Abstract

Children are Allah's entrustment to parents, society, nation and country heirs of Islamic teachings (revelation of Allah Almighty) which will later prosper the world as rahmatan lil 'âlamîn. That every child has the right to protection from violence or persecution and discrimination as mandated in the 1945 Constitution of the Republic of Indonesia. The rights of children as victims of criminal acts of maltreatment include, such as treatment, psychological rehabilitation and compensation. This research was conducted with normative legal research. Normative legal research is research that places law as a building system of norms, consisting of principles, norms, rules of laws and regulations, court decisions, agreements and doctrines.

Abstract

This research aims to identify and analyze service quality strategies that can increase user satisfaction of beauty clinic services from a legal perspective in Indonesia. Beauty clinics as providers of health and beauty services have a responsibility to ensure that the services provided are not only effective and safe, but also comply with applicable regulations and legal standards. The research method used in this research is normative legal research, which involves analysis of library materials or secondary data. Even though there are regulations such as Law Number 29 of 2004 concerning Medical Practices and the Consumer Protection Law, their implementation still faces various challenges. This research underlines the importance of increasing the competency of medical and non-medical personnel through training and certification, the use of quality technology and products that meet national standards, as well as transparency of information and consumer education. In addition, improving responsive customer service and promoting ethical principles in medical practice were also identified as important factors in increasing service user satisfaction and trust. Through these strategies, beauty clinics can improve the quality of their services, ensure legal compliance, and ultimately increase consumer satisfaction and protection. This research provides concrete recommendations for beauty clinic practices in Indonesia so that they can operate to higher standards and provide greater benefits for consumers.

Abstract

The restorative justice approach is an alternative resolution action outside of court that prioritizes peace and restitution of losses and aims to empower victims, perpetrators, families and the community to repair an unlawful act by using awareness and conscience as a basis for improving social life. This research was conducted using normative legal research. After carrying out a legal analysis of the Circular Letter of the Chief of Police of the Republic of Indonesia Number SE/2/11/2021 concerning Awareness of Ethical Culture to Create a Clean, Healthy and Productive Indonesian Digital Space and the Republic of Indonesia State Police Regulation Number 8 of 2021 concerning Handling Criminal Acts Based on Restorative Justice, peace can be made for criminal acts of defamation through electronic media with a restorative justice approach, but it must comply with applicable requirements and procedures.

Abstract

The narcotics problem in Indonesia continues to rise, with one-third of inmates convicted of drug offenses. This study analyzes the implementation and challenges of the rehabilitation program at the Class IIB Correctional Institution of Lubuk Pakam using a normative-empirical juridical approach. The program follows relevant regulations through WHO-ASSIST screening, assessment, staged rehabilitation, and post-rehabilitation. Cooperation with the Titian Harapan Indonesia Foundation has proven effective, with 85% of participants experiencing improved quality of life. Main obstacles include limited qualified personnel, infrastructure, coordination, and funding. Optimization requires capacity building, infrastructure improvement, partnership expansion, and increased financial support.

Abstract

Kasus tindak pidana pencurian dengan pemberatan merupakan salah satu kejahatan yang sering kali menimbulkan kekhawatiran dalam masyarakat. Salah satu faktor utama penyebab tindak pidana pencurian dengan pemberatan adalah faktor ekonomi, lingkungan dan pengaruh temen yang menyebabkan individu melakukan kejahatan sebagai jalan pintas untuk kebutuhan hidup. Peraturan hukum tindak pidana pencurian dengan pemberatan diatur dalam pasal 363 KUHP yang mengatur pencurian dengan pemberatan. Tujuan penelitian ini untuk menganalisis berbagai aspek yang terkait dengan pencurian dengan pemberatan, termasuk faktor penyebab terjadinya pencurian dengan pemberatan oleh terdakwa yang dilakukan karena faktor ekonomi, serta pertimbangan yang digunakan oleh hakim dalam memutuskan hukuman bagi terdakwa yang melakukan tindak pidana pencurian dengan pemberatan. Sifat penelitian jurnal ini bersifat deskripsi kualitatif, jenis penelitian ini menggunakan yudiris empiris. Adapun data yang digunakan dalam penelitian ini untuk menganalisis dinamika yang terlibat memberikan hukuman yang tepat bagi pelaku tindak pidana pencurian dengan pemberatan.

Abstract

Legal protection in social life is crucial to protect people from violations of norms. Legal norms are needed in cases of sexual violence, encompassing various forms of physical, psychological, sexual, or economic suffering. Cases of violence against women are a topic of criminal procedure, particularly in the evidentiary process. Violence against women often faces evidentiary challenges due to the hidden nature of the crime, and victims often find it difficult to provide direct evidence. Collecting and presenting evidence in cases of violence against women faces various complex challenges. One of the main challenges is the often personal nature of the violence, making it difficult to obtain objective evidence. Another factor is that victims of violence often experience profound psychological trauma, which also affects the consistency or completeness of their testimony before investigators or the court. Shame, fear of social stigma, or threats from the perpetrator often make victims reluctant to report the incident. These obstacles require the involvement of experts from the National Commission on Violence Against Women (Komnas Perempuan), as well as legal services and assistance. Standard proof in cases of violence against women prioritizes the integration of various forms of evidence in accordance with Article 184 of the Criminal Procedure Code.

Abstract

Drug crimes are special crimes regulated in Law number 35 of 2009 concerning Narcotics crimes. The research aims to find out the role of the Padang Lawas Police Drug Investigation Unit in handling drug crimes, what obstacles are experienced in the investigation process for handling drug crimes. The type of research used is empirical juridical research (field study). This research is descriptive in nature, the location of this research was carried out at the Padang Lawas Resort Police Drug Research Unit. The subject of this research is the police who have the authority to handle drug crimes in the Padang Lawas Resort Police Drug Investigation Unit. Data collection techniques were carried out by means of observation, interviews, document study. The research results show the role of the Padang Lawas Resort Police's drug investigation unit in accordance with Law Number 2 of 2002 concerning the Republic of Indonesia Police and Law no. 35 of 2009 concerning Narcotics Crimes, the obstacles experienced in the investigation process are,Lack of budget, inadequate facilities and infrastructure, lack of drug investigation personnel, a culture of society that still covers things up, each perpetrator being tied to each other and changing illegal crime techniques, in terms of efforts to overcome these obstacles, the Padang Resort Police Narcotics Investigation Unit Lawas making the village drug-free is a solution to minimizing the illegal circulation of drugs.
