Abstract

Gambling is basically a game where there are parties who bet each other to choose one choice among several choices where only one choice is correct and being a winner means that the player who loses the bet will give the bet to the winner. Gambling rules and bets are determined and agreed before the match starts. Talking about "Gambling" which is forbidden by religion, is also expressly prohibited by positive law. This can be seen from the provisions of article 303 of the Criminal Code, Jo. Law No.7 of 1974 concerning Control of Gambling Jo. PP.No. 1981 Jo. Presidential Instruction and Minister of Home Affairs Instruction No.5, April 1, 1981. The type of research used in writing this thesis is to use normative legal research methods. Normative legal research is research that studies the study of documents, namely using various secondary data such as statutory regulations laws, court decisions, legal theories, and can be in the form of opinions of scholars. As for efforts to prevent gambling so that it can be overcome, it is desirable for religious leaders and law enforcers to often conduct socialization such as lectures at places of worship so that they are aware that gambling is prohibited in any form.

Abstract

The crime of trafficking in persons (human trafficking) is a very complex crime so it is difficult to eradicate. However, attention to trafficking in persons is more focused on women as vulnerable groups in this discussion (women trafficking). The purpose of this study is to see more clearly that there is still a link between the crime of commercial sex worker service providers with the crime of trafficking in persons. The method of approach that the authors take in this research is descriptive qualitative. The underlying factors are economic, family, religious, lack of awareness, the desire to get rich quickly. The legal provisions in Law Number 21 of 2007 concerning the Criminal Act of Trafficking in Persons have been supplemented with implementing regulations, namely Government Regulation Number 9 of 2008 concerning Procedures and Mechanisms for Integrated Services for Witnesses and / or Victims of Trafficking in People in Article 1 paragraph 1 and Presidential Regulation No. 69/2008 concerning the Prevention and Handling of Criminal Acts of Trafficking in Persons Article 4. Legal Analysis that the Defendant is proven guilty of committing a crime "intentionally as a livelihood or habit of committing or facilitating obscene acts with others" and the Defendant has become a pimp by providing women who are trafficked for sexual services so that the Defendant benefits from these actions.

Abstract

Tindak pidanaterorisme adalah suatu bentuk penggunaan kekerasan  yang dilakukan oleh seseorang atau suatu kelompok yang terorganisir, yang  ditujukan terhadap  masyarakat sipil,  tempat-tempat umum maupun  fasilitas yang menyangkut kepentingan publik, dengan menggunakan kekerasan, ancaman atau bentuk intimidasi lainnya,yang dapat mengakibatkan hilangnya nyawa orang lain, rusaknya  harta benda serta  hancurnya fasilitas dan sarana publik,  untuk mencapai tujuan- tujuan yang bersifat ideologi, politik atau keagamaan.Tindak terorisme tidak dapat disejajarkan dengan kejahatan biasa. Terorisme mengarah kepada kejahatan terhadap kemanusiaan karena perbuatan yang dilakukan dilakukan secara meluas atau sistematis, mematikan atau menewaskan jumlah korban yang banyak dengan cara cara yang tidak berperikemanusiaan. Terorismetelah menjadi ancaman terhadap kehidupan umat manusia sehingga diperlukan suatu lembaga peradilan yang khusus untuk mengadili tindak pidana terorisme  dengan  cara – cara yang khusus pula.Upaya peradilan kejahatan terorisme  sebaiknya dilaksanakan di Pengadilan Pidana Internasional karena terorisme telah menjadi kejahatan internasional yang telah dikriminalisasi oleh negara negara lainnya.

Abstract

Hak Asasi Manusia (HAM)  merupakan hak – hak yang dimiliki oleh setiap manusia tanpa memandang perbedaan ras, warna kulit, gender,suku,agama bahasa, jenis kelamin, agama, dan politik. HAM secara hukum dijamin dalam hukum HAM yang melindungi individu-individu atau kelompok dari  tindakan-tindakan yang melanggar kebebasan serta harkat  dan martabat manusia. Salah satu instrument dari hukum HAM yang digunakan sebagaipedoman bersama dalam melaksanakan norma-norma HAM  adalah Deklarasi Universal Hak Asasi Manusia tahun 1948 yang dirumuskan oleh PBB dan  ditaati sebagai norma internasional oleh negara-negara di seluruh dunia. Dalam rangka menegakkan HAM pemerintah Indonesia telah mengeluarkan UU No. 39 tentang HAM dan UU No. 26 tahun 2000 tentang  Pengadilan HAM. Salah satu persoalan yang  masih mengganjal selama bertahun-tahun adalah penyelesaian  kasus-kasus pelanggaran HAM di Indonesia. Seiring dengan perkembangan demokrasi, maka salah satu tuntutan yang mendesak di era pemerintahan Jokowi adalah bagaimana upaya perlindungan dan penegakan hukum di dalam menyelesaikan berbagai kasus pelanggaran HAM yang selama ini terbengkalai karena  belum adanya  keseriusan dan kesungguhan pemerintah untuk menyelesaikan kasus-kasus tersebut. Upaya perlindungan dan penegakan hukum terhadap HAM  merupakan salah satu kewajiban Negara terhadap rakyat Indonesia dalam menjamin pelaksanaan hak-hak yang fundamental.

Abstract

Default is a condition where the debtor does not carry out his obligations that have been specified in the agreement. In addition to not carrying out its obligations as specified in the agreement, default can also occur where the debtor does not carryout his obligations asstipulated in the law. Research method used is normative yuridicial research, the nature of the research used is descriptive, data collection technique is with do library research and interviews. The results of the study default lawsuit against state owned enterprise on land and buildings sale agreement disputes because where Sumurung Siregar wanted to buy the official house he once occupied but when the installment of the house wascompleted the Director of PT.PLN did not reverse the deed of the official house to the name of Samurung Siregar. So that in this sale and purchase agreement the judge judges by listening to witness statements and examining the existing evidence. From research conducted it can be concluded that the cause of default is that in resolving the default dispute, deliberation must first be carried out so as not to harm the parties if they do not get a solution then go to court.

Abstract

Traffic violations cannot be left alone because based on available data most of the occurrence of traffic accidents are caused by the human factor of road users who do not comply with traffic regulations but there are still many causes outside of human factors such as broken tires, failed brakes, roads holes and so on. The problems in this study are criminal threats against traffic violations due to negligence resulting in the death of others, what factors cause negligence in traffic accidents that result in other people's death and law enforcement efforts against traffic offenders due to negligence causing death.The research method uses a type of empirical normative law. The nature of the research used is descriptive analysis. Data collection techniques using library research and field studies. Data analysis used qualitative analysis.The results of the study that the cause of negligence in traffic accidents that resulted in other people's death in the form of human negligence factors, inappropriate vehicle factors resulting in accidents, weather factors could not determine it then the road factor where it was damaged there would be many traffic accidents. Law enforcement provided in the form of preventive or preventive and repressive. The conclusion that the criminal threat to traffic violations due to negligence resulting in the death of another person is regulated in Article 359 of the Criminal Code for a maximum imprisonment of five years or a maximum confinement of one year and criminal sanctions are regulated in Article 310 Paragraph (4) of Law No. 22 of 2009 concerning Road Traffic and Transportation is a criminal offense for 6 (six) years. Factors that cause negligence in traffic accidents that cause other people to die are human factors, vehicle factors, weather factors, and road factors. Efforts to enforce the law against traffic violations due to negligence causing death, one of which is prevention and repressive efforts.

Abstract

In Indonesia itself, it has imposed a ban on possessing sharp weapons that can injure other people or even actions that are carried out under the pretext of self-protection. The use of sharp weapons for which the designation is not clear has the potential to lead to acts or criminal acts that are classified as crimes. The method used in this study is normative juridical, namely a research method that examines document studies, namely by using various data such as legislation, legal theory of court decisions. Indonesia Number 12 of 1951 Article 2 paragraph (1) which states that whoever carries, controls, keeps, hides, uses a stabbing weapon, or stabbing weapon, is punished with a maximum prison sentence of ten years and criminal law enforcement against perpetrators of crimes without rights. Bringing Sharp Weapons Based on Decision No. 3058/Pid.Sus/2021/PN.Mdn can be known by the judge's verdict which gave a criminal sentence of 10 (ten) months in prison.

Abstract

Spiritualism and pluralism are two different things but are related to one another. In spiritualism, the soul or spirit becomes a supporting medium for the existence of spiritualism by believing in God as the creator of the entire universe which causes the emergence of a relationship between humans and their God. Pluralism prioritizes diversity and differences in various aspects of society's life. This study will highlight the two objects, namely spiritualism and pluralism as a reality in modern and complex societal life. The results of this study show that the role of spiritualism and pluralism can be a solution in resolving conflicts between modern and complex societies by implementing them based on spiritual values which are based on belief in the Almighty God and pluralism values which respect differences in society and at the same time become a filter for various challenges in the life of a pluralistic society.

Abstract

Forced marriages are frequent in Indonesia for several reasons, including economics and culture. In reality, practically all South Asian countries have the same problem, with poverty and tribal animosity frequently being used to force certain adolescents to marry. The purpose of this study is to examine women’s rights in the context of family law in avoiding forced marriage, as well as to examine law enforcement against forced marriage from a family law viewpoint. This research uses normative legal methods with statutory, conceptual, case, and comparative approaches. The findings reveal that respect for and implementation of women’s rights have been included in various legal instruments, both at the international and state levels. The protection of women’s rights is critical for achieving substantive justice and avoiding forced marriage. However, the combination of social, cultural, and legal concerns continues to challenge law enforcement. As a result, a family consultancy institution in partnership with the judiciary is required, similar to Australia, which has a Family Court to address instances such as forced marriage. With consultants who understand family matters and are experts in their fields, the settlement of cases of forced marriage through non-litigation is expected to be more effective, where the results of the decision can be determined by the court, as is the practice in Australia.
