Abstract

The problem that occurs is a legal vacuum regarding the regulation of sanctions that can be imposed on perpetrators of infidelity through national law. In the Dayak indigenous communities of Central Kalimantan, Dayak customary law is strictly enforced, but it is still not widely known. This research uses empirical qualitative research type, conducted by visiting the Kedamangan Institute in Central Kalimantan and the Dayak Customary Council (DAD) in Central Kalimantan. This can complement national legal efforts before the implementation of the national law of the Criminal Code Bill for the Ngaju Dayak community in Central Kalimantan. Legal efforts made to ensnare perpetrators of infidelity are broken promises which are the most serious legal remedies that can be done by the indigenous people of the Ngaju Dayak tribe. They believe that the oath taken on Basarah Adat will be serious for those who dare to lie. They may be short-lived, unlucky and suffer from continuous illness for themselves and their offspring and siblings. The customary Dayak Ngaju sanctions imposed on perpetrators of infidelity are to pay twice the value of the customary marriage (dowry) of the confiscated spouse, pay shame compensation for the legal family of the female partner, pay compensation for marriage expenses for the legal couple, and pay the peace of the party.

Abstract

Penelitian ini bertujuan untuk menggambarkan dan menjelaskan cara penyelesaian terjadinya proses sengketa tanah melalui mediasi Ketua Adat serta penyebab terjadinya konflik antara masyarakat adat di Kecamatan Kahayan Tengah Kabupaten Pulang Pisau. Penelitian ini membahas bagaimana penyelesaian sengketa tanah melalui mediasi secara adat dimasyarakat serta hambatan maupun kendala dalam penyelesaian sengketa adat di masyarakat. Metode yang digunakan adalah penelitian hukum empiris dengan teknik pendekatan deskriptif-analitis dan teknik penarikan kesimpulan induktif dan melakukan wawancara di kedamangan. Hasil penelitian ini, menjelaskan bahwa penyelesaian sengketa di luar pengadilan tidak memiliki kiekuatan eksekutoria. Hambatan yang terjadi karena kurangnya pemahaman terhadap batasan tanah ulayat, karena telah meninggalkan pelaku sejarah para tokoh adat merupakan kelompok orang yang paling mengetahui keberadaan tanah ulayatnya, proses mediasi tidak ada itikad baik serta minimnya kesadaran masyarakat untuk mensertifikasi tanah.

Abstract

Baitul Maal wat Tamwil (BMT) is a sharia-based microfinance institution that plays an important role in expanding financial access and helping to improve the economy of small communities. However, in practice, legal problems often arise between BMT and its members, particularly in relation to the withdrawal of savings. This study aims to analyze the legal aspects of the BMT BUS case related to the withdrawal of member deposits and to examine the legal protection for members as depositors. This study uses a normative legal research method with a legislative, conceptual, and case study approach. Research data was collected through a literature study of relevant legal sources and analyzed qualitatively. This study shows that the problem of withdrawing member deposits at BMT BUS is caused by weak risk management and disrupted institutional liquidity, so that BMT is unable to fulfill its obligation to return funds in accordance with the agreed contract. Legally, this condition can be categorized as default and reflects the suboptimal legal protection for BMT members. The novelty of this research lies in its legal analysis, which integrates positive law provisions, sharia economic principles, and actual practices in the BMT BUS case. This study is expected to contribute to strengthening regulations, governance, and improving legal protection for BMT members in Indonesia.
