Abstract

Kreditor dapat melakukan eksekusi terhadap objek Hak Tanggungan apabila debitur cidera janji (wanprestasi) yang diatur dalam Pasal 20 Undang-undang Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda yang Berkaitan dengan Tanah (selanjutnya disebut Undang-Undang Hak Tanggungan), bahwa ada 3 alternatif untuk menangani kredit macet dengan melakukan eksekusi Hak Tanggungan, yaitu : (1) Eksekusi Hak Tanggungan melalui Pasal 6 Undang-Undang Hak Tanggungan (2) Title eksekutorial tercantum dalam Sertipikat Hak Tanggungan dan dilakukan melalui mekanisme pelelangan umum dengan fiat dari Ketua Pengadilan Negeri; (3) eksekusi di bawah tangan atas objek Hak Tanggungan dilakukan atas dasar kesepakatan antara kreditor dan debitor. Dalam pelaksanaan lelang Hak Tanggungan sekalipun telah sesuai dengan prosedur dalam Peraturan Direktur Jenderal Kekayaan Negara Nomor 2/KN/2017 Tentang Petunjuk Teknis Pelaksanaan Lelang jo. Peraturan Menteri Keuangan Nomor 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang, tidak menutup kemungkinan adanya gugatan dalam bentuk perlawanan ke pengadilan yang dilakukan sebelum lelang atau setelah lelang yang dapat membatalkan pelaksanaan lelang atau menunda pelaksanaan lelang.Kata kunci: Perlindungan Hukum; Pemenang Lelang ; Eksekusi Hak Tanggungan

Abstract

Indonesia adalah Negara yang terdiri dari berbagai pulau sejumlah 17.000 lebih pulau yang membentang luas. Wilayah laut Indonesia melebihi luas daratannya. Menyadari bahwa Indonesia merupakan negara kepulauan, dimana jumlah pulau pulau kecil terluar banyak, maka untuk menjaga kedaulatan negara, sekaligus meningkatkan kemakmuran rakyat, perlu dilakukan penataan pemanfaatan pulau pulau kecil terluar melalui penSertifikatan tanah. Permasalahan yang dirumuskan dalam penelitian ini yaitu terkait penerbitan Sertifikat Hak Pakai untuk pulau-pulau kecil terluar di Indonesia menurut hukum tanah nasional dan bagaimana Sertifikat hak pakai untuk pulau kecil terluar di Indonesia ditinjau dari teori kepastian hukum. Adapun tujuan dilakukan penelitian ini adalah menggambarkan penerbitan Sertifikat hak pakai untuk pulau kecil terluar di Indonesia menurut hukum tanah nasional dan menggambarkan sertifikat hak pakai untuk berbagai pulau kecil yang berada paling luar pada wilayah Indonesia berdasarkan teori kepastian hukum. Penelitian dilakukan dengan metode yuridis normatif melalui pendekatan perundang-undangan. Penelitian menemukan hasil penerbitan Sertifikat hak pakai untuk pulau kecil terluar di Indonesia menurut hukum tanah nasional dilaksanakan sebagaimana diatur dalam UUPA dan peraturan pelaksanaannya. Sertifikat tersebut menjadi bukti pemilikan yang paling kuat. Sertifikat Hak Pakai untuk pulau kecil terluar di Indonesia ditinjau dari teori kepastian hukum memberikan jaminan bagi Kementerian Kelautan dan Perikanan sebagai pihak yang menguasai pulau tersebut untuk kegiatan penelitian dan pengembangan perikanan, sekaligus pula sebagai wujud kedaulatan negara Republik Indonesia.

Abstract

One of the features of a mortgage is that its execution is simple and certain. This is governed by Article 20 of Law Number 4 of 1996 concerning Mortgage Rights on Land and Objects Related to Land (hereinafter referred to as the Mortgage Law or UUHT), which includes three different execution methods: execution based on Article 6 of the Mortgage Act (parate executing), execution based on executorial title, and underhanded execution. However, issues frequently develop during installation. If the debtor fails to complete his responsibilities after receiving three warning letters from the creditor, the obligations must be fulfilled right away as specified in the contract. so that creditors may execute in accordance with Article On the auction's rules, 6 UUHT. The Mortgage Law's Article 11 paragraph (2) letter e, which was made clear in the Power of Attorney for Imposing Mortgage Rights (SKMHT) and Deed of Granting Mortgage Rights (APHT), reiterates the creditor's rights.

Abstract

Every fishing activity in the water area of ​​the Republic of Indonesia must have a permit and meet the requirements for the use of fishing nets as regulated in the Regulations. This research discusses Fishing without SIPI. This research is normative and descriptive analytical legal research, using secondary data obtained through library research. The data is analyzed qualitatively and the conclusions are drawn using deductive logic. The conclusion from this research is the fishing by Sugianto did not use SIPI and violated article 27 paragraph (1) Law Number 45/2009 from Law Number 31/2004 concerning fishery and Sugianto also using nets in the form of Trawls Nets. On the other hand the actions he did categorized as Illegal Fishing.

Abstract

The Mortgage Law and Objects Related to Land, namely Law Number 4 of 1996, (hereinafter reffered as the Mortgage Law) states that there are three ways if the debtor breaks a promise (wanprestasi) and the creditor can carry out the execution of the Mortgage object. The three methods consist of Parate Execution as stated in the Mortgage Law Article 6, Executorial Title as stated in the Mortgage Law Article 14 paragraphs (2) and (3), as well as Underhand Execution. Execution of Mortgage carried out by Islamic Banks in the Study of Decision Number 5530/Pdt.G/2017/PA.Badg remains subject to the Mortgage Law and the auction process which is carried out on the basis of Minister of Finance Regulation Number 27/PMK.06/2016 concerning The Instructions for Auction has been amended by The Minister of Finance Regulation Number 213/PMK.06/2020 concerning Instructions for Auction Implementation. The judge's considerations in adjudicating the Decision Number 5530/Pdt.G/2017/PA.Badg case are in accordance with the Mortgage Law, especially in Article 6 with the creditor still having the right to carry out execution through auction according to Minister of Finance Regulation Number 27/PMK. 06/2016 which has now been amended by Minister of Finance Regulation Number 213/PMK.06/2020.

Abstract

Illegal fishing often use explosives. The Research’s problem is how the policies regarding fishing gear in Law on Fisheries and the Job Creation Law and how fishing carried out by the Kasdin using explosives in terms of the Law on Fisheries and the Job Creation Law (case study Decision Number 4/Pid.Sus-Prk/2020/PN Mme). The research conducted in normative and descriptive analytical legal research, using secondary data and primary and secondary legal materials. The data is analyzed qualitatively and conclusions drawn using deductive logic method. The conclusion is that the policy related to the prohibition of the use of bombs (chemical explosives) in fishing activities is regulated in Law Number 45 of 2009 concerning Fisheries, Minister of Maritime Affairs and Fisheries Regulation Number 18 of 2021 and Government Regulation Number 27 of 2021 concerning the Implementation of Maritime Affairs and Fishery. Based on the case in Decision Number 4/Pid.Sus-Prk/2020/PNMme, Kasdin violated Article 8 (1) of Law 45/2009 Concerning Fisheries, Article 7 (1) and (2) of Minister of Maritime Affairs and Fisheries Regulation Number 18 of 2021, Article 43 (1) Government Regulation Number 27 of 2021 concerning the Implementation of Maritime Affairs and Fishery and can be categorized as illegal fishing using explosive.

Abstract

Every individual or corporation engaged in the fishing industry is required to hold a permit. It is intended that by granting this licence, fishing operations will be legally protected and that fish resources will remain abundant. The Job Creation Law and Law No. 31/2004 concerning Amendments to Law No. 31 of 2004 Concerning Fisheries (hereinafter referred to as the Fisheries Law) very clearly regulate licenses for fishing activities, but PERMEN Maritime Affairs and Fisheries No. 17/2006 concerning Capture Fisheries Businesses regulates licenses for fishing activities for Indonesian-flagged vessels then changed the Minister of Maritime Affairs and Fisheries Regulation No. 58/2020 concerning Capture Fisheries Businesses, providing licenses to vessels flying the Indonesian and foreign flags, Fishing by foreign-flagged vessels without a Fishery Business Permit (SIUP) and Permit Fishing (SIPI) is clearly illegal and in violation of Articles 26 and 27 of the Fisheries Law. It may also be subject to Article 92 of the Fisheries Law.

Abstract

According to the Permen ATR/Ka.BPN Number 5 of 2020 Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency concerning Services Electronic Integrated Mortgage Rights, Electronically Integrated Mortgage (HT-el) is a set of procedures for servicing mortgage rights in the context of maintaining land registration data that  organized through an integrated electronic system. However, the implementation of electronic mortgage registration is in accordance with the Regulation of ATR/Ka.BPN Number 5 of 2020, starting from preparation to issuance of the Electronic Mortgage Certificate (HT-el Certificate), p. The Depok City Land Office is still in the development stage of electronic mortgage registration. Communication, availability of resources, attitude, and organizational structure all have an impact on this. Some challenges the readiness of the Depok City Land Office to improve internal data; and from external factors, such as the readiness of human resources, such as the PPAT and the Bank as the applicant, are the examples of external obstacles that cause the process of carrying out the Electronic Mortgage to be delayed, which will have an impact on the birth of the Mortgage. All barriers must be removed in the future, along with increased data verification and thorough training for all parties involved.

Abstract

Housing Loans (KPR) is a bankprovided facility that allows for the credit-based purchase of real estate and residential buildings, with the real estate and residential buildings serving as mortgage-backed collateral. Decision 81/Pdt.g/2019/PN.Ckr Analysis The question is how the National Land Law is applied to the transfer of debtors in the KPR and how the judge interpreted it decision 81/Pdt.g/2019/PN.ckr in accordance with Law Number4 of 1996 regarding Mortgage Rights onLand and Objects Related to Regulation Number24 of 1997 regarding Land Registration. Normative descriptive research data from literature. Deductive conclusion drawing and qualitative data analysi. The mortgage debtor canbe transferred two ways: first,with the knowledge the bank ascreditor, where the process is the same as applying for bank mortgage, and second, without the knowledge of creditor, through buying and selling transactions supported by proof of receipt. One the judge's considerations is that the process of buying and selling land between the old debtor and the new debtor has been proven that receipt is considered valid; however, the judge's consideration is inappropriate because the transfer of debtor without the creditor's knowledge is included in default, and the creditor can demand compensation and nulland void.
