Abstract

In accordance with the provisions in the articles of the 1945 Constitution of the Republic of Indonesia, it can be said that customary law is recognized for its existence or existence as long as the customary law is still alive and in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia. This research method uses a descriptive research method using a sociological empirical research approach, namely research carried out through field research at the Palakka District police office, as a provider of justice for every problem that occurs in the community, especially in cases of criminal acts. Child theft which was resolved according to custom. This research uses a normative juridical research type, namely research that uses library methods to produce secondary data as main data and basic data, while primary data is in conservative form and interviews as complementary data. So the obstacle encountered by investigators is the very short time factor for the examination process. Of course, with this the problem arises that actually uncovering cases of theft with violence committed by children is quite difficult, especially if the perpetrator carries out the action not alone but in a group. External obstacles are generally technical obstacles, for example because the residence of the perpetrator and witnesses is far from the place of investigation. If in this case there is more than one perpetrator, whose residence is different, then investigators must also often adjust the investigation time.

Abstract

This research aims to investigate factors that cause the occurrence of violent crimes against children. The data obtained in this research analyzed qualitatively using a descriptive approach (descriptive research) to describe the data obtained, then interpretation and conclusions provided. The results of the research found that Lack of supervision by parents, lack of awareness of children to resolve problems through deliberation, many groups of children are emerging. Meanwhile, efforts made by the police to tackle violent crimes against children in Bone Regency include: Guidance, Peace Efforts, Counseling, Patrols. Providing education to families about the importance of monitoring children so that their children do not become victims of crime or perpetrators of crime. Providing continuous legal education considering the important role of society in preventing crime, especially violent crimes against children.

Abstract

Customary law and the rights of indigenous peoples have an important role in maintaining cultural identity and local wisdom, especially in Indonesia, which has a diversity of customs. However, in the era of globalisation, customary law faces various challenges, from the legal, economic and social aspects. This article explores how customary law and the rights of indigenous peoples are trying to remain relevant amidst the influences of modernisation, globalisation, and harmonisation with national law. The research uses a qualitative approach by analysing several cases in different regions, which shows that the process of globalisation often results in the erosion of customary law, marginalisation of indigenous peoples, and exploitation of natural resources in indigenous territories. The findings also highlight the importance of recognising and protecting customary law in state regulations, as well as the need to strengthen the rights of indigenous peoples in order to adapt and remain resilient in the face of global challenges. Thus, strengthening customary law in the national legal system is essential to create a balance between modernity and tradition.

Abstract

Between humans and their environment there is a dynamic relationship. Changes in the living environment will cause changes in the physical and psychological conditions of humans to adapt to new conditions. Changes in the human condition will in turn cause changes in the environment. Thus, it can be said that not only the environment can affect humans, but humans can also be the main and dominant factor influencing the environment, so that human awareness is needed for their own environment. This is done in order to obtain a good environment and in accordance with human needs, so that the dynamic relationship between humans and their environment will be maintained. The method of this community service is the counseling method in the form of direct presentation of lecture material to 5 respondents using leaflets and browser media. This community service as a whole is very effective, so that an increase in knowledge is obtained after counseling on the Criminal Act of Granting Business Permits by Officials Without Completed Environmental Permits.

Abstract

Hukum adat merupakan salah satu sumber hukum positif yang ada di Indonesia saat ini. Setiap daerah di Indonesia memiliki hukum adat sendiri. Setiap daerah juga memiliki identitas tersendiri yang mewakili daerahnya. Namun perbedaan tersebut tidak menjadi pemecah Negara Kesatuan Republik Indonesia (NKRI). Anak memiliki sistem penilaian kanak-kanak yang menampilkan martabat anak sendiri dan kriteria norma tersendiri, sebab sejak lahir anak sudah menampakkan ciri-ciri dan tingkah laku karateristik yang mandiri. Tindak pidana yang dilakukan oleh anak terutama karna faktor perekonomian keluarganya yang rendah, terlantar, pengaruh pergaulan yang buruk atau karena putus sekolah. Tujuan pengabdian ini dilakukan sebagai sarana untuk memberikan edukasi kepada Masyarakat tentang peran hukum Adat sebagai bentuk upaya mencegah dan meminimalisir serta menanggulangi kejahatan atau tindak pidana Anak dibawah Umur. Hukum adat pada dasarnya merupakan sebagian dari adat istiadat masyarakat. Adat istiadat mencakup konsep yang sangat luas.sehingga perlu diketahui oleh Masyarakat mempunyai peranan dalam membina Anak dibawah umur. Kegiatan Pengabdian Masyarakat ini dilakukan dengan mengerakkan Masyarakat untuk melakukan upaya pencegahan kejahatan dan tindak pidana diantaranya kejahatan kekerasan terhadap anak. Kegiatan ini dilakukan 3 Tahap yaitu Fokus Grup Discusion ( FGD ), sosialisasi kebijakan hukum kekerasan pada anak dibawah umur dan kesepakatan dalam komitmen bersama guna membina Masyarakat untuk patuh pada Hukum Adat Hasil pengabdian ini menghasilkan kesepakatan untuk menyelesaikan permasalahan melalui musyawarah untuk menghasilkan suatu Keputusan yang tidak bertentangan dengan Hukum Adat.
