Abstract

The concept of Restorative Justice is an alternative settlement of criminal cases in which, in criminal justice procedures, the focus of punishment is shifted to a mediation or deliberation process involving several parties, including the perpetrator, victim, family of the perpetrator or victim, and other related parties, where the principle of one crime in the Criminal Code (KUHP) is the crime of rape regulated in Article 285 of the Criminal Code which is a form of crime against decency. The purpose of the research is to review the perception errors in the application of the principles of restorative justice to the crime of rape to provide a direction for change regarding the principles of restorative justice in the crime of rape. The study comes to the conclusion that restorative justice must prioritize ensuring the rights of rape victims are upheld rather than being applied in a way that reconciles the victim and the offender. The TPKS Law, which governs rape law enforcement in Indonesia, ensures that victims' rights are protected in terms of handling rights, protection issues, and recovery rights. The punishment meted out to those who commit the crime of rape is a way of holding them accountable for their deeds.

Abstract

Responsibility means being imposed on the perpetrator of a criminal offense relating to the basis for imposing criminal sanctions. Children as perpetrators of criminal acts, also known as children in conflict with the law, are children who have committed acts which according to criminal law are prohibited and criminal sanctions will be given to the perpetrator. Provisions in criminal law related to criminal responsibility state that children as criminal perpetrators are considered incapable of being responsible for their actions. The formulation of the problem in this research is: 1) how is criminal law related to the judge's legal considerations in decision Number 1/Pid.Sus-Anak/2020/PN.Mjn 2) What is the legal protection for children as perpetrators of criminal acts? This research uses a descriptive-qualitative research method using a juridical-normative approach. The research results obtained show that the criminal responsibility of children as perpetrators of criminal acts refers to the provisions regulated in the Juvenile Criminal Justice System Law, where when children as perpetrators of criminal acts are over 12 years old and not yet 18 years old, they must go through diversion efforts. In Decision Number 1/Pid.Sus-Anak/2020/PN.Mjn, the panel of judges decided on 6 months of training at a Job Training Center with the consideration that the child's actions were a repetition of a criminal act. The form of protection given to children who commit criminal acts is to prioritize the best principles for children.

Abstract

Berdasarkan data statistik Sistem Informasi Online Perlindungan Perempuan dan Anak (SIMFONI PPA) Kementrian Pemberdayaan Perempuan dan Perlindungan Anak (KemenPPPA) sepanjang tahun 2023 terdapat 12.094 kasus kekerasan, 9.953 kasus korbannya adalah perempuan, 4.962 mengalami kekerasan seksual, 3.706 kekerasan fisik, 3.508 kekerasan psikis, 1.088 kasus penelantaran, dan    kekerasan-kekerasan lainnya. Selama ini, penegakan hukum kekerasan seksual terhadap anak hanya menekankan aspek pemberian sanksi pelaku dan kurang memperhatikan pemenuhan hak korban. Padahal korban membutuhkan penganganan, perawatan dan pemulihan dari akibat perbuatan tersebut. Untuk itu, artikel ini fokus mengurangai hak-hak anak sebagai korban kekerasan seksual dan implikasi yuridis yang ditimbulkan Undang-Undang No. 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual. Menggunakan metode penelitian hukum Yuridis Normatif. Disahkannya Undang- Undang No.12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual ini   merupakan upaya pembaharuan hukum serta mengatasi permasalahan     dalam perlindungan hukum terhadap perempuan dan anak yang rentang menjadi korban kekerasan. Pemberian restitusi kepada korban diatur dalam beberapa regulasi salah satunya UU TPKS akan tetapi pemberian restitusi hanya bisa dilakukan apabila korban mengajukan permohonan. Kata Kunci: Restitusi, Perlindungan Anak, Kekerasan Seksual

Abstract

Stunting is a chronic nutritional problem that has a multidimensional impact on the quality of human resources. This study aims to identify strategies to reduce stunting in the KB Village of Palipi Soreang Village, Majene Regency, as a priority area in West Sulawesi. Using a qualitative approach and case study method, data were collected through in-depth interviews, FGDs, participatory observation and documentation. The results showed the significant success of Palipi Soreang Village in reducing the prevalence of stunting through strengthening village regulations, activating Posyandu and the Family Assistance Team, and involving village youth. These strategies are effective when combined with nutrition education, early marriage supervision, and inter-sectoral synergy. This study recommends the integration of stunting interventions into village development policies based on the Islamic family law approach, as well as cadre empowerment and merit-based incentives.

Abstract

This study aims to analyze in depth how the practice of polygamy in Majene Regency affects the fulfillment and protection of women's rights in the context of family law. This research is a descriptive qualitative research in understanding the practice of polygamy in Majene Regency and its impact on the fulfillment and protection of women's rights. Primary data, namely data obtained directly from four informants, namely (a) Wife in polygamous marriage, (b) Daughter from polygamous marriage, (c) One of the Women's Institutions in Majene Regency, (d) Religious Leaders in Majene Regency. Meanwhile, secondary data comes from documents or literature related to the object of research. Data collection techniques include interviews, observations and documentation studies. Data analysis was carried out thematically through the stages of reduction, presentation, and drawing conclusions. The results of the study show that the practice of polygamy in Majene Regency has a significant impact on the fulfillment and protection of women's rights, especially first wives, in the context of family law. Although there are clear legal rules, their implementation is still constrained by low legal awareness, weak supervision, and a strong patriarchal culture that places women in subordinate positions. In addition, children from polygamous families also experience emotional impacts due to the inequality of parental attention, which has so far received less attention in legal policies. Therefore, a more holistic and gender-perspective legal approach is needed that not only focuses on formal aspects, but also considers social, cultural, and psychological factors to realize fair and comprehensive legal protection for all family members.
