Abstract

Pengadilan agama dapat mengeluarkan dispensasi pernikahan kepada calon pengantin yang berada di bawah usia pernikahan yang sah karena alasan yang memaksa, seperti kehamilan yang tidak terduga. Metodologi kualitatif berdasarkan analisis deskriptif dan penilaian menyeluruh terhadap literatur yang relevan membentuk strategi penelitian penelitian ini. Berikut hasil penelitian tersebut: Berdasarkan Undang-Undang No. 1 tahun 1974 sampai dengan Undang-Undang No. 16 tahun 2019 tentang perubahan usia minimum perkawinan, calon pengantin harus berusia 19 tahun untuk menikah, menurut analisis hukum dari putusan perkara perkawinan. Namun demikian, menurut Pasal 7 (2), dalam keadaan darurat, pasangan tersebut dapat mengajukan permohonan pengabaian ke pengadilan dengan memberikan bukti yang cukup. Yang kedua adalah perlindungan jiwa dan anak-anak melalui dispensasi pernikahan bagi ibu hamil, yang didasarkan pada berkah dzaruriyah dan memastikan hak dan kehormatan anak ditegakkan.

Abstract

The misuse of personal data in online lending in Indonesia has become an important issue alongside the rapid growth of the digital finance sector. This study aims to analyze personal data protection in the context of online lending, focusing on Law No. 27 of 2022 and POJK No. 22 of 2023. The method used is a normative legal approach with a descriptive-analytical approach, which includes an analysis of legislation and data protection practices in the industry. The research subjects include both regulations and how they are applied in practice. Data collection techniques were conducted through document studies, including analysis of laws, regulations, and related literature. The main theory used is the theory of personal data protection, which emphasizes individual rights and the responsibilities of data controllers. The results of the study show that Law No. 27 of 2022 and POJK No. 22 of 2023 provide a comprehensive legal framework for personal data protection in online lending, with an emphasis on individual rights and the responsibilities of data controllers. Although this legal framework is already strong, there are still challenges in its implementation, so further efforts are needed to ensure effective personal data protection in this sector. The academic contribution of this research is to provide new insights into the effectiveness of regulations in protecting personal data and to encourage discussion on improving data protection implementation in the digital finance sector.Keywords: Personal Data Protection, Online Lending.

Abstract

Kasus kekerasn seksual terhadap anak masih kerap terjadi, tragisnya dalam banyak kasus kekerasan seksual terhadap anak, pelaku paling sering berasal dari lingkungan keluarga atau lingkungan di mana anak tersebut berada (rumah, masyarakat, sekolah, dan lain-lain). Wujud perlindungan dalam Islam termuat dalam konsep Maqashid Syariah yang setidaknya mencakup 5 bentuk perlindungan yakni: hifdz al-din (menjaga agama), hifdz an-nafs (menjaga jiwa), hifdz al-aql (menjaga akal), hifdz an-nasl (menjaga kehormatan/ keluarga) dan hifdz al-mal (menjaga harta). Tujuan penelitian ini adalah pertama untuk mengetahui lebih dalam psikologis anak korban kekerasan seksual pasca ditangani oleh Yayasan Rumah Aman Wadah Kreatif Cirebon. Kedua, Untuk mengkaji lebih upaya penanganan secara psikologis yang dilakukan oleh Yayasan Rumah Aman Wadah Kreatif Cirebon terhadap anak korban kekerasan seksual. Ketiga, Untuk mengkaji lebih dalam perlindungan anak korban kekerasan seksual berdasarkan Maqosid Syari’ah.Metode penelitian yang digunakan oleh penulis adalah metode kualitatif, dimana penelitian ini bersifat deskriptif dan cenderung menggunakan analisis dan memanfaatkan teori sebagai pemandu agar fokus penelitian sesuai dengan fakta di lapangan. Jenis penelitian yang digunakan adalah penelitian lapangan (field research), yaitu penelitian yang dilakukan secara sistematis dan mengambil data di lapangan, seperti mengamati lingkungan dan mengambil data yang dibutuhkan untuk penelitian dalam bentuk wawancara. Pendekatan Penelitian yang digunakan dalam penelitian ini adalah deskriptif.Kesimpulan yang dapat diperoleh adalah Pertana bahwa kondisi psikologis anak sebelum dibina oleh yayasan rumah aman anak cenderung stress, pendiam, mengalami perasaan tidak berharga, bahwa dirinya tidak berguna dan menjadi anak yang tidak diinginkan. Kedua, penangan psikologis yayasan rumah aman adalah dengan pendekatan Exposure therapy,dan Cognitive Therapy. Ketiga, kekerasan seksual ditinjau dari sudut pandang Hukum Islam dalam konsep Maqashid Syariah berada pada posisi yang sangat urgen, yakni pada tingkatan derajat dharuriyyah.

Abstract

Interfaith marriage is a complex social and legal phenomenon in Indonesia's pluralistic society. In Islam , marriage is not just a social contract, but part of worship that must be in accordance with the provisions of the Sharia. This paper analyzes the Qur'anic verses related to the law of interfaith marriage, especially QS. Al-Baqarah [2]:221, QS. Al-Mumtahanah [60]:10, and QS. Al-Maidah [5]:5, through classical and contemporary tafsir approaches. This study shows that Islam strictly prohibits marriage between Muslims and polytheists because it has the potential to damage faith and household stability, but provides limited exceptions for Muslim men to marry women of the Book under certain conditions. The different interpretations of scholars such as Imam Syafi'i, Ibn Kathir, Ibn Hazm, and Abu Hanifah reflect the dynamics of fiqh in understanding the social and theological context of each era. In the context of Indonesian positive law, through Law Number 1 of 1974 and the Compilation of Islamic Law (Presidential Instruction No. 1 of 1991), the state emphasizes that interfaith marriages are not valid according to Islamic law. Thus, the discussion of the interpretation of these legal verses provides a theological and normative basis that the sanctity of faith is the main foundation in the formation of an Islamic family in Indonesia.

Abstract

The crime of corruption is an extraordinary crime that has a broad impact on the morality of the nation, social justice, and the sustainability of national development. In the Islamic perspective, corruption is not only seen as a violation of positive law, but also as an act of great sin that contains elements of betrayal of trust and creates social damage (fasad fil-ardh). Therefore, handling corruption is not sufficient through legal instruments alone, but also requires a moral and spiritual approach based on the values of the Qur'an and hadith. This article aims to examine the implementation of corruption crimes in the perspective of tafsir and hadith by examining Qur'anic verses related to the concepts of ghulul (betrayal), risywah (bribery), sariqah (theft), and hirabah (robbery), as well as traditions that condemn similar behavior. This study uses a normative qualitative approach with thematic interpretation (mauḍu'i) and hadith analysis methods to find Islamic universal values in the prevention and eradication of corruption. The results of the study show that the implementation of the crime of corruption in the perspective of tafsir and hadith is a moral and spiritual deviation that is contrary to Islamic teachings. The Qur'an describes corruption through the terms ghulul (embezzlement), risywah (bribery), which will cause fasad fil-ardh (damage), all of which indicate the unauthorized deprivation of other people's rights. QS. Al-Baqarah: 188 prohibits consuming wealth through unlawful means, while the Hadith narrated by Bukhari No. 3196 emphasizes severe punishment for the perpetrators. Corruption is a grave sin that violates the principles of trust and justice, so its eradication must be through strict law enforcement and moral guidance based on the values of the Qur'an and hadith.
