Abstract

The implementation of Small Claims court mechanism according to Supreme Court Regulation (PERMA) Number 2/2015 concerning Procedures for Small-Claims Court Resolution recently granted a breakthrough in the civil justice system particularly in Indonesia. It was reached by the Supreme Court in order to reduce the court burden against cases with disputes below IDR 200 million rupiah. The disputes resolution by Small Claims court mechanism is done by a single judge assisted with registrar and must completed within 25 working days, the final decision is binding, thus unable to ask for appeal or judicial review. This article tries to comprehend dispute resolution through Small Claims mechanism in several state courts, such as Medan district Court, Palu, and the Jember. The study, also aims to comprehend the comparison of Small Claims mechanism in Indonesia and small claims in the Netherlands and UK in business disputes resolution. The study employs a normative juridical method. Based on the studies, the implementation through Small Claims court mechanism in Indonesia has been carried out in accordance with the Supreme Court Regulation Number 2/2015. Comparison on business dispute resolution using Small Claims court mechanism in Indonesia and in Netherlands and UK proof that the proof mechanisms whether in Indonesia, Netherlands and United Kingdom relatively simple. Legal remedies for Small Claims decision in Indonesia and the verdict in the Netherlands and in England are limited. The distinction is that the case number in Indonesia is higher than the number in the Netherlands and England.

Abstract

Improving legal certainty to attract foreign investment is very significant because it is one of very important consideration which involved in the decision to choose where to invest. In relation to legal certainty, an issue that has being discussed intensively is the investment conducted by Qatar Telecom, a big company form Middle East and a shareholder of PT. Indosat Tbk. The legal issue which arise is, Qtel would like to buy Indosat shares and increase its shares in PT. Indosat to be more than 50%. However under Presidential Regulation No. 111/2007, the maximum of foreign capital ownership limit in the business sector of telecommunication was 49%. Then, Ministry of Economic Coordinator concluded for any company that had been invested before the enactment of Presidential Regulation No. 111/2007 was governed by existing Negative List of Investment at the time the company established. This article analyzes the enforcement of Negative List of Investment regulated in Presidential Regulation No.111/2007 to the investment in the capital market.

Abstract

n 2014, Indonesia implemented measures relating to the importation of horticultural products,animals, and animal products which were seen as a trade barrier in the form of quantitative restrictions imposed through the import licensing system. This article analyzes whether the paneland appellate body decision in the case of Indonesia -Importation of Horticultural Products, Animals and Animal Products under the provisions contained in the WTO legal framework. Indonesias policies cannot be justified under WTO legal framework, thoughthere are some exceptions to the quantitative restriction provision.

Abstract

The process of resolving cases at a trial is not always carried out conventionally ie the parties come directly to the trial but can be done online. This is marked by the launch of the e-court application on July 13, 2018. With the launch of the e-court application, the Supreme Court has moved towards electronic justice which will fundamentally change the practice of litigation services in the courts. Since the issuance of Supreme Court Regulation No. 1 of 2019 concerning Administrative of Cases and Trials in Electronic Courts on August 19, 2019, the Supreme Court Regulation No. 3 of 2018 concerning Administration of Cases in Electronic Courts was declared revoked and no longer valid. This PERMA Number 1 of 2019 perfected PERMA Number 3 of 2018 so that now not only case registration can be done online or known as e-court but the trial can also be conducted electronically namely e-litigation.

Abstract

As financial institutions, banks are required to have customer data protection mechanisms. This is for the sake of the banking busines’ continuity that is being undertaken. The sustainability of a bank's business is largely determined by the trust of the customers to save funds and use bank services. The customer data protection mechanism is one of a risk management form that is primarily aimed at protecting customer personal data, which is useful for preventing the risk of misuse of bank customer data by irresponsible persons. This study aims to discuss the provisions regarding the protection of customer data by banks in Indonesia in order to prevent banking crimes, especially embezzlement of customer funds. In order to conduct this study's normative legal research, secondary data sources were examined by collecting legal materials by means of a literature search supported by interviews. Based on the results of the research, it was found that although banks have their own protection mechanisms following the provisions stipulated by the Financial Services Authority (OJK) and Bank Indonesia (BI) as part of risk management, each bank has a system that is not necessarily the same as other banks. By reviewing the implementation of PT. Bank X and PT. Bank Y, Banks in general have an IT system to store customer data which can only be accessed by certain bank employees with an interest, and the opening of this data can be done in accordance with banking regulations. For fraud prevention mechanisms, banks enforce various kinds of internal and external protection in accordance with OJK and BI regulations.

Abstract

Ultimum Remedium is a principle that means criminal sanctions should be the last resort in solving a problem, where civil and administrative sanctions are prioritised. In this journal, the researcher will discuss how this principle relates to the authority held by the Notary Honorary Council in limiting actions against the law committed by notaries. This study uses normative juridical research, where the law serves as a foundation for examining legal regulations related to legal issues regarding unlawful acts committed by notaries.

Abstract

Notaris memiliki peran dalam pendirian perseroan terbatas ( perseroan ) yaitu membuat akta pendirian perseroan. salah satu tugas dan tanggungjawab notaris adalah memastikan bahwa modal perseroan pada saat pendirian perseroan harus memenuhi Pasal 33 ayat (1) Undang-Undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas ( UUPT ) yaitu 25% modal ditempatkan dan disetor penuh dari modal dasar perseroan. Oleh karena itu, rumusan masalah dalam penilitian ini adalah bagaimanakah pertanggungjawaban notaris terhadap akta pendirian Perseroan yang tidak memenuhi Pasal 33 ayat (1) UUPT dan bagaimanakah akibat dari akta pendirian Perseroan yang tidak memenuhi Pasal 33 ayat (1) UUPT. Metode penelitian ini menggunakan yuridis normatif dengan tipe penelitian deskriptif dan menggunakan data sekunder yang diperoleh melalui studi dokumen. Hasil penelitian ini adalah pertanggungjawaban notaris terhadap akta pendirian Perseroan yang tidak memenuhi Pasal 33 ayat (1) UUPT adalah tanggung jawab administratif karena telah melanggar Pasal 16 ayat (1) huruf a UUJN dan tanggungjawaban kode etik notaris karena melanggar Pasal 3 ayat (3) Kode Etik Notaris dengan bentuk sanksi berupa teguran tertulis. Berikutnya adalah akibat dari akta pendirian Perseroan yang tidak memenuhi Pasal 33 ayat (1) UUPT adalah perseroan dapat dibubarkan atas dasar pengajuan permohonan pembubaran kepada pengadilan oleh pihak yang berkepentingan. Hal ini dikarenakan akta pendirian perseroan tidak menerapkan Pasal 8 ayat (2) huruf c dan Pasal 15 ayat (1) huruf d UUPT, sehingga akta pendirian perseroan mengandung cacat hukum.

Abstract

 The purpose of this paper is to analyze the policy of the Apostille Convention in Indonesia and the responsibilities of a notary in the document legalization process. A simpler legalization process with less time and cost is comprehensively regulated in The Hague Convention Abolishing the Requirements for Legalization for Foreign Public Documents 1961 (Apostille Convention). A notary is a public official who is authorized to make deeds and other authorities. The duties and work of a notary are not only to make authentic deeds but also to register and ratify underhanded deeds, namely legalization and waarmerking efforts. Notaries have a role in the Apostille Convention which has been accessed by Indonesia as a public official who legalizes every deed legalized by the parties. This study questions the legalization of foreign public documents in Indonesia after the Apostille Convention comes into effect and the legal responsibilities of a notary in the document legalization process after the Apostille Convention comes into effect in Indonesia. The conclusion of this study is that the Apostille Convention aims to simplify the authentication of public documents to be used abroad by removing the requirements for legalization, which is often time-consuming and expensive and still requires the role of an authorized notary in legalizing foreign public documents.Tujuan dari tulisan ini untuk menganalisis kebijakan Konvensi Apostille di Indonesia dan tanggung jawab Notaris dalam proses legalisasi dokumen. Proses legalisasi yang lebih sederhana dengan waktu dan biaya yang tidak begitu banyak, diatur secara komprehensif dalam The Hague Convention Abolishing the Requirement for Legalisation for Foreign Public Documents 1961 (Apostille Convention). Notaris adalah pejabat umum yang berwenang dalam membuat akta dan kewenangan lainnya. Tugas dan pekerjaan dari seorang Notaris tidak hanya membuat akta autentik, akan tetapi juga melakukan pendaftaran dan mengesahkan akta-akta yang dibuat dibawah tangan yaitu upaya legalisasi dan waarmerking. Notaris mempunyai peran dalam Konvensi Apostille yang telah diaksesi oleh Indonesia sebagai pejabat umum yang melegalisasi setiap akta yang dilegalisasi oleh para pihak. Penelitian ini mempertanyakan legalisasi dokumen publik asing di Indonesia setelah keberlakuan Apostille Convention dan tanggung jawab hukum Notaris dalam proses legalisasi dokumen setelah keberlakuan Apostille Convention di Indonesia. Kesimpulan dari penelitian ini adalah Konvensi Apostille bertujuan menyederhanakan autentikasi dokumen publik yang akan digunakan di luar negeri dengan menghapus persyaratan untuk legalisasi, yang seringkali memakan waktu dan mahal serta tetap membutuhkan peranan Notaris yang berwenang dalam melegalisasi dokumen publik asing.

Abstract

The accountability mechanism in Sovereign Wealth Funds (SWF) is a crucial aspect in ensuring transparency and sustainability in the management of state investment funds. This mechanism is reflected in the implementation of oversight and managerial responsibility within SWFs. BPI Danantara, as Indonesia’s SWF, operates under an internal oversight system involving a Board of Supervisors, an audit committee, and external monitoring from public auditors and relevant state institutions in a decentralized manner. In terms of managerial responsibility, the Business Judgment Rule (BJR) is applied, providing legal protection for managers in investment decision-making, as long as it is conducted in good faith and without negligence. However, this mechanism still poses a significant risk of corruption due to Indonesia’s low Corruption Perceptions Index (CPI) score. Meanwhile, Norway’s Government Pension Fund Global (GPFG) has a stricter oversight structure, with a hierarchical reporting system from Norges Bank Investment Management (NBIM) to the Ministry of Finance and direct supervision by the Norwegian Parliament. Although GPFG does not apply BJR, it has consistently achieved the highest transparency scores and enjoys stronger public trust in its governance. This study aims to analyze the differences in supervisory regulations and managerial accountability between these two institutions.

Abstract

This study has two aims. The first aim is to examine the binding force of the Conditional Sale and Purchase Agreement of the Right of Land (CSPA-Land) based on applicable provisions and Supreme Court Circular No.4/2016 (SCC No.4/2016). The second aim is to examine the legal position of the CSPA-Land to Sale and Purchase Agreement of the Right of Land (SPA-Land) when there is a prospective buyer’s bad faith based on Decision Number 241/Pdt.G/2021/PN.Jkt.Tim jo. Decision Number 126/Pdt/2023/PT DKI. The research method employed is the doctrinal legal research method using secondary data. There are two conclusions. First, under Article 1338 (1) jo. Article 1340 (1) of the Civil Code, a valid CSPA-Land has binding force as law for the parties. Based on SCC No.4/2016, the CSPA-Land results in the transfer of land rights provided the price has been paid in full and the object is controlled by the buyer in good faith. Second, referring to Decision No.241/Pdt.G/2021/PN.Jkt.Tim jo. Decision No.126/Pdt/2023/PT DKI, the CSPA-Land is an agreement that regulates the obligations of the parties that must be fulfilled to make a SPA-Land. When there is any obligation not fulfilled by one party, the other party's refusal to make the SPA-Land does not constitute a default. The existence of the prospective buyer’s bad faith is the basis for the cancellation of the CSPA-Land.” litian ini memiliki dua tujuan. Pertama, mengkaji kekuatan mengikat Perjanjian Pengikatan Jual Beli Hak atas Tanah (PPJB-Tanah) berdasarkan ketentuan yang berlaku dan Surat Edaran Mahkamah Agung No.4/2016 (SEMA No.4/2016). Kedua, mengkaji kedudukan hukum PPJB-Tanah terhadap Akta Jual Beli Hak atas Tanah (AJB-Tanah) dalam hal adanya itikad tidak baik calon pembeli berdasarkan Putusan No.241/Pdt.G/2021/PN.Jkt.Tim jo. Putusan No.126/Pdt/2023/PT DKI. Metode penelitian yang digunakan adalah metode penelitian hukum doktrinal dengan menggunakan data sekunder. Ada dua simpulan. Pertama, berdasarkan Pasal 1338 (1) jo. Pasal 1340 (1) KUHPerdata, PPJB-Tanah yang sah mempunyai kekuatan hukum mengikat bagi para pihak yang membuatnya. Berdasarkan SEMA No.4/2016, PPJB-Tanah menyebabkan pemindahan hak atas tanah sepanjang harga telah lunas dan objek dikuasai pembeli dengan itikad baik. Kedua, mengacu pada Putusan No.241/Pdt.G/2021/PN.Jkt.Tim jo. Putusan No.126/Pdt/2023/PT DKI, PPJB-Tanah merupakan perjanjian yang mengatur tentang kewajiban para pihak yang harus dipenuhi untuk membuat AJB-Tanah. Apabila ada kewajiban yang tidak dipenuhi oleh suatu pihak, maka penolakan pihak yang lain untuk membuat AJB-Tanah bukan merupakan suatu wanprestasi. Adanya itikad tidak baik calon pembeli merupakan dasar untuk PPJB-Tanah batal.
