Abstract

This study examines environmental law enforcement regarding the disposal of tofu and tempeh waste into subak irrigation in the Jembrana District. The purpose of this study was to analyze environmental law enforcements regarding the disposal of tofu and tempeh waste into the irrigation canal of the'Subak Kedua', Lelateng Village, Jembrana Regency and the efforts of the Environmental Service in preventing the disposal of tofu and tempeh waste into the 'Subak Kedua' irrigation, Lelateng Village, Jembrana Regency. This research is empirical legal research. The results of this study related to environmental law enforcement regarding the disposal of tofu and tempeh waste, law enforcement that have been carried out by civil service police unit and the Regional Regulation Enforcement Team according to applicable regulations, there has been a violation of Jembrana Regency Regional Regulation Number 5 of 2007 concerning Cleanliness and Public Order. After carrying out mediation, checking the location, calling, making statements, and giving warning letters from 1st to 3rd warning letters, the entrepreneur has followed up on the directions from the warning letters to create additional storage places for tofu and tempeh waste. As for the efforts of the Environmental Service in preventing the disposal of tofu and tempeh waste by conducting surveillance and monitoring of water quality regularly, cleaning up river waste to increase the ability of the self-purification process, namely the power of water to decompose pollutant substances that enter the river. Coaching was carried out for nine tofu and tempeh entrepreneurs to carry out business waste management before being discharged into waterways and for entrepreneurs to complete a business permit in the form of a Statement of Environmental Management, proposing to procure a Communal Water-waste Treatment Plant for water-waste management. In addition, the Environmental Service has routinely conducted outreach programs regarding environment protection and the dangers of waste.

Abstract

Badung Regency is one of the destinations for tourism investment, but the amount of investment that goes to Badung Regency must be supervised by the Representative House of Badung Regency. The research aiming on examining effectiveness of supervision of the Representative Council of Badung Regency on tourism investment.The research was done using empirical legal research with legal sociology approach by conducting interviews with informants. Results implies that, the Representative Council of Badung Regency as an element of regional administration has the authority to supervise investment in the tourism sector by supervising the Badung Regency Lisencing Agency through Commission II. Technical supervision is carried out in the Control and Executor Sector by forming a monitoring and coaching team for tourism business actors. The strategy used in overcoming obstacles related to investment supervision and increasing investment is to provide guidance through technical guidance with several sources and provide incentives to business actors who contribute to the development of Badung Regency.

Abstract

Perlindungan masyarakat hukum adat dijamin oleh Pasal 18 B Undang-Undang Dasar 1945. Namun ada penguasaan oleh PT Muria Sumba Manis (MSM) untuk mengelola tanah ulayat di desa adat, kecamatan Umalulu, kabupaten Sumba Timur sebagai perkebunan tebu. Penelitian ini bertujuan untuk menganalisis dan mendeskripsi perlindungan hukum dan penyelesaian sengketa terhadap hak milik atas tanah ulayat tersebut. Metode yang digunakan dalam penelitian ini yakni metode empiris. Hasil temuan penelitian, bahwa akibat dari masuknya PT MSM, hak-hak masyarakat adat di kecamatan Umalulu, yang meliputi hutan, mata air, dan tempat ibadah kepercayaan Marapu terabaikan. Hasil investigasi hukum ditemukan bahwa Perusahaan tidak mengantongi surat resmi dari BPN mengenai HGU untuk kepentingan bisnis tebu PT MSM. Upaya penyelesaian hukum terhadap konflik ini menggunakan UUPA nomor 5 tahun 1960. Wahana Lingkungan Hidup Indonesia (WALHI) NTT menggunakan UUPLH nomor 32 tahun 2009 dengan tahapan identifikasi, pengorganisasian, pendampingan, dan mediasi/audiensi bersama pemerintah daerah terkait persoalan agraria di Sumba Timur.

Abstract

The high population correlates with the level of pollution that occurs, considering the high level of mobility of each person makes the need for transportation facilities even greater. The existence of so many workshops affects the surrounding environmental conditions. The formulation of the issues raised is (1) How are the legal protection efforts against the environment from pollution due to workshop business activities in Sumerta Village?, (2) What are the obstacles in environmental protection due to workshop business activities in Sumerta Village? This thesis research uses empirical legal research methods. The results of the study found that there were prevention efforts made to the environment from pollution due to workshop business activities, namely by conducting socialization from the Environment and Hygiene Service and Sumerta Village to workshop business actors. Obstacles in enforcing environmental protection due to workshop business activities in Sumerta Village there are several factors such as factors of legal facilities, law enforcement officials, facilities and facilities, licensing, public legal awareness of the environment, and a large number of workshops and even distribution make supervision difficult.

Abstract

The problem of waste is a problem that never ends from year to year. The volume of waste always increases every year and causes various negative impacts on the environment and the sustainability of people's lives. The population is affected by the increase in waste volume. With this background, the problem formulation raised is how the implementation of Tabanan Regency Regional Regulation Number 5 of 2021 concerning Waste Management in Tabanan City, and how the effectiveness of Tabanan Regency Regional Regulation Number 5 of 2021 in Tabanan City. This research uses empirical legal research type, data collection techniques in this research are by conducting interviews and document studies. The results of the study found that Tabanan Regency Regional Regulation Number 5 of 2021 concerning Management of Household Waste and Waste Similar to Household Waste has been implemented quite well but has not been fully effective because there are still several obstacles in the implementation of the regulation, namely low awareness and knowledge of waste management and lack of facilities and infrastructure in managing waste. Sanctions against waste violators are subject to administrative sanctions in the form of verbal and / or written warnings, as well as fines.

Abstract

With the Decree of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 276/KEP-19.2/X/2017 Regarding the Appointment of Pakraman Village as the Subject of Joint Ownership Rights (Communal) Overland (the decree of the minister No. 276/KEP-19.2/X/2017) in the Province of Bali, Desa Pakraman/Desa Adat has been named as a customary law community. The discourse on strengthening the traditional village became relevant with the Bali Province Regional Regulation No. 4 of 2019 concerning Traditional Villages in Bali, which gave traditional villages legal standing as a legal subject. This research aims to determine how the model of customary land registration as communal ownership rights in Bali and the impact of land registration on the existence of land in Bali. Empirical research is used, and a legal approach, a conceptual approach, a case study approach, and a sociological approach are all used. Based on the research results, it was found that the customary land registration model of communal (or shared) ownership rights in Bali was registered as property rights using the minister's ATR/Ka decree as the legal basis. BPN No. 276/KEP-19.2/X/2017, so that the name of the right holder on the property rights certificate is the name of the traditional village. When customary land in Bali is registered as property rights, land registration makes it more likely that ownership rights can be moved.

Abstract

Economic growth in a country is crucial for the well-being of its society. This research utilizes the normative research method, which is a scientific research method to discover truths based on scholarly logic from a normative perspective. Legal materials in normative research can include primary legal sources, secondary legal sources, and non-legal sources. The results of this research explain that various forms of institutions have been established in efforts to develop the community's economy at the village level, such as Village-Owned Enterprises (BUM Desa) and Cooperatives, as mandated by Law Number 6 of 2014 concerning Villages.

Tourism affairs are one of the elective matters that are closely related to the superior potential and regional peculiarities This research is important to do with the aim of knowing the setting of sanctions against unlicensed tour guides in the field of travel agencies regulated in the Bali Provincial Regulation Number 5 of 2016 This research will be carried out using normative legal research, normative legal research is used because it examines and analyzes laws tourism Setting Sanctions Against Unlicensed Tour Guides in the Field of Travel Bureaus Regulated in the Bali Provincial Regulation in accordance with Regional Regulation Number 5 of 2016 Article 15 paragraphs (1) and (2) states that : Every General Tour Guide as referred to in Article 2 letter a, is required to have an KTPP to carry out tourist guiding duties Everyone who violates the provisions as referred to in Article 3 paragraph (1) shall be punished with imprisonment for a maximum of 3 (three) months or a fine of a maximum of Rp.50,000,000 as for Administrative Sanctions in the form of verbal warnings and freezing of KTPP.

Abstract

The enactment of Law No. 11 of 2020 concerning Job Creation experienced pro and con problems in social life, especially in the land sector. Multi-interpretation of regional authority in terms of licensing the land sector encourages the government as soon as possible to synergize existing regulations. The problems are: 1) What is the legal arrangement for permits related to land? and 2) What is the government's role in licensing in the land sector? The purpose of this research is to be able to find out the legal regulation of licensing related to land, and to know the role of the government in licensing in the land sector. The research method used is a normative research method. Regulations regarding land permits are broadly regulated in the main agrarian laws, namely Law Number 5 of 1960, and Law Number 23 of 2014 concerning Regional Governments regarding permits for land management in regions according to the autonomous system. The authority and role of the government in terms of licensing the land sector is also regulated through the law on spatial planning and location permit regulations.

Abstract

Kegiatan yang merubah kegunaan tanah dari satu jenis kegiatan menjadi kegiatan lain yang lebih beragam disebut sebagai alih fungsi lahan. Perubahan kepemilikan lahan timbul selaku dampak dari pembangunan dan kenaikan populasi penduduk. Pada setiap tahunnya, Kabupaten Jembrana kerap mengalami perubahan fungsi lahan pertanian menjadi non-pertanian. Apabila perubahan fungsi berlangsung secara terus-menerus dan tidak diawasi secara khusus, maka lahan pertanian di Kabupaten Jembrana mengalami penurunan bertahap dari tahun ketahun. Dari dampak berbahaya yang disebabkan, maka penulis menyimpulkan 2 (dua) rumusan masalah yaitu: Bagaimanakah bentuk penanggulangan terhadap perubahan fungsi lahan pertanian menjadi non pertanian di Kabupaten Jembrana serta Bagaimana upaya hukum pemerintah daerah dalam mencegah terjadinya alih fungsi lahan di Kabupaten jembrana. Digunakan metode penelitian empiris serta pendekatan fakta, perundang-undangan, dan menganalisa dalam penelitian ini. Hasil dari penelitian ini, yaitu dikatakan masih belum optimal karena penerapan terhadap lahan pertanian yang mempunyai garis batas zona hijau dan pada tiap tahunnya masih didapatkan aktivitas perubahan fungsi terhadap kawasan/lahan pertanian pangan di Kabupaten Jembrana.
