Abstract

This article aims to examine the importance of the Victim Trust Fund in handling criminal cases of sexual violence in the Indonesian criminal law system and its comparison to the Victim Trust Fund in the United States. This article uses  a normative juridical research with a statutory,  a conceptual  and a comparative approach. The position of victims in the Victim Trust Fund is very important for the criminal justice system in Indonesia because it creates a firm and a binding justice. The Victim Trust Fund is a compensation system in Indonesia apart from restitution and compensation where it is necessary to establish a victim assistance fund management institution to be able to manage the funds allocated to victims.

Abstract

Effective leadership plays a pivotal role in achieving quality higher education. This study delves into how leadership management in higher education institutions can be aligned with the 18 national character values of Indonesia. Employing a Systematic Literature Reviews (SLR) methodology, the study analyzes literature pertaining to leadership, education quality, and national character values. The findings underscore the paramount importance of effective and professional leadership in enhancing the quality of higher education. Effective leaders must possess the competencies and qualities to manage, guide, cultivate, and steer all components of the higher education institution towards achieving educational goals. The new leadership management model proposed in this study integrates the 18 national character values of Indonesia into leadership styles. These values encompass religiousity, honesty, tolerance, discipline, hard work, creativity, independence, democracy, curiosity, nationalism, patriotism, appreciation for achievement, friendliness/communicativeness, peacefulness, love of reading, environmental awareness, social responsibility, and accountability. Implementing national character values into leadership is expected to encourage followers to work voluntarily and enthusiastically towards achieving shared goals. Ultimately, this will lead to the enhancement of higher education quality in Indonesia.

Abstract

In 2022, there was a phenomenon of cases of Atypical Progressive Acute Kidney Disorders in Children. After laboratory examinations were carried out by The Indonesian Food and Drug Authority together with other institutions, it was found that the compounds Ethylene Glycol (EG), Diethylene Glycol (DEG), and Ethylene Glycol Butyl Ether (EGBE) exceeded the limits in syrup medicines consumed by children. Based on this, this research aims to determine criminal responsibility by BPOM as the party that supervises all distribution of medicines and food regarding the distribution of syrup medicines which cause acute kidney failure in children and indications of the application of the murder article in the Criminal Code as BPOM's responsibility. The object of study in regulating legitimate composing is the disclosure of law in concreto using statutory and conceptual approaches. The research results show that in this case BPOM can be held criminally liable because it essentially fulfills the elements of error due to negligence. Apart from that, if we examine the Criminal Code, the legal basis that can accommodate BPOM's actions is Article 205 of the Criminal Code because in this case BPOM was negligent in granting a distribution permit for the syrup medicine which resulted in MMR and resulted in the death of the child.
