Abstract

This study aims to examine the signification of the role of the Banda Aceh City government in ensuring the availability of halal food. This research uses a descriptive method of analysis, and the data obtained are analyzed qualitatively. The results showed that the reasons for the importance of the government's role in creating regulations to ensure the availability of halal food are, first; the normative principle of ta'abbudi every Muslim is obliged to consume halal food, second, the modern production system as a result of advances in food technology, third, the inability of consumers to evaluate food even when it has been consumed. For this purpose, the Banda Aceh City Government as the element most related to the community plays a role through the regulations of Mayor Regulation No. 13 Tahun 2011 and No. 16 Tahun 2016. With this goal, the Government of Aceh has established a rule of law that can protect the public from products that are not halal, namely through Qanun Aceh No. 8 Tahun 2016. However, these rules still require regulations / rules to supervise and enforce as a control function so that the form of information regulation, control of producer behavior and preliminary permits synergize in ensuring the availability of halal food. Penelitian ini bertujuan untuk mengkaji signifikasi peran pemerintah Kota Banda Aceh dalam menjamin ketersediaan makanan halal. Penelitian ini menggunakan metode deskriptif analisis, dengan jenis penelitian kualitatif. Hasil penelitian menunjukkan alasan pentingnya peran pemerintah dalam merumuskan regulasi guna menjamin ketersediaan makanan halal yakni, pertama; prinsip normatif ta’abbudi setiap muslim wajib mengkonsumsi makanan halal; kedua, sistem produksi modern sebagai akibat kemajuan teknologi pangan ketiga, ketidakmampuan konsumen mengevaluasi makanan bahkan ketika telah dikonsumsi. Untuk kepentingan tersebut, Pemerintah Kota Banda Aceh sebagai unsur yang paling berhubungan dengan masyarakat telah berperan melalui regulasi Peraturan Walikota No. 13 Tahun 2011 dan No. 16 Tahun 2016. Dengan tujuan tersebut pula, Pemerintah Aceh membuat aturan hukum untuk melindungi masyarakat dari produk non-halal, yakni melalui Qanun Aceh Nomor 8 Tahun 2016. Namun aturan tersebut masih memerlukan regulasi/aturan melakukan pengawasan dan penindakan sebagai fungsi kontrol agar bentuk regulasi informasi, kontrol perilaku produsen dan izin pendahuluan bersinergi dalam menjamin ketersediaan makanan halal.

Abstract

In line with the developments in the era of human life, especially in the economic field, earning activities through skills and professions will continue to grow occasionally. The determination of professional zakat obligations to him shows that Islamic law is very aspirational and responsive to the times. The Baitul Mal Institution works to manage zakat, religious assets, and other assets, so using field research methods, the researcher wants to see the management of professional zakat collection at Baitul Mal Aceh, from the research results, it is concluded that the professional zakat collection system at Baitul Mal Aceh is carried out with the first system, you can go to the counter to record your name and then provide a receipt for proof of zakat payment. Secondly, you can go through a bank account via the mobile banking application to deliver the zakat/zakat deposit, after the zakat is paid, we will send it to the regional treasury as for the account number. As for the opportunities and obstacles in collecting professional zakat, namely, the opportunity is that there is still public trust in the management of zakat carried out by Baitul Mal Aceh so that it is motivated to be better, with this opportunity the Baitul Mal continues to strive to increase professional zakat collection.

Abstract

Brand counterfeiting is very disturbing to the public as consumers who always use the brand image of certain products, but the perpetrators of brand counterfeiting continue to increase, therefore they need to be held criminally responsible for their actions. With a legal normative approach, namely by considering laws and norms and concepts related to the boundaries of legal units so that the sanctions obtained as a form of legal responsibility for the perpetrators of counterfeiting this article try to find the answer, so that in the end a conclusion is obtained in Indonesian positive law that the sanctions are regulated in the Law of the Republic of Indonesia Number 20 of 2016 concerning Marks and Geographical Indications with a maximum sanction of 5 (five) years and/or a maximum fine of Rp. zir which is returned to the authorities/judges in imposing sanctions that can provide a sense of justice for all.
