Abstract

Ketersediaan lahan merupakan salah satu isu utama dalam konteks kedaulatan dan ketahanan pangan. Fakta menunjukkan bahwa perlindungan lahan pertanian pangan belum efektif, yang ditandai oleh masih tingginya perubahan lahan pertanian menjadi lahan nonpertanian. Mulyani memperkirakan laju konversi sawah nasional sekitar 96.512 ha pada periode 2000-2015, dan dengan laju yang demikian itu diperkirakan lahan sawah akan menciut dari 8,1 juta ha menjadi hanya 5,1 juta ha pada tahun 2045

Abstract

This research underscores the urgent need for copyright protection in the Indonesian bridal makeup design sector, particularly focusing on Kendal Bridal Makeup Design. The absence of legal safeguards for innovative makeup designs poses a significant threat to the creative efforts of makeup artists and the broader bridal industry. This study identifies a critical gap in existing intellectual property laws, which inadequately address the unique challenges of protecting original makeup designs. Findings indicate that the lack of robust copyright protections results in widespread imitation and unauthorized use of designs, undermining their economic value and diminishing creative incentives for artists. This situation impedes the growth of the creative industry, where originality and personal branding are essential. The research highlights that the current legal framework does not adequately support the sector, leaving artists exposed to exploitation and legal disputes. The novelty of this study lies in its specific focus on bridal makeup design within the Indonesian context, an area that has received limited scholarly attention. By evaluating the legal and economic impacts of insufficient copyright protection, the study offers new insights into how reforming intellectual property laws can promote innovation and support industry growth. The research contributes by advocating for targeted legal reforms to enhance copyright protections for makeup designs and provides actionable recommendations for policy changes. These measures aim to safeguard artists' rights, foster creativity, and bolster the Indonesian creative industry, thereby paving the way for a more sustainable and innovative sector.

Abstract

Nazir as the party who received the mandate to receive and manage waqf land faced several problems related to waqf land. These problems are that the waqf land has not been certified, the waqf land is in dispute, the waqf land has been lost/controlled by another party. This problem occurs because the practice of waqf land is carried out verbally on the basis of mutual trust, the waqf pledge has not been made before PPAIW, the waqf pledge deed has not been processed, the waqf land has not been registered, and the waqf land has not been utilized according to the waqf pledge. Through community service activities, Nazir's capacity was increased through literacy in land waqf law. Legal literacy includes the land waqf process and waqf land registration. The legal act of donating land must be carried out according to the Waqf Law, carried out before an authorized official and the waqf land is registered at the Land Office. The waqf pledge must be made in front of the Waqf Pledge Deed Registrar to be recorded in the Waqf Pledge Deed. The Waqf Pledge Deed is written evidence in land registration at the Land Office, as the basis for issuing a Waqf Land Certificate. Waqf Land Certificates are issued to create legal certainty and legal protection for land waqf. The regulation of land waqf in the Waqf Law and its implementing regulations further confirms waqf as an important and useful institution for efforts to realize community welfare, in line with the goals of state life.

Abstract

ABSTRAK Kota Jakarta menghadapi tekanan tinggi dalam pengelolaan ruang akibat pertumbuhan penduduk dan terbatasnya lahan yang tersedia. Urbanisasi yang masif telah memicu alih fungsi lahan hijau dan menyebabkan degradasi lingkungan serta ketimpangan ruang hidup. Dalam konteks ini, pemanfaatan ruang di atas bangunan (ruang vertikal) muncul sebagai solusi inovatif untuk mendukung tata ruang berkelanjutan. Penelitian ini bertujuan menganalisis dasar hukum dan implementasi pemanfaatan ruang vertikal melalui studi kasus “The Villas” di atas Mall of Indonesia (MOI), Jakarta. Kajian dilakukan dengan pendekatan yuridis-normatif dan konseptual, melalui analisis peraturan perundang-undangan di bidang agraria, tata ruang, serta perizinan bangunan. Hasil kajian menunjukkan bahwa meskipun terdapat pengakuan ruang tiga dimensi dalam Undang-Undang Penataan Ruang dan pengaturan HMSRS dalam Undang-Undang Rumah Susun, regulasi mengenai hak atas ruang di atas tanah (air rights) secara spesifik masih belum tersedia. Studi kasus “The Villas” menunjukkan keberhasilan integrasi hunian dan komersial dalam satu struktur bangunan, namun juga menyoroti celah hukum terkait status kepemilikan dan legalitas izin pembangunan. Oleh karena itu, diperlukan pembaruan dan harmonisasi regulasi antara hukum agraria, tata ruang, dan sistem perizinan untuk mewujudkan kepastian hukum dalam pemanfaatan ruang vertikal. Pendekatan ini tidak hanya menjawab krisis ruang kota, tetapi juga mendukung pengembangan kota berkelanjutan dan efisien. Kata kunci: hukum agraria; ruang vertikal; tata ruang berkelanjutan   ABSTRACT Jakarta faces significant spatial challenges due to rapid population growth and limited available land. Massive urbanization has triggered the conversion of green spaces, leading to environmental degradation and spatial inequality. In this context, the utilization of space above buildings (vertical space) emerges as an innovative solution to support sustainable spatial planning. This study aims to analyze the legal basis and implementation of vertical space utilization through a case study of “The Villas” located above the Mall of Indonesia (MOI) in Jakarta. Using a normative and conceptual legal approach, the study examines relevant regulations in agrarian law, spatial planning, and building permits. The findings reveal that although three-dimensional space is acknowledged in the Spatial Planning Law and ownership of apartment units is regulated under the Housing Law, there remains a regulatory vacuum regarding specific rights over airspace above land (air rights). The “The Villas” case demonstrates the feasibility of integrating residential and commercial functions within a single structure, yet also highlights legal uncertainties related to ownership status and development permits. Therefore, regulatory reform and harmonization between agrarian law, spatial planning, and the permitting system are urgently needed to provide legal certainty for vertical space utilization. This approach not only addresses the spatial crisis in urban areas but also promotes the development of efficient and sustainable cities. Abstract

This research aims to analyze the application of the "in dubio pro natura" principle in Indonesia. This principle translates as "in doubt, for nature" and emphasizes the importance of protecting nature and the environment in making legal decisions. This scientific research uses one of the parts of the grand method, namely Library Research which is based on literature or literature. The author uses several references as legal materials to analyze the object of writing. The results show that the application of the principle of "in dubio pro natura" is the foundation of the application of the concept of the precautionary principle that has entered the Indonesian legal order since the enactment of Law Number 32 of 2009, this principle is in line with the principles of environmental equity, bio diversity and polluter pays principle. In addition, this principle in Indonesia still faces challenges in its application. Several factors affecting the application of this principle in Indonesia include inconsistent government policies in environmental protection, lack of public understanding and awareness of the importance of nature conservation, and shortage of human and technical resources in environmental law enforcement.
