Abstract

The boundaries of a country's sovereignty today are increasingly blurred due to globalization. The era of globalization is marked by technological advances and free trade between countries. In addition to the positive impact of globalization, globalization also has excesses of crime that are rapidly increasing along with advances in information technology and transformation. Transnational crime has grown to become a threat to society as a result of the globalization era. One of the transnational crimes in the era of globalization is terrorism. In general, terrorism is included in the characteristics of these serious crimes. This is because the criminal act of terrorism is a crime committed using violence or the threat of violence in a deliberate, systematic and planned manner, which creates an atmosphere of terror or widespread fear by targeting state officials, random or unselected civilians, as well as vital objects that are strategic, environmental, and public facilities or international facilities and tend to grow into symmetrical hazards that endanger state security and sovereignty, territorial integrity, peace, human welfare and security, both nationally, regionally and internationally.Keywords: Universal Jurisdiction; Criminal Acts; Foreign Terrorist Fighter AbstrakBatas-batas kedaulatan suatu negara dewasa ini semakin kabur dikarenakan dari globalisasi. Era globalisasi ditandai dengan kemajuan teknologi dan perdagangan bebas antar negara. Selain dampak positif dari globalisasi tersebut, globalisasi juga memiliki ekses kejahatan semakin pesat seiring dengan kemajuan di bidang teknologi informasi dan transformasi. Kejahatan lintas negara telah tumbuh menjadi salah satu ancaman bagi masyarakat sebagai dampak dari era globalisasi. Salah satu kejahatan lintas negara di era globalisasi adalah terorisme. Secara umum terorisme masuk dalam karateristik kejahatan serius tersebut, hal ini dikarenakan tindak pidana terorisme merupakan kejahatan yang dilakukan dengan menggunakan kekerasan atau ancaman kekerasan dengan sengaja, sistematis, dan terencana, yang menimbulkan suasana teror atau rasa takut secara meluas dengan target aparat negara, penduduk sipil secara acak atau tidak terseleksi, serta objek vital yang strategis, lingkungan hidup, dan fasilitas publik atau fasilitas internasional dan cenderung tumbuh menjadi bahaya simetrik yang membahayakan keamanan dan kedaulatan negara, integritas teritorial, perdamaian, kesejahteraan dan keamanan manusia, baik nasional, regional, maupun internasional.Kata Kunci: Yuridiksi Universal; Pelaku Tindak Pidana; Foreign Terrorist Fighter

Abstract

Maraknya gerakan radikalisme di kalangan ASN yang merebak di tanah air tentunya mengkhawatikan kehidupan berbangsa dan bernegara Indonesia maka perlu upaya utuk membendung hal tersebut melalui pemahaman nilai - nilai bela negara. Untuk memberikan kesadaran tersebut berdasarkan konstitusi yang ada di NKRI. Maraknya penyebaran hoax tanpa filter melalui sosial media membuat paham radikal makin subur. Persoalan saat ini adalah adanya gerakan- gerakan radikalisme yang memiliki agenda terselubung yang menggerogoti sendi-sendi negara yang ingin memecah belah bangsa Indonesia, melemahkan persatuan dan kesatuan, merusak ke-bhineka-an yang sejak Indonesia berdiri telah menjadi konsensus bersama. Perlu adanya kebijakan hukum sebagai upaya mencegah terjadinya penyebaran gerakan radikalisme di kalangan Aparatur Sipil Negara dan melibatkan seluruh stakeholder yang bersentuhan langsung dengan dunia pendidikan, sosial, keagamaan, komunikasi dan keamanan di lingkungan masing-masing dan pendekatan sampai tindakan hukum, metode penelitian ini adalah penelitian hukum normative(legal research) ialah hukum sebagi norma guna memperoleh hasil yang ilmiah dan kentektual sehingga hasil penelitian ini menunjukan bahwa pencegahan terhadap faham faham intoleransi dan radikalisme dapat di fahami oleh segenap ASN di seluruh Indonesia.

Abstract

This research was conducted to examine how efforts to digitize the formation and also test the laws and regulations in Indonesia. Where the Ministry of Law and Human Rights as an institution representing the government in the formation of laws and regulations through the Directorate General of Laws and Regulations launched a digitalization program for the formation of laws and regulations to make it easier for the public to participate in the formation of laws and regulations because it is equipped with five innovations, namely e-public participation, e-invitation, e-litigation, Design HelpDesk, Design Chat Podcast (OPERA). Meanwhile, in terms of legal review, the Constitutional Court as a judicial institution tasked with maintaining the constitution and democracy and protecting human rights so that they can be easily recognized by the Indonesian people through digital technology tools so that the Indonesian people can not only easily know the Constitutional Court but also can easily submit applications or lawsuits to the Constitutional Court if they experience constitutional losses, namely through www.mahkamahkonstitusi.go.id website. With the efforts to digitize the formation and testing of these laws and regulations, it is expected that the public will be more active in participating in the formation and testing of laws and regulations

Abstract

Public speaking is an important communication skill in today's digital era. This study aims to analyze the effectiveness of the IBC (Introduction, Body, Conclusion) method in training students' public speaking skills. The research was conducted in batch 7 of public speaking training at Nusa Putra University Sukabumi with 40 students participating. The research method is qualitative with observation, interview and documentation study techniques. The results showed that the IBC method was very effective in equipping participants to become professional speakers. Participants were able to create an attention-grabbing introduction, deliver the content systematically, and make a conclusion that summarizes the main points. Regular application of the IBC method is proven to improve students' public speaking skills. This study recommends that the IBC method be applied to public speaking training to produce professional speakers in the digital era

Abstract

This study aims to find out how the implementation of the right to immunity of victims in the crime of sexual violence; and to find out how urgent it is to implement the provisions of the right to immunity of victims in the ideal sexual assault crime in the future. The method used in this study is normative legal research conducted as an effort to obtain the necessary data in relation to the problem. This research uses a legal approach (Statute Apporach), a conceptual approach, an analytical approach, a case approach (Case Approcah) and a comparative approach which in principle are sourced from primary legal materials, secondary legal materials, and tertiary legal materials with qualitative legal material analysis techniques The results of the study show that the right to immunity of the victim's companion is declarative and has not provided real protection. The main factors include weak technical arrangements, lack of understanding of law enforcement officials, a formalistic perspective that favors the victim, and a patriarchal culture that worsens the position of companion. Cases of criminalization, intimidation, and obstruction such as LBH Yogyakarta, UNRI, and UPTD PPA Makassar confirm that the permaping is still in a vulnerable position. Therefore, the implementation of the right to immunity for victims of sexual abuse in Indonesia has not been effective and requires strengthening regulations, increasing the capacity of the apparatus, clear operational protection, and changing the legal culture so that the criminal justice system is truly responsive and on the side of the victim.

Abstract

Indonesia as a country experiencing a transition from transition to democracy is marked by the strengthening of the flow of democracy and reforms are faced with the growing terrorist acts. Which has an impact on the destruction of infrastructure and a deep fear of the people to live, terrorism is a crime against humanity and then has a wide network of real and serious threats and at any time can jeopardize the security of the country, Counterterrorism can not be solved by just enforcing law with the approach of Hard Approach but also must be done with Soft approach approach . In this case is the approach of the Deradicalization Program, especially to the perpetrators of criminal acts of terrorism. In the implementation of the Deradicalization Program begins in the process of investigation, prosecution and judicial process so that the Deradicalization Program can be used as consideration of the judge of the judges to decide the criminal case of Terrorism so that the Value of Legal Use in Deradicalization Program is achieved and the perpetrators of terrorist crimes do not do the deed or repeat the actions.The method used in this research is normative legal research that is done as an effort to get the data needed in connection with the problem, the specification of the research is normative and empirical, the data used is primary data and secondary data consisting of primary legal materials and secondary law materials as well as tertiary law materials then for data analysis done with qualitative jurisdictional analytical method.The benefits of deradicalisation programs are counter terrorism, preventing radicalism, comparing ideologies, evading hate provocation, hostility in the name of religion, preventing society from indoctrination, and community participation rejecting terrorism. The current deradicalisation program should be re-supplied by the government and the wider community. Although there are no specific provisions on the deradicalization of terrorism in the Indonesian criminal law system, it is necessary to list the provisions related to the deradicalization program based on the legalization of the deradicalization program becoming the latest formulas for counter terrorism have links to ideology , Deradicalization can be related to the process of creating an environment that prevents the growth of radical movements by responding to the root causes that encourage the growth of radicals.

Abstract

Criminal law policy in countering terrorism faces a serious challenge to maintain a balance between the interests of state security and the protection of human rights. An overly repressive approach has the potential to lead to rights violations, while an overly lenient approach can reduce the effectiveness of prevention. Therefore, deradicalization was developed as a non-penal strategy that complements criminal law enforcement. This study aims to analyze the extent to which terrorism criminal law policies that integrate deradicalization approaches reflect the principle of balance between enforcement, prevention, and rehabilitation. This research uses normative legal research methods with legislative, conceptual, and philosophical approaches. Data were obtained through a literature study of current laws and regulations, legal doctrines, and related policy documents, which were analyzed qualitatively through legal reasoning and systematic interpretation. The results of the study show that the policy of terrorism criminal law has undergone a paradigm shift towards an integrative model that combines penal and non-penal instruments, with deradicalization as an important element to prevent recidivism and support social reintegration. In conclusion, the integration of deradicalization within terrorism criminal law policy not only reflects the principle of balance between enforcement, prevention, and rehabilitation, but also constitutes a normative foundation for the realization of rehabilitative justice oriented toward social reintegration and the prevention of recidivism.

Abstract

This study examines the complex dynamics of Indonesian Islam amidst the rise of global Islamic fundamentalism, focusing specifically on processes of radicalization and counter-radicalization within the archipelago. Indonesia, as the world’s largest Muslim-majority nation, presents a unique case due to its historically pluralistic and moderate religious landscape, which now faces increasing pressure from extremist ideologies. The primary objective of this research is to identify the key drivers of radicalization among Indonesian Muslims and to critically assess the effectiveness of existing counter-radicalization strategies implemented by the government and civil society organizations. Utilizing a mixed-methods approach, this study combines a quantitative analysis of survey data from 500 university students and religious leaders across Java and Sumatra with qualitative in-depth interviews. The qualitative component involved 30 participants, including former extremists, religious scholars, and policymakers, providing nuanced insights into their experiences and perspectives on radicalization and deradicalization. Results indicate that socio-economic grievances, misinterpretations of religious texts, and online propaganda are significant factors contributing to radicalization, particularly among younger demographics. In conclusion, Indonesian Islam demonstrates significant resilience against fundamentalist encroachment, largely due to its strong civil society and established moderate religious organizations.

Abstract

Global Islamic discourse is dominated by Middle Eastern centrism. Indonesia promotes Islam Nusantara (Archipelagic Islam), emphasizing moderation and syncretism (adat), aiming to be a global counter-model for reconciling faith, democracy, and modernity. This study aimed to analyze the strategic efficacy and global reception of Islam Nusantara among Middle Eastern religious elites and Western policymakers, addressing the critical Theological-Policy Translation Gap hindering its soft power projection. A qualitative, comparative multi-site case study (N=25 elite informants) was conducted, including Indonesian propagators, Salafi critics, and integration experts. Data were gathered via interviews and analyzed using a Policy Translation Matrix. The campaign is severely constrained by the Translation Gap. Middle Eastern elites rejected the concept based on Theological Purity (bid’ah). Western policymakers marginalized it due to a lack of Policy Utility and secular framing, proving the uniform message failed to satisfy opposing filters. The findings mandate an urgent dual-track communication strategy. The study’s contribution is a novel Global Policy Strategy for Contextual Islam that requires focusing on rigorous Arabic fiqh scholarship for the East and pragmatic, secular policy framing for the West.
