Abstract

Penyandang disabilitas sering dilupakan dalam perkembangan hukum dan juga partisipasi dalam pembangunan hukum, sehingga menjadi rentan aksesnya terhadap keadilan. Penyandang disabilitas harus memperoleh hak yang sama dengan yang lain tanpa terkecuali. Hal ini untuk memberikan rasa adil bahwa penyandang disabilitas berhak untuk memperoleh pendidikan di negara ini. Oleh sebab itu, perlu ada sosialisasi terkait hak pendidikan melalui perlindungan hukum anak penyandang disabilitas. Tujuan Pengabdian kepada Masyarakat (PkM) ini ialah untuk memberikan gambaran umum tentang adanya perlindungan hukum terhadap anak-anak disabilitas atas hak pendidikan di Republik Indonesia. Metode PkM melalui kegiatan partisipatif berupa sosialisasi terkait hak pendidikan terhadap anak penyandang disabilitas. Berdasarkan hasil PkM ditemukan bahwa sosialisasi perlindungan atas hak pendidikan terhadap anak penyandang disabilitas telah disampaikan dengan baik dan peserta antusias mengikuti kegiatan. Dari kegiatan tersebut diperoleh telaah ketentuan perundang-undangan yang memberikan perlindungan terhadap pemenuhan hak anak penyandang disabilitas dan dibentuknya Komisi Independent yang melakukan pengawasan terhadap pemenuhan hak tersebut.

Abstract

The professionalism of law enforcement officers is a crucial factor in achieving just, effective, and legitimate law enforcement in society. In practice, however, law enforcement often reveals a gap between legal norms and social reality, frequently caused by low levels of professionalism among officers. This condition shows that the effectiveness of law enforcement depends not only on the clarity of legal norms but also on the quality of those who implement them. This study aims to analyze the professionalism of law enforcement from a socio-legal perspective and examine its implications for the legitimacy of law enforcement institutions. The research employs a socio-legal method that integrates normative legal analysis with an examination of the social dimensions of law enforcement practices. The findings indicate that professionalism extends beyond technical competence and procedural compliance, encompassing integrity, ethical conduct, independence, and sensitivity to social contexts. Weak professionalism contributes to selective law enforcement, discriminatory practices, and declining public trust in legal institutions. From a socio legal perspective, legal legitimacy is not solely derived from formal authority but is also constructed through public acceptance of how the law is applied. Law enforcement perceived as unfair, inconsistent, or lacking transparency undermines institutional credibility and weakens legal compliance. Therefore, strengthening the professionalism of law enforcement officers is essential not only to improve the quality of law enforcement but also to bridge the gap between law in the books and law in action, ensuring the sustainability of institutional legitimacy.

Abstract

This article explores the resolution of the criminal act of vandalism through a restorative justice approach. Under Indonesian criminal law, vandalism is regulated in Article 406 of the Criminal Code with a maximum prison sentence of two years and eight months. However, the retributive approach is considered less effective in achieving substantive justice as it focuses solely on punishing the offender. This study employs a normative legal method with statutory, conceptual, and comparative approaches to examine the urgency of implementing restorative justice in resolving vandalism cases. The findings indicate that restorative justice offers a more humane approach by prioritizing the restoration of relationships between offenders and victims through mediation and mutual agreement. This approach aligns with local cultural values such as deliberation and contributes to reducing the burden on judicial and correctional institutions. Moreover, restorative justice provides a fairer and more efficient resolution, strengthening community involvement in legal enforcement. Therefore, this approach is relevant for application in vandalism cases that meet the established criteria, as a means to achieve balanced justice and restore the condition of all parties involved.
