Abstract

Penelitian ini menganalisis implementasi Peraturan Presiden No. 22 Tahun 2017 tentang Rencana Umum Energi Nasional (RUEN) sebagai kebijakan strategis untuk mencapai ketahanan energi dan mempromosikan energi terbarukan. RUEN menetapkan target ambisius meningkatkan porsi energi terbarukan dalam bauran energi nasional hingga 23% pada tahun 2025. Melalui analisis komprehensif, penelitian ini mengevaluasi efektivitas implementasi kebijakan, mengidentifikasi tantangan yang dihadapi, dan memberikan rekomendasi strategis. Tantangan utama meliputi keterbatasan infrastruktur, resistensi industri energi konvensional, kompleksitas regulasi, dan ketergantungan tinggi terhadap bahan bakar fosil. Temuan menunjukkan bahwa meskipun RUEN memberikan kerangka kerja yang jelas, implementasinya memerlukan strategi yang lebih efektif dan koordinasi antar sektor untuk mencapai target. Penelitian ini berkontribusi pada upaya Indonesia mewujudkan ketahanan energi berkelanjutan dan ramah lingkungan.

Abstract

This article explores the rationale behind the revocation of Government Regulation (GR) No. 5 of 2021 on Risk-Based Business Licensing and its replacement by GR No. 28 of 2025. Using a normative juridical approach, the study assesses the effectiveness of the existing regulatory framework and the urgency for reformulating Indonesia’s business licensing system. The findings indicate that the implementation of GR 5/2021 encountered significant challenges, including systemic fragmentation, poor inter-agency coordination, and limited legal certainty. GR 28/2025 introduces key reforms such as the full integration of the Online Single Submission (OSS) system, the implementation of a strict Service Level Agreement (SLA), and the expansion of regulated business sectors. These reforms mark a strategic step toward a more transparent, responsive, and integrated business licensing regime in Indonesia.

Abstract

This study is centered on the change in the arrangement of environmental permits as regulated in Law of the Republic of Indonesia Number 32/2009 concerning Environmental Protection and Management (UUPPLH) to environmental approval as regulated in Law of the Republic of Indonesia Number 11/2020 concerning Job Creation (Omnibus Law). This study aims to examine and analyze the implications of changes in environmental approval arrangements as regulated in the Omnibus Law concerning environmental licensing in the Environmental Protection and Management Law. A normative legal research method was employed in this study. The approaches used in this study included the statute approach and the conceptual approach. The results of this study confirmed the need to balance economic interests with environmental sustainability so that sustainable development can be well actualized.

Abstract

The Right to Build Certificate (Hak Guna Bangunan/HGB), as evidence of land rights intended to provide legal certainty for right holders, may in practice be revoked through decisions of the State Administrative Court. Such revocation creates legal uncertainty regarding the legal status of the land and the position of the right holder, particularly where the certificate holder is not a party to the proceedings. This research aims to analyze the legal status of land following the revocation of an HGB certificate and to examine the legal remedies available to right holders in order to obtain legal certainty. The research employs a normative juridical approach through a literature review of statutory regulations and court decisions. The findings indicate that following the revocation of HGB Certificate Number B 222 in the name of PT Pertamina (Persero), the land reverts to state land, with Pertamina holding priority rights pursuant to Article 37 paragraph (4) of Government Regulation Number 18 of 2021. However, legal remedies through the priority rights mechanism do not provide absolute legal certainty, as the use of the term “may” reflects governmental discretion rather than a legal obligation. Consequently, legal certainty for PT Pertamina remains conditional and dependent upon administrative discretion, rather than constituting final legal certainty.

Abstract

This study aims to analyze the implementation of household waste management policies in Sukoharjo Regency based on Sukoharjo Regent Regulation Number 57 of 2018 concerning Regional Policies and Strategies in Household Waste and Household-like Waste Management. This legal research is a type of empirical legal research that is descriptive and analytical in nature, using data collection techniques such as interviews, field observations, and documentation. The results of this study show that the Sukoharjo Regency Environment Agency has made efforts to implement sustainable household waste management. The Environment Agency has implemented various programs in an effort to reduce and manage household waste. However, it cannot be denied that there are obstacles in the implementation of this policy program that have resulted in suboptimal household waste management. Its implementation is still hampered by uneven community participation and limited infrastructure. To address these obstacles, the Sukoharjo Regency Government has made efforts to formulate policies and strategies for household waste management in the form of policies to improve the performance of reducing household waste and similar waste, as well as policies to improve the performance of handling household waste and similar waste.

Abstract

Indonesia's forest tourism governance is still plagued by overlapping regulations, fragmented institutional coordination and poor community participation. These issues compromise both ecological sustainability and social justice. This research aims to analyse the weaknesses of the current legal and institutional framework governing forest tourism, and to propose a governance model based on ecological justice that is aligned with the Sustainable Development Goals (SDGs). This study employs a normative legal approach, complemented by socio-legal and historical-legal analyses. Statutory regulations and legal doctrines are examined alongside the historical evolution of forestry law, and governance practices and policy implementation are critically assessed. Three main findings emerged from the results: first, a lack of regulatory coherence across sectoral laws governing forest tourism; second, the marginalisation of ecological justice and participatory governance principles; and third, the predominance of technocratic and market-oriented regulatory instruments that undermine conservation objectives. Although recent legal reforms provide partial reinforcement, they fail to address fundamental governance gaps. It can therefore be concluded that forest tourism governance requires an integrative legal reform model combining ecosystem-based conservation, community-based resource management, and polycentric institutional arrangements, in order to strengthen ecological integrity, institutional accountability, and community inclusion, and to advance SDGs 13, 15, and 16.
