Abstract

Hukum adat merupakan salah satu sumber hukum positif yang ada di Indonesia saat ini. Setiap daerah di Indonesia memiliki hukum adat sendiri. Setiap daerah juga memiliki identitas tersendiri yang mewakili daerahnya. Namun perbedaan tersebut tidak menjadi pemecah Negara Kesatuan Republik Indonesia (NKRI). Anak memiliki sistem penilaian kanak-kanak yang menampilkan martabat anak sendiri dan kriteria norma tersendiri, sebab sejak lahir anak sudah menampakkan ciri-ciri dan tingkah laku karateristik yang mandiri. Tindak pidana yang dilakukan oleh anak terutama karna faktor perekonomian keluarganya yang rendah, terlantar, pengaruh pergaulan yang buruk atau karena putus sekolah. Tujuan pengabdian ini dilakukan sebagai sarana untuk memberikan edukasi kepada Masyarakat tentang peran hukum Adat sebagai bentuk upaya mencegah dan meminimalisir serta menanggulangi kejahatan atau tindak pidana Anak dibawah Umur. Hukum adat pada dasarnya merupakan sebagian dari adat istiadat masyarakat. Adat istiadat mencakup konsep yang sangat luas.sehingga perlu diketahui oleh Masyarakat mempunyai peranan dalam membina Anak dibawah umur. Kegiatan Pengabdian Masyarakat ini dilakukan dengan mengerakkan Masyarakat untuk melakukan upaya pencegahan kejahatan dan tindak pidana diantaranya kejahatan kekerasan terhadap anak. Kegiatan ini dilakukan 3 Tahap yaitu Fokus Grup Discusion ( FGD ), sosialisasi kebijakan hukum kekerasan pada anak dibawah umur dan kesepakatan dalam komitmen bersama guna membina Masyarakat untuk patuh pada Hukum Adat Hasil pengabdian ini menghasilkan kesepakatan untuk menyelesaikan permasalahan melalui musyawarah untuk menghasilkan suatu Keputusan yang tidak bertentangan dengan Hukum Adat.

Abstract

Improving health is one of the national development efforts to achieve awareness, willingness and ability to live a healthy life for every resident in realizing the highest degree of public health. Clean and Healthy Living Behavior in the school environment is an effort to empower students, teachers and the school community so that they can and are willing to carry out clean and healthy living behaviors in creating a healthy school. This community service activity aims to provide education about PHBS to elementary school students in S. The method of implementing the activity is in the form of education consisting of counseling, video screening, discussion and question and answer. Participants in educational activities are students in grades 1, 2, and 3.  The material presented was washing hands with soap before and after eating, eating healthy snacks, using clean and healthy latrines, exercising regularly, eradicating mosquito larvae, not smoking in the school environment, disposing of garbage in its place, and doing community service work with school residents to create a healthy environment. This community service activity succeeded in increasing the knowledge and understanding of participants about PHBS where there was an increase in knowledge by 70%. PHBS education activities in schools can be continued in other schools as an effort to foster clean and healthy living behaviors at an early age.

Abstract

This study aims to understand the dynamics of determining men's and women's parts of inheritance; explore thoughts related to contemporary inheritance formulations and analyze from the perspective of Islamic law. This research is library research with a normative approach (syar'i) in the form of literary analysis relevant to the research object, namely the problem of determining men's and women's parts in the matter of inheritance. The Data were collected structurally through document studies to be analyzed. Data analysis uses qualitative content analysis of relevant documents or texts. As a result, determining men's and women's parts is currently experiencing dynamics 2:1 to 1:1 concept because of the influence of customary law, distribution of inheritance level of welfare, and understanding of the justice value, which has shifted from based on rights and obligations which interpreted according to the needs and conditions. The 1:1 inheritance paradigm or equal share results from the ijtihad of contemporary figures by understanding the value of justice according to social situations and conditions and gender equality. The initiators of the paradigm are Hazairin with the concept of bilateral inheritance, Munawir Sjadzali with his quantitative equation, Muhammad Syahrur, and Yahya Harahap with the concept of boundary theory. According to Islamic law, the 1:1 inheritance paradigm is not contradictory because the goal is for the common good of the heirs. In contrast, the benefit is the goal of Islamic law through the concept of maqāsiḍ sharia by paying attention to the rules of Islamic law, such as not ignoring human rights and maintaining good relations with others. Islamic law, with its flexibility that can adapt to place, time, and circumstances, has also blended with the results of contemporary ijtihad.
