Abstract

The process of resolving cases at a trial is not always carried out conventionally ie the parties come directly to the trial but can be done online. This is marked by the launch of the e-court application on July 13, 2018. With the launch of the e-court application, the Supreme Court has moved towards electronic justice which will fundamentally change the practice of litigation services in the courts. Since the issuance of Supreme Court Regulation No. 1 of 2019 concerning Administrative of Cases and Trials in Electronic Courts on August 19, 2019, the Supreme Court Regulation No. 3 of 2018 concerning Administration of Cases in Electronic Courts was declared revoked and no longer valid. This PERMA Number 1 of 2019 perfected PERMA Number 3 of 2018 so that now not only case registration can be done online or known as e-court but the trial can also be conducted electronically namely e-litigation.

Abstract

The development of digital technology and information technology is happening very rapidly, computer systems are getting more sophisticated and internet access is getting easier making technology a part of people's daily lives, the existence of documents and or electronic information has now become a common thing. How does the Indonesian Civil Procedure Law regulates documents and or electronic information as an evidence and how does the law regulates the recognition, the validity and the strength of that evidence in the trials in order to create legal certainty for the people seeking justice.

Abstract

Artificial Intelligence is a technology that simulates human intelligence, programmed into electronic media to think and imitate human actions. Artificial Intelligence functions as a tool for restructuring, due diligence, and making deeds, raising concerns regarding potential errors in Artificial Intelligence output that could cause losses to legal subjects. This research examines legal responsibility when the output produced by Artificial Intelligence causes losses, with a focus on the careful application of notary principles as regulated in Article 16 of the Notary Position Law (UUJN). This research adopts a doctrinal legal research approach, utilizing secondary data from literature studies, archives, research reports, and legal sources such as UUJN and the Civil Code. Through qualitative analysis, this research reveals that Artificial Intelligence is not a legal subject but can be categorized as a tool that helps notaries. In terms of legal liability for losses caused by Artificial Intelligence, civil liability is given to the owner of the order, namely the person who uses and gives orders to Artificial Intelligence. This research emphasizes the need for careful consideration of legal responsibilities and prudence in notarial practice, along with the development of Artificial Intelligence technology in the legal domain.

Abstract

An authentic deed is a form as written evidence that has perfect evidentiary power or so called fautless evidence. A deed can be declared as an authentic deed if it fulfil all the terms in article 1868 of Burgerlijk Wetboek, where the deed is made in the presence of or made by public functionary, namely a notary. As a public functionary that has an authority and obligations that clearly regulated in law, when carrying out his duties a notary must follows the notary’s act and the Code of Ethics. A notarial deed cannot be canceled immediately but must go through the correct process to remove the binding status of the deed. This research was conducted to provide an understanding of the proper and correct ways for cancellation of notarial deeds that can be carried out by the parties. The research methods that uses is doctrinal research methods, with secondary data which is divided into 3 legal materials, namely, primary, secondary and tertiary which are analyzed to answer the problems in the thesis. A deed made by a notary has binding legal force for each parties in the deed, as well with regulated third party in the deed. By the process, a deed can be invalidated or annulled if it does not fulfil the formal or material terms, either based on a lawsuit by one of the parties through a the decision of a court from judge, or based on the mutual agreement of the parties through a deed of cancellation.

Abstract

Tulisan ini akan mendiskusikan salah satu modus penyelundupan hukum yaitu pendirian Perseroan Terbatas berdasarkan perjanjian pinjam nama dan tanggung jawab Notaris dalam pembuatan akta pendirian Perseroan Terbatas terkait. Penulisan ini menggunakan metode penelitian doktrinal dengan jenis data sekunder. Berdasarkan penelitian dipahami bahwa Notaris berperan dalam proses pendirian Perseroan Terbatas dengan membuat Akta Pendirian Perseroan Terbatas sebagaimana dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Tindak pidana pencucian uang dan pembatasan terhadap penanaman modal asing menjadi dasar adanya modus pendirian perseroan terbatas berdasarkan perjanjian pinjam nama sebagai bentuk penyelundupan hukum. Para pendiri Perseroan Terbatas hadir dihadapan Notaris dengan menyertakan bukti identitas bahwa dirinya adalah yang berwenang dalam melakukan perbuatan hukum dalam akta. Namun ditemukan terdapat hal-hal yang tidak diterangkan para penghadap kepada Notaris seperti adanya perjanjian pinjam nama di balik pendirian suatu perseroan. Hal ini diluar dari tanggung jawab Notaris karena Akta Pendirian Perseroan merupakan akta partij yaitu keterangan dari Para Penghadap sehingga kebenaran yang tidak dinyatakan oleh Para Penghadap kepada Notaris di luar tanggung jawab Notaris karena Notaris hanya memiliki kewajiban untuk mencari kebenaran formil.

Abstract

Individual companies exist because of the issuance of Law Number 11 of 2020 concerning Job Creation. The regulations added to the Limited Liability Company Law mean that all provisions contained therein also apply to individual companies as long as there are no special or excluded regulations, including regarding social and environmental responsibility. The problem arises regarding whether the scope of social and environmental responsibility also covers individual companies, which causes individual companies to be obliged to carry out social and environmental responsibilities and what kind of individual companies are obliged to do so. The research method used is a doctrinal method, through an approach to statutory regulations and concepts in law. The results obtained in this research show that individual companies are obliged to carry out social and environmental responsibilities as long as they meet the existing criteria and provisions. Apart from providing benefits to local people and communities, there are also benefits that companies obtain from carrying out social and environmental responsibilities, thus enabling individual companies to also have the urgency to get involved voluntarily. Considering the differences between Limited Liability Companies and Individual Companies, more specific regulations are needed regarding the implementation and supervision of the implementation of Social and Environmental Responsibility.Keywords: Social; environmental; responsibility; individual companies

Abstract

AbstrakPenelitian ini bertujuan untuk membandingkan peran notaris dan penerapan jurnal notaris di Negara Bagian New York, Amerika Serikat, dengan protokol notaris di Indonesia pada era reformasi teknologi. Dasar dari penelitian ini adalah perbedaan dalam sistem hukum yang diterapkan oleh kedua negara, yaitu sistem hukum common law di Amerika Serikat dan sistem hukum civil law di Indonesia, serta dampak perkembangan teknologi terhadap praktik notaris. Metode penelitian yang digunakan adalah pendekatan doktrinal atau normatif, yang berfokus pada analisis dan interpretasi sumber hukum seperti peraturan undang-undang, putusan pengadilan, dan doktrin hukum. Hasil penelitian menunjukkan bahwa terdapat perbedaan yang signifikan dalam peran dan fungsi notaris di Negara Bagian New York dan Indonesia, hal ini dipengaruhi oleh perbedaan dalam sistem hukum yang berlaku. Di Negara Bagian New York, notaris publik memiliki peran yang lebih terbatas dibandingkan dengan Indonesia, dimana notaris memiliki wewenang lebih luas sebagai pejabat umum untuk membuat akta otentik. Terkait implementasi jurnal notaris dan protokol notaris. Kata kunci:  notaris, jurnal notaris, protokol notaris, reformasi teknologi, perbandingan hukum AbstractThis research aims to compare the role of notaries and the implementation of notary journals in New York State, United States, with notary protocols in Indonesia during the technological reform era. The basis of this research is the differences in the legal systems applied by the two countries, namely the common law legal system in the United States and the civil law legal system in Indonesia, as well as the impact of technological developments on notary practice. The research method used is a doctrinal or normative approach, which focuses on the analysis and interpretation of legal sources such as statutory regulations, court decisions, and legal doctrine. The research results show that there are significant differences in the roles and functions of notaries in New York State and Indonesia, this is influenced by differences in the applicable legal systems. In New York State, notaries have a more limited role compared to Indonesia, where notaries have broader authority as public officials to make authentic deeds. Abstract

The strength of a Settlement Agreement Act is equivalent to ha ruling issued by the court. The Settlement Agreement Act arises from a peace agreement made during the mediation process in front of a designated judge who has the authority to act as a mediator. This peace agreement does not carry executory legal power. This is because the Settlement Agreement Act is a settlement ruling issued by the district court, reflecting the true intent and agreement of the parties involved in a civil case directly. The mediator judge plays a fundamental role in mediation; the mediator must actively work to reconcile the parties in dispute, encouraging solutions that are fair and do not disadvantage one party over the other through a comprehensive problem-solving approach
