Abstract

Abstract:Lack of parties or plurium litis consortium in the the Religious Court of the City of Madiun, can not only occur in a case of contention. More minor cases can also happen in case of request (volunteer). The potential voluntary issues that arise from more minor parties are the Application for Determination of Heirs (PPAW). If the claim is lacking in instances of contingent inheritance, then the case must be declared unacceptable (niet ontvankelijk verklaart). Then what if the lack of parties occurs in a voluntary case? Can the case still be granted? This article tries to answer that question. The research method used in this article is juridical-normative. The approach used is the statute approach and the conceptual approach. At the same time, the type of research is library research. The results of the study are: based on the perspective of legislation, legal objectives, legal functions, and legal principles, voluntary inheritance cases (PPAW). If not, the judge can advise on improving the application. However, if the direction for improvement is not followed up, then the application must be declared unacceptable (niet ontvankelijk verklaart). Abstrak: Kurang pihak atau plurium litis consortium dalam Pengadilan Agama khususnya Pengadilan Agama Kota Madiun tidak hanya dapat terjadi dalam perkara gugatan (contensius) saja, kurang pihak juga dapat terjadi pada perkara permohonan (voluntair). Perkara voluntair yang potensial terjadi kurang pihak adalah Permohonan Penetapan Ahli Waris (PPAW). Dalam perkara kewarisan contensius, jika gugatan kurang pihak, maka perkara tersebut harus dinyatakan tidak dapat diterima (niet ontvankelijk verklaart). Lalu bagaimana jika kurang pihak terjadi dalam perkara voluntair? Apakah perkara tetap dapat dikabulkan? Artikel ini berusaha menjawab pertanyaan tersebut. Metode penelitian yang digunakan dalam artikel ini adalah yuridis-normatif. Pendekatan yang dipakai adalah pendekatan perundang-undangan (statute aproach) dan pendekatan konseptual (conceptual aproach). Sedangkan jenis penelitiannya adalah penelitian kepustakaan (library research). Hasil penelitiannya adalah: berdasarkan perspektif aturan perundang-undangan, tujuan hukum, fungsi hukum, dan asas hukum, perkara kewarisan yang bersifat voluntair (PPAW). Jika tidak, hakim dapat memberi advis perbaikan permohonan. Namun jika arahan perbaikan tidak ditindaklanjuti, maka permohonan harus dinyatakan tidak dapat diterima (niet ontvankelijk verklaart). Kata kunci: plurium litis consortium, Permohonan Penetapan Ahli Waris, dan niet ontvankelijk verklaart.

Abstract

This paper describes and analyzes the textual-contextual h}adīth on the prohibition of women’s leadership in the public sphere. This study is a critical hermeneutic with the theory of ma‘nā-cum-maghzā, by making the literal origin (historical meaning, explicit) the starting point for understanding the central message of the text (implied meaning). The results of this paper indicate that women may become leaders in public affairs because textually and linguistically, the word lan yufliḥ, which means ‘will not be successful,’ in the h}adīth does not apply permanently (mu’abbad), but only temporally (mu’aqqat). Contextually, the h}adīth prohibited women from becoming leaders because the condition of women at the time of the h}adīth did not allow them to handle social affairs due to the lack of knowledge and experience and the existence of deceit and greed, which could happen to anyone who had ambitions of power, men as well as women. Meanwhile, nowadays, many women have the expertise, knowledge, and managerial-organizational experience to support these matters.

Abstract

This research employs critical discourse analysis of media to examine the news coverage of the Papua student riot in Surabaya.  This study analyzes how media texts and narratives apply news coverage of the incident in the Papuan Student riots in Surabaya. This study adopts a qualitative descriptive approach, utilizing Norman Fairclough's Critical Discourse Analysis as its analytical framework. Data collection methods include observation and documentation. The findings of this study indicate that the media's amplification of the Papua student riots in Surabaya reflects historical factors, situational konteks, and the hegemony of media institutions, leading to interpretative insinuation in news narratives that tend toward media-driven judgment. This tendency is reflected in headlines such as "Refusing to Hoist the Red and White Flag" and "Discovery of a Bag with the Morning Star Emblem," which historically connected to the issue of the Papuan independence movement community. The media's tendency toward insinuative or provocative reporting has exacerbated anarchic conflicts in several regions, including Manokwari, Jayapura, Fakfak, and Sorong.

Abstract

This study aims to see the idea of religious nationalism K.H. A. Wahid Hasyim on Islam and Indonesia. K.H. A. Wahid Hasyim is an interesting figure in the midst of tug-of-war between the interests of making Indonesia an Islamic state and a secular state at the beginning of the founding of Indonesia, the idea of ​​KH. A. Wahid Hasyim became the middle ground. This study raises the main question, namely how the relationship between religion and the state according to K.H. Wahid Hasyim in the Indonesian context. This research is based on text reading and had analyzed by content analysis. This study concludes that KH. A. Wahid Hasyim is consistent in Islamic thought and prioritizes the unity and integrity of the nation. According to K.H. A. Wahid Hasyim, the state serves the religious needs of the people in accordance with the Pancasila basis. In matters of an individual nature (private), the government should not interfere. Meanwhile, the state may regulate issues of a social nature (public). Kiai Wahid is of the opinion that the secularistic relationship between religion and the state is only a theory, and has never actually happened. Islam still needs the state to protect the freedom of its citizens to practice their religion, while the state needs religious legitimacy to make a set of regulations in order to achieve benefit. Thoughts K.H. A. Wahid Hasyim belongs to the category of thinkers who relate religion and state as a mutualistic symbiotic relationship, where state and religion support each other. On the same dimension, its relevance lies in its idea of ​​prioritizing common interests over personal interests. Kiai Wahid's idea of​​religious nationalism is still relevant today. Especially in the context of maintaining the relationship between the state and religion, and giving the government a share to participate in efforts to facilitate its citizens in practicing their religion.

Abstract

This study examines how Chinese Muslims in Jember, Indonesia, negotiate their unique position as an ethnic minority within a religious majority through the lens of fiqh al-siyasah (Islamic political jurisprudence). Using a qualitative approach that combines in-depth interviews with community leaders, participant observation, and documentary analysis, the research reveals three main patterns of political expression: a response of avoidance justified by the principle of preventing means to ends, an adaptive response rooted in expediency through strategic alignment with the Nahdlatul Ulama and limited individual participation. At the socio-religious level, Chinese Muslims have devised a complex dual-identity strategy that preserves Chinese cultural authenticity and Islamic orthodoxy through the creative application of the principles of custom, the distinction between custom and worship, and the architectural-ritual synthesis embodied in the Muhammad Cheng Ho Mosque. Their positions on contemporary theological-political issues—the Ahok blasphemy case, the call for a caliphate, fundamentalist movements, and Indonesian democracy—demonstrate a sophisticated application of political jurisprudence concepts, including siyasah syar’iyah, maqasid al-sharia, istihsan and istishlah. The study contributes theoretically by expanding fiqh siyasah to include ‘composite minorities’—ethnic minorities within religious majorities—and practically by showing how classical fiqh principles can provide a flexible yet sound framework for Muslim minorities navigating complex pluralistic contexts. The findings confirm that Islamic jurisprudence is inherently dynamic and contextual (rulings change with changing circumstances) and that creative cultural-religious synthesis can achieve social integration without compromising doctrinal fundamentals.

Abstract

Artikel ini membahas perubahan pelayanan publik yang dilakukan pemerintah Kota Surabaya selama pandemi COVID-19 dan dampaknya terhadap reformasi birokrasi digital pasca pandemi. Dampak Pandemi COVID-19 membuat pemerintah tanggap dalam membuat kebijakan dengan memperbarui regulasi layanan publik. Pemerintah Kota Surabaya melakukan perubahan secara signifikan sistem layanan menjadi sistem daring (online) pada sector layanan kategori layanan administrasi dan non administrasi. Penelitian ini menggunakan metode deskriptif kualitatif dengan pengambilan data melalui dokumen online dan observasi digital. Hasil penelitian menemukan perubahan pelayanan public di Kota Surabaya telah memenuhi prinsip good governance. Kota Surabaya telah berhasil penerapan sistem layanan berbasis online pada sector layana kesehatan, layanan kependudukan, lalayanan UMKM, layanan surat menyurat, pengaduan dan layanan budgeting. Program tersebut merupakan keberlanjutan yang ditingkatkan dan dikembangkan secara maksimal oleh pemerintah untuk mencegah penyebaran COVID-19. Layanan public berbasis digital yang cepat, transparan, dan efektif telah berhasil mengurangi dan menekan angka penyebaran virus COVID-19 sekaligus meningkatkan indeks Sistem Pemerintahan Berbasis Elektronik (SPBE) dengan predikat sangat baik (3,69) di tahun 2022 dan predikat memuastkan (4.54) di tahun 2024, melapaui capaian Provinsi Jawa Timur. Selain itu, layanan public berbasis online di Kota Surabaya juga berdampak pada terwujudnya partisipasi masyarakat terhadap akses layanan pemerintahan. Adanya perubahan regulasi layanan online semakin mempercepatan reformasi birokrasi tata kelola layanan publik yang akuntabel, efektif dan efisien.
