbitration to appoint a third arbitrator from an approved list. This article employs a normative juridical method with a comparative law approach to scrutinize the selection and appointment of a third arbitrator according to Indonesian and Russian law. Qualitative analysis reveals that, under certain circumstances, all three arbitrators may be appointed by the Nomination Committee or even the general jurisdiction court, as outlined in the Russian International Commercial Arbitration Court's regulations. The article underscores the importance of providing legal certainty to disputing parties, empowering arbitrators, and avoiding conflicts that could impede dispute resolution. By shedding light on the appointment process, this research aims to contribute to the efficacy of arbitration as a judicious alternative for resolving disputes.

Abstract

Tidak dapat dipungkiri bahwa dalam kehidupan bermasyarakat sering terjadi permasalahan atau sengketa. Permasalahan dalam kehidupan masyarakat banyak terjadi pada berbagai lini di kehidupan masyarakat yaitu kegiatan ekonomi dan bisnis. Yang umumnya menjadi akar dari munculnya permasalahan atau sengketa adalah perbedaan terhadap pendapat, benturan dari kepentingan, hingga rasa takut dirugikan. Penyelesaian sengketa pada dunia bisnis umumnya dilaksanakan dengan menggunakan cara litigasi atau penyelesaian sengketa melalui pengadilan. Namun disamping penyelesaian sengketa melalui proses pengadilan, terdapat pula penyelesaian sengketa melalui non litigasi atau di luar pengadilan. Penyelesaian melalui non litigasi atau di luar pengadilan ialah penyelesaian sengketa yang dilakukan menggunakan cara-cara yang ada di luar pengadilan atau menggunakan lembaga alternatif penyelesaian sengketa. Pasal 1 Undang-Undang Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa menyebutkan bahwa Arbitrase adalah cara untuk menyelesaikan suatu permasalahan perdata diluar peradilan umum yang didasarkan oleh perjanjian arbitrase yang dibuat secara tertulis oleh para pihak yang bersengketa.
