Abstract

This article aims to explain the permissibility of combining (jamak) two fard prayers without having to travel far (safar) due to rain, busyness, traffic jams, celebrations (walimah) as a form of convenience in worship. In this condition, jamak becomes an alternative solution for Muslims because of the difficulty of fulfilling the obligation to pray in the time specified in the Qur'an and hadith. As literature research, this article will examine the plural prayer in the perspective of scholars, such as Abdurrahman bin Muhammad Ba'lawi, Yusuf al-Qardhawi, and Alwi Ahmad Saqqaf who provide rukhshah (relief) solutions in worshiping Allah. This research is qualitative in nature, which is done by collecting, analyzing, and interpreting narratives comprehensively against visual data to get a full, comprehensive, and holistic insight into the phenomenon of plural prayers for other than travelers. The results of this study indicate that combining two prayers without traveling far is permissible because of busyness, traffic congestion, and celebrations (walimah). Associated with current conditions, the situation is a form of masyaqqah that cannot be avoided so as to perform plural prayers, both taqdim and ta`khir.

Abstract

The issue of inter-religious marriage continues to be a concern among Islamic thinkers until now, becoming a discussion that does not recede, in line with the practice of such marriages which are still common among Muslims in Indonesia. The purpose of this article is to explain the status of inter-religious marriages in the perspective of Islamic law and legislation in Indonesia. This research utilizes a qualitative method using data sources from the literature (library research), which involves the collection, analysis, and interpretation of a comprehensive narrative of literature data to gain a thorough, comprehensive, and holistic understanding of the status of interfaith marriage in Indonesia. The results show that the Indonesian Ulema Council (MUI) has circulated a Fatwa stating that it is forbidden for Muslims, both men and women, to marry non-Muslims, including those who are People of the Book. The rationale for the Fatwa is that inter-religious marriages often cause conflicts in society and trigger conflicts of debate among Muslims. MUI's view is in accordance with the provisions of Law No. 1/1974 on Marriage and the Compilation of Islamic Law which also prohibit marriage between adherents of different religions.

Abstract

This article aims to compare the two concepts of Maqashid al-Syari'ah from al-Ghazali and at-Thufi with a focus on finding similarities and differences between their views. Maqashid al-Syari'ah refers to the principles or goals that are the basis of Islamic law, which aim to maintain human welfare and justice in society. Social changes arising from developments over time and the dynamics of society encourage scholars to deepen their studies of Maqashid al-Syari'ah seriously to find legal innovations that are needed to deal with existing social changes. The research method applied is qualitative in nature by utilizing library research, which involves the collection, analysis and thorough narrative interpretation of visual data to understand thoroughly and comprehensively the concept of maqashid al-Syari'ah from the perspective of al-Ghazali and at -Thufi. The results and discussion of this article confirm that the main aim of all Islamic religious teachings, including the Qur'an and hadith, is benefit. Al-Ghazali groups benefits into three parts, namely maslahah dharuriyah (urgent interests), hajiyah (necessary interests), and tahsiniyah (interests that improve the quality of life). On the other hand, At-Thufi does not divide benefits into these categories; for him, benefit is benefit, without needing to be shared. However, both agree that the essence of this benefit concept is to protect human welfare itself.
